About this file

This document is an Amendment #001 containing Request for Information (RFI) Responses from Northern Wasco County People's Utility District (PUD). The document addresses four specific questions from potential bidders regarding a solicitation, with responses dated 8/31/2025 and 9/8/2025. The RFI covers clarifications about Exhibit D requirements, Oregon CCB considerations, overseas manufacturer participation, and bid/surety bond requirements.

The RFI responses provide key details about the solicitation's requirements, indicating that BAA (Buy American Act) does not apply since the project is not federally or state-funded. The utility district can accept quotes from overseas manufacturers, provided they meet all RFQ requirements and can provide references from utilities within the Pacific Northwest. Notably, references must be from utilities currently using the manufacturer's transformers. The responses also clarify that an Oregon CCB consideration is not mandatory for this solicitation, and a bid or surety bond is not required. The Foreign Entity disclaimer relates to Executive Order 13920, which aims to avoid purchasing electrical equipment from adversary countries.

RFI Number Question Request Date Response

1 Does an FEOC statement, or BAA, suffice for the Exhibit D requirement? 9/8/2025

BAA applies to federally funded and some state funded projects. We do not receive federal or state funds and our board policy does not require BAA. The

Foreign Entity disclaimer has to do with Executive Order 13920 which addresses critical infrastructure and adversary countries. Essentially, we are to avoid buying electrical equipment from adversary countries. We can still buy electrical equipment from countries that are not adversary.

2 Does the Bidder Oregon CCB consideration mandatory? 8/31/2025 This requirement doesn’t apply to this solicitation.

We are overseas manufacturer, would it be possible for us to particiapte in the bidding as a bidder directly? 8/31/2025

We can accept quotes from overseas manufacturers provided all RFQ requirements are met. References must be provided from utilities within the

Pacific Northwest of the United States that are currently using your transformers.

4 Bid Bond/Surety bond, is it required? 8/31/2025 A bid or surety bond is not required for this solicitation.
