About this file

This is a Solicitation Amendment for an Electronic Fareboxes procurement by Bay Area Rural Transit (BART) with Solicitation Number 20250624. The amendment modifies the original Request for Proposal (RFP) and provides clarifications on various technical and procedural requirements. Key changes include updates to federal participation guidelines, specifically regarding Buy America requirements for purchases over $150,000, and modifications to farebox physical requirements such as allowing individualized vault dump systems instead of centralized systems. The solicitation covers the procurement of electronic fareboxes and related equipment, with proposals due by the original deadline and no extension granted.

The amendment includes detailed federal funding compliance requirements, particularly related to the Infrastructure Investment and Jobs Act, which mandates domestically sourced steel and components. Vendors must submit a Current Major Components and Sub-assemblies Buy America Spreadsheet prior to order placement and at delivery, demonstrating at least 60-70% domestic content depending on the fiscal year. BART will self-install the equipment, and no bid bond is required. The pricing proposal must be all-inclusive, and proposers are expected to comply with all specifications outlined in the original RFP. The solicitation allows for DocuSign signatures and provides a mailing address in Ashland, Wisconsin for submissions.

39. BUY AMERICA REQUIREMENTS

49 U.S.C. 5323(j)

49 CFR Part 661

Applicability to Contracts

The Buy America requirements apply to the following types of contracts: Construction Contracts and Acquisition of Goods or Rolling Stock (valued at more than

$150,000).

Flow Down Requirements: The Buy America requirements flow down from FTA recipients and subrecipients to first tier contractors, who are responsible for ensuring that lower tier contractors and subcontractors are in compliance. The $150,000 threshold applies only to the grantee contract, subcontracts under that amount are subject to Buy America.

Mandatory Clause/Language: The Buy America regulation, at 49 CFR 661.13, requires notification of the Buy America requirements in FTA-funded contracts, but does not specify the language to be used. The following language has been developed by FTA.

Buy America - The contractor agrees to comply with 49 U.S.C. 5323(j) and 49 C.F.R. Part 661, which provide that Federal funds may not be obligated unless steel, iron, and manufactured products used in FTA-funded projects are produced in the United States, unless a waiver has been granted by FTA or the product is subject to a general waiver. General waivers are listed in 49 CFR 661.7, and include software, microcomputer equipment and small purchases (currently less than $150,000) made with capital, operating, or planning funds. Separate requirements for rolling stock are stated at 5323(j)(2)(C) and 49 CFR 661.11. Rolling stock must be manufactured in the US and have a minimum 60% domestic content for FY2016 and FY2017, a minimum 65% domestic content for FY2018 and

FY2019 and a minimum 70% domestic content for FY2020 and beyond.

A bidder or offeror must submit to the FTA recipient the appropriate Buy America certification (below) with all bids or offers on FTA-funded contracts, except those subject to a general waiver. Bids or offers that are not accompanied by a completed Buy America certification must be rejected as nonresponsive. This requirement does not apply to lower tier subcontractors.

Certification requirement for procurement of steel, iron, or manufactured products.

Questions and Answers

Amendment 1 contains questions that were received after the Questions and Answer period concluded. WisDOT identified these questions as integral to the nature of the solicitation and have elected to answer them.

Quest.

No.

Question Answer

1. Please let us know if BART is open to a solution that meets BART’s budget and stated technical requirements, while exceeding the RFP by adding a rider mobile app, expandability to small fleet vehicles to unify payments on those vehicles, and fare policy flexibility including fixed/variable/zone-based fares, but does so using a manual farebox, driver console, and validator - and thus is not an electronic farebox?

We would note that this solution still meets most cash-focused requirements such as electronic records, contactless payments, options for inexact fare payments and operator overrides. It can also secure cash in transit and provide a centralized vault. It would not require a probe and would not provide an electronic bill validator.

Please see RFP for requirements. Minimum specifications must be met to be considered for award.

2. Please clarify how vendors should include the cost of a central vault on the price sheet?

Please see amended RFP Document section 7.1.7.

Please see RFP for requirements. Per section 8.12 and Attachment A - Pricing Proposal: “The total cost provided must be all inclusive to carry out the services included in this RFP”.

3. Can BART please clarify if they require deposit access to the vault to be physically separated from removing cash? To be specific, does the vault need to be a through-the-wall solution to accommodate a secure cash-processing room?

Both options are acceptable.

4. Please confirm that BART intends to install the equipment themselves or how installation should be included on the price sheet?

BART will be installing the equipment.

5. Does BART desire to extend physical retail outlets to institutions, local retailers, or national chain stores like Walmart and CVS at which riders may already be shopping.

Please see RFP for requirements. If it is not listed in the RFP, then it is not required.

6. Will the agency accept DocuSign for signatures? Yes.

7. Would the agency consider a three-week extension of the deadline to September 12, 2025?

No.

8. Is a bid bond required for this project? No. Please see RFP for requirements. If it is not listed in the RFP, then it is not required.

9. Can the agency provide a physical mailing address for the submission?

Bay Area Rural Transit

P.O. Box 612

2216 6th St. E

Ashland, WI 54806

10. How would the agency prefer proposers to include additional or alternate terms and conditions?

Please see section 13.4 Tab 5.

11. Will Federal funding be used for this project and if so, will the source of that funding be from USDOT and the Infrastructure Investment and Jobs Act?

Please see Attachment G - Federal Clauses and section 1.7.

12. If the question above is yes or possibly, will Build America Buy America requirements associated with that funding be applied and thus require domestically sourced steel and components for hardware?

Yes, please see ATTACHMENT G – FEDERAL CLAUSES, SECTION 39,

13. If so, how will the agency verify domestic steel content during this procurement?

Please see amended RFP Document Section 1.7: A Current Major components and Sub-assemblies Buy America Spreadsheet must be sent via email, to the “End user or noted Ship to contact” as listed on the purchase order, PRIOR to the order being officially placed AND at the time of delivery.

14. If the agency is not using Federal funding, will you provide preference to submissions that utilize steel sourced in the United States?

Please see Attachment G - Federal Clauses and section 1.7.

15. Does BART have a preferred transfer media? Magnetics? Barcoded ticket?

No.

16. Does BART intend to procure smart cards, Point of Sale, and mobile ticketing as part of this RFP?

Please see RFP for requirements. If it is not listed in the RFP, then it is not required.

17. If so, does BART intend for those electronic payment methods to be validated on the farebox?

Please see RFP for requirements. If it is not listed in the RFP, then it is not required.

18. Noting that Federal funding is to be used in this contract, and the various federal clauses are required, will Buy America provisions apply?

Yes, please see Attachment G - Federal Clauses and section 1.7.

19. The RFP requests "a fare collection vault dump system” but a vault is not part of the pricing form.

- Can the pricing form be modified

- Are there further specifications available (quantity, size, integration with data collection system, etc)

Please see amended RFP Document section 7.1.7.

Per section 8.12 and Attachment A - Pricing Proposal: “The total cost provided must be all inclusive to carry out the services included in this RFP”. Also, “Proposals may be disqualified if the price sheet is altered and not completed as designed”.

20. Can the pricing form (updated if necessary) be provided in excel format?

Excel version has been uploaded to Vendornet.

21. Can you please confirm the deadline for exceptions and additions to the RFP? On page 26 it notes:

“Any questions, exceptions, or additions concerning this RFP must be submitted in writing on or before 8/4/2025 by 2 PM CT to: __Nick Esberner, n.esberner@bartbus.com____________________ Vendors are expected to raise any questions, exceptions, or additions they have concerning the RFP document by the Question Due Date specified in this RFP. Questions must be submitted to the Procurement Manager in writing via email.”

But on page 11 it says that “Questions, noted errors, discrepancies, ambiguities, exceptions, additions, or deficiencies noted in this solicitation must be submitted by e-mail to the identified Procurement Administrator prior to the specified solicitation closing date.”

Please advise so we may proceed accordingly.

Questions were due on 8/4/2025 by 2 PM CT.
