About this file

This Amendment One to a Request for Proposal (RFP) issued by the South Carolina Department of Health and Environmental Control (DHEC) pertains to a Turnkey Mobile COVID Vaccination Service. The solicitation (Number 5400021476) seeks qualified contractors to provide mobile vaccination services using self-contained units to administer COVID-19 vaccines throughout South Carolina. Offerors must submit responses by June 24, 2021, at 2:30 PM ET, with questions due by June 8, 2021, at noon ET. No pre-bid conference or site visit is required. Award will be announced on June 30, 2021. The procurement officer is Rebecca Nichols, contactable at 803-898-1262 or nicholrj@dhec.sc.gov. Submissions must be made online through the South Carolina Procurement system at procurement.sc.gov, with supplementary hard copies required including one original, one copy on USB drive (excluding price proposal), one sealed copy of the price proposal, one price proposal on USB drive, and one redacted hard copy if applicable. Multiple awards are anticipated, with allocations determined by region based on contractor capacity and state needs.

Amendment One clarifies submission requirements, including that technical proposals and price proposals must be submitted as two separate documents with the price proposal in a sealed envelope. Mandatory qualifications require contractors to be enrolled as COVID-19 vaccine providers with CLIA certification. Contractors must provide all vaccinators and support staff under direct supervision with no subcontracting permitted. The state will conduct advertising at no contractor cost, though contractors may perform additional advertising at their own expense. Vendors must ensure no out-of-pocket costs for vaccine recipients. Travel costs and minimum daily vaccination quantities must be included in pricing; if minimum daily quantities are not met, contractors may still bill for the minimum. The solicitation establishes this as a master contract for DHEC use only, with contractor-state collaboration on route determination based on demand, vaccine storage and handling per provider agreements, and data reporting per SIMON system requirements.

RESTRICTIONS ON PRESENTING TERMS OF USE OR OFFERING ADDITIONAL SERVICES (FEB 2015)

(a) Citizens, as well as public employees (acting in their individual capacity), should not be unnecessarily required to agree to or provide consent to policies or contractual terms in order to access services acquired by the government pursuant to this contract (hereinafter “applicable services”) or, in the case of public employees, to perform their job duties; accordingly, in performing the work, contractor shall not require or invite any citizen or public employee to agree to or provide consent to any end user contract, privacy policy, or other terms of use (hereinafter “terms of use”) not previously approved in writing by the procurement officer. Contractor agrees that any terms of use regarding applicable services are void and of no effect.

(b) Unless expressly provided in the solicitation, public contracts are not intended to provide contractors an opportunity to market additional products and services; accordingly, in performing the work, contractor shall not – for itself or on behalf of any third party – offer citizens or public employees (other than the procurement officer) any additional products or services not required by the contract.

(c) Any reference to contractor in items (a) or (b) also includes any subcontractor at any tier. Contractor is responsible for compliance with these obligations by any person or entity that contractor authorizes to take any action related to the work.

(d) Any violation of this clause is a material breach of contract. The parties acknowledge the difficulties inherent in determining the damage from any breach of these restrictions. Contractor shall pay the state liquidated damages of $1,000 for each contact with a citizen or end user that violates this restriction. [07-7B212-1]

The following prospective offeror question and agency response is hereby incorporated into the solicitation:

QUESTION 1: Page 4 of the RFP states, “3. One (1) each separate copy of the Price Proposal (marked “Price Proposal”) in a separate sealed envelope. 4. One (1) each separate individual copy of your Price Proposal on a USB drive identical to the paper copy, labeled ‘Price Proposal’”. Page 17 of the RFP states, “(c) The contents of your offer must be divided into two parts, the technical proposal and the business proposal. Each part should be bound in a single volume,”.

a. Please clarify which instruction is correct?

i. For hard-copy and online proposal submissions, should offerors provide a single volume with two parts (i.e., Technical Proposal and Price Proposal)

ii. Or should offerors provide two separate proposal volumes (i.e., a separate and distinct Technical Proposal and a separate and distinct Price Proposal)?

b. Also, please confirm that the “Price Proposal” and “Business Proposal” are one and the same?

STATE’S RESPONSE: The Offeror’s Technical Proposal and Price Proposal are to be submitted as two (2) separate documents, with the Price Proposal in a sealed envelope; and two (2) separate USB drives, labeled accordingly. The “Price Proposal” and “Business Proposal” are synonymous.

QUESTION 2: Please clarify if offerors should submit the signed Cover Pages (pages 1 & 2 of the RFP) as part of their Technical Proposal response (via the online system and hard copy mailed to SC DHEC)?

a. If not, please clarify if offerors should provide the Cover Pages as a Stand-Alone document and include it under

“Notes and Attachment” tab in the online system?

STATE’S RESPONSE: Offerors may submit Cover Pages 1 & 2 of the RFP in either their Technical Proposal or as a Stand- Alone document.

QUESTION 3: Would SC DHEC like offerors to provide copies of their CLIA certification?

a. If so, may we submit it as an Appendix to the Technical Proposal response?

STATE’S RESPONSE: Proof of CLIA certification may be submitted as an Appendix to the Technical Proposal response.

QUESTION 4: Page 4 of the RFP states, “2. Individual copies of your Offer on One (1) USB drive, identical to the Original (but NOT including the “Price Proposal”)”

a. Kindly clarify if SC DHEC would like offerors to provide one (1) copy of their Technical Proposal on one (1) USB drive.

STATE’S RESPONSE: Offerors are to provide one (1) copy of their Technical Proposal on a USB drive.

QUESTION 5: Page 4 of the RFP states, “4. One (1) each separate individual copy of your Price Proposal on a USB drive identical to the paper copy, labeled “Price Proposal.””

a. Should the Price Proposal on a USB drive be included in the separate sealed envelope with the Price Proposal?

STATE’S RESPONSE: A labeled Price Proposal on a USB drive does not require a separate envelope.

QUESTION 6: Page 4 of the RFP states, “5. One (1) Redacted Hard Copy (marked “Redacted”), if applicable. (See Section IV

– “Submitting Redacted Offers”.”

a. Should offerors provide the redacted hard copy for both the technical proposal and price proposal?

i. If so, should offerors include the redacted hard copy of the price proposal in the sealed envelope with the Price

Proposal and the hardcopy on USB? Please clarify.

STATE’S RESPONSE: Offerors may submit “Redacted” copies in the appropriate sealed envelopes. “Redacted” copies must be marked “Redacted”

QUESTION 7: On page 22, Section V. Qualifications, QUALIFICATIONS - SPECIAL STANDARDS OF RESPONSIBILITY (MAR 2015), subsection (a), it states: UNLESS YOU POSSESS THE FOLLOWING MANDATORY MINIMUM QUALIFICATIONS, DO NOT SUBMIT AN OFFER: 1.Contractor shall be enrolled in COVID-19 vaccine provider as outlined:

https://scdhec.gov/covid19/guidance-healthcare-professionals-covid-19/covid-19-vaccine-provider-enrollment Can this be revisited? Due to the nature of the COVID-19 pandemic, companies that are known to be healthcare staffing agencies have fulfilled similar scope of work related to this RFP. We do not have a physical brick and mortar, nor are we a vaccine provider in the sense of being a pharmacy. We do have highly relevant experience in providing COVID-19 vaccinations as a mobile medical service in a state similar to the size of South Carolina. Mandatory enrollment would disqualify companies that are capable.

STATE’S RESPONSE: The Mandatory Minimum Qualifications cannot be revisited. The provider must be an enrolled COVID vaccine provider.

QUESTION 8: In the price sheet, what does “extended price” refer to? Do we leave this blank?

STATE’S RESPONSE: Extended price refers to the Unit Price multiplied by the Quantity.

QUESTION 9: If we are submitting our bid via https://vendorportal.sc.gov.irj/portal - can you clarify if hard copy is also required to be sent (per “NUMBER OF COPIES – Pages 3 and 4 of the solicitation). Page 15 of the solicitation indicates bids should be per “ON-LINE BIDDING INSTRUCTIONS.” And that “Paper offers are discouraged.” On page 3, it is not clear https://scdhec.gov/covid19/guidance-healthcare-professionals-covid-19/covid-19-vaccine-provider-enrollment if the instructions under “NUMBER of COPIES” applies to “INSTRUCTIONS FOR OFFERORS SUBMITTING HARD COPY BIDS” only. Or…if the “NUMBER OF COPIES” section is applicable to both “on-line” and “hard copy” bids.

STATE’S RESPONSE: Under NUMBER OF COPIES on Page 3 of the solicitation document it states:

Offerors will need to follow these instructions carefully when responding to the solicitation online.

1. The original solicitation response should be submitted on-line and is the official response.

2. All Offerors should attach all additional requested documents to their response in the online system. These documents can be attached under the “Notes and Attachment” tab in the online system either on the main response page or under the necessary line item.

In addition to the offer you submit online, the Offeror must submit the following:

1. One (1) original (hard copy) marked “ORIGINAL”

2. Individual copies of your Offer on One (1) USB drive, identical to the Original (but NOT including the “Price

Proposal”)

3. One (1) each separate copy of the Price Proposal (marked “Price Proposal”) in a separate sealed envelope.

4. One (1) each separate individual copy of your Price Proposal on a USB drive identical to the paper copy, labeled

“Price Proposal.”

5. One (1) Redacted Hard Copy (marked “Redacted”), if applicable. (See Section IV – “Submitting Redacted

Offers”.

In addition to the online offer, the additional items listed above are requested.

QUESTION 10: How many sites is the state requesting the vendor to service per day?

STATE’s RESPONSE: The number of sites the State is requesting is dependent upon location, demand, and expectation for number of vaccines to potentially be administered.

QUESTION 11: What is the expected average number of vaccinations per site, per day or week?

STATE’S RESPONSE: See response to Question 10.

QUESTION 12: Is the expectation that the mobile teams have infrastructure to set up an ad hoc site or using the site facilities?

STATE’S RESPONSE: The purpose of this solicitation is to identify providers who can administer vaccines directly from a mobile unit.

QUESTION 13: If demand is not there to fill a site’s capacity 7 days a week, would the vendor’s still be paid at the minimum capacity for the full 7 days?

STATE’S RESPONSE: Refer to instruction/explanation under Section VIII. BIDDING SCHEDULE / PRICE-BUSINESS PROPOSAL of the solicitation (page 33) for guidance.

QUESTION 14: Internet Explorer: On page 3 of the RFP, reference is made to utilizing Internet Explorer 8, 9 or 10. Our understanding is that these Internet Explorer versions have been out of service for some time. The most recent version 10, stopped receiving security updates in January of 2020.

a. Does the State need to revise this requirement?

b. What current browser can be utilized?

STATE’S RESPONSE: The statement is unchanged.

QUESTION 15: Multiple Awards: On page 8 the RFP indicates that "multiple awards are anticipated."

a. Can the State please describe on what basis the awards will be made - per region or some other basis?

b. Will multiple awards be made to the same basis or category? If for example the State awards based on region, would there be more than one awardee for the same region? If so, how will that region be divided between awardees?

c. If there are multiple awardees, are the awards divided up equally or how will that work?

STATE’S RESPONSE: Awards will be made to the highest ranked offeror or offerors for each Region, with the quantity of awards being determined based on the expressed capacity of the offeror or offerors and the expected needs of the Region. There may be more than one awarded vendor per Region. If multiple vendors are awarded to the same Region, work will be divided based on the capacity of the vendors and the cost to the State. See Changes to the Original Solicitation on Page 6.

QUESTION 16: Binding: Does binding offer on page 17 mean a binder or bound by the printer?

STATE’S RESPONSE: A ring binder or bound by printer is an acceptable submission.

QUESTION 17: Locations: Page 18 indicates the locations will be identified by DHEC.

a. If we have access to parking lot type locations in rural, disadvantaged and difficult to reach locations, would DHEC consider those as potential sites as well?

b. Regarding Page 20, Item E - "Secure necessary agreements for use of any space, property…," if the State desires the use of a particular location that the contractor does not have "access to" will the State coordinate in securing the agreements?

STATE’S RESPONSE: DHEC will consider all sites as potential sites, and the contractor will be responsible for securing any agreements to utilize the sites.

QUESTION 18: Vaccinators: Page 18 indicates that "all vaccinators and supporting staff are to be under the direct supervision of the Contractor and shall not be delegated to any additional third party." Does "any additional third party" include a named subcontractor?

STATE’S RESPONSE: No subcontracting will be allowed.

QUESTION 19: Pre-Determined Routes: Page 18 - regarding "pre-determined routes" - is it the State's intent for these routes to be determined by the contractor in conjunction with State key stakeholder review/approval?

STATE’S RESPONSE: There will be collaboration between the contractor and DHEC on the routes on a regular basis. This will be based on need/demand.

QUESTION 20: Advertising: Page 18 - regarding advertising.

a. Please confirm that the State will bear this cost.

b. Does the State expect the awardee to perform the advertising?

STATE’S RESPONSE: The State will conduct advertising of the program and mobile vaccination routes on the web and through other media channels at no cost to the contractor. The contractor (“Awardee”) may choose to perform additional advertising, at its own expense, in order to increase participation, effectiveness, and awareness. This may be a wise business strategy but is not a requirement.

QUESTION 21: No Out Of Pocket: Page 19 - "no out-of-pocket costs are incurred by any person for any reason,"

a. We interpret this statement to be referring to South Carolina residents receiving a vaccine, is that correct?

STATE’S RESPONSE: All persons receiving a vaccine, regardless of residence are not to incur any out-of-pocket costs.

QUESTION 22: Travel Costs: We do not see reference to travel costs - will these be allowed to be billed to the State by the contractor?

STATE’S RESPONSE: Travel costs are to be included in the price/quote submitted by offeror.

QUESTION 23: Qualifications: On page 22 section V Qualifications, the RFP notes:

a. "We may also consider a documented commitment from a satisfactory source that will provide you with a capability." Please provide an example as to what the State means by "documented commitment."

b. "You must promptly furnish satisfactory evidence of responsibility upon request." Please provide an example or what is meant by "evidence of responsibility."

STATE’S RESPONSE: This is a standard State clause regarding qualifications of offerors that is included in all solicitations.

(a) An example of a “documented commitment” would be a signed letter, on letterhead, from the entity that is providing the resource. This may be necessary when an offeror is otherwise qualified but is dependent on a third party for some critical element called for in the solicitation, and without which the offeror would not be qualified. (b) The S.C.

Consolidated Procurement Code, §11-35-1410(8) defines a “Responsible bidder or offeror” as “a person who has the capability in all respects to perform fully the contract requirements and the integrity and reliability which will assure good faith performance which may be substantiated by past performance.” Each offeror’s “Responsibility” is determined prior to and during the scoring process of the offers. During this process, if anything relevant is unclear and necessary for this determination, the buyer may request relevant documentation from the offeror. In such instances, the offeror must provide this promptly, as it is necessary in order for the State to move forward with the final scoring of proposals.

QUESTION 24: Number of Locations: Does the State have a number of locations for vaccines in total you are considering?

STATE’S RESPONSE: The number of locations for vaccines will be determined based on need/demand.

QUESTION 25: Number of Individuals: Does the State have a number or range of individuals in regards to this RFP?

STATE’S RESPONSE: The number of individuals will be determined based on need/demand.

QUESTION 26: On Demand: Is this an "on-demand contract" - meaning - upon award will there be a definite region in which the awardee will operate or is this more of a "master contract" where awardees are an approved vendor from which the services can be procured?

STATE’S RESPONSE: Each offeror is applying to service a specified DHEC region, regions, or state as a whole. We anticipate having at least one contractor awarded for each Region. A single vendor may be awarded more than one Region. If multiple vendors are awarded to the same Region, work will be divided based on the capacity of the vendors and the cost to the State.

QUESTION 27: Other Agencies: Will agencies other than the SC Dept of Health and Environmental Control procure off this contract? If so, please elaborate on how this will work.

STATE’S RESPONSE: The subsequent contract(s) will be for SC DHEC agency use only.

QUESTION 28: Using Governmental Unit: Please confirm that the only agency that will utilize this contract is the SC Dept of Health & Environmental Control STATE’S RESPONSE: See response to Question 27.

QUESTION 29: Event Coordination:

a. Will the awardee coordinate directly the SC Dept of Health and Environmental Control for vaccine events?

b. If awardee will be working with other entities, please elaborate how this will work and who the other entities are.

STATE’S RESPONSE: Coordination will begin directly with SC DHEC. Potential collaboration may be in conjunction with DHEC and community partners as directed by the agency.

QUESTION 30: SC Dept of Health and Environmental Control Support: If other agencies, entities are involved in the procurement/event coordination, will the SC Dept of Health and Environmental Control support or guide the other entities to utilize the services of awardees?

STATE’S RESPONSE: See response to Question 29.

QUESTION 31: Negotiation: After award is there the ability to negotiate if there are any changes to scope expectation?

STATE’S RESPONSE: If there are changes to the scope after award, DHEC reserves the right to negotiate with awarded contractors.

QUESTION 32: State System: Are there any existing systems the State is mandating the Awardees use?

STATE’S RESPONSE: Refer to COVID 19 Vaccine provider enrollment: https://scdhec.gov/covid19/guidance-healthcare-professionals-covid-19/covid-19-vaccine-provider-enrollment

QUESTION 33: Where will the state be storing the vaccines? Each individual provider must store vaccine per COVID vaccine provider agreement.

STATE’S RESPONSE: Each contractor must have appropriate storage and handling equipment to manage storage and handling for vaccine.

QUESTION 34: How will Vendor get access to the vaccine supply?

STATE’S RESPONSE: Vaccine will be ordered per the COVID vaccine provider agreement. Contractor will be required to store and handle vaccine appropriately.

QUESTION 35: If the vendor is to go to the central warehouse, if that is where the vaccines will be stored, are there hours of operation that will impact event hours of operation?
