Notes: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in this solicitation. Contracting officers will rely on representations from offers based on provisions in the solicitation. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.

This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the proposed price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror's FSS or GWAC contract, and the statement required above shall be included in the quotation.

(IX) Provision 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:

EVALUATION CRITERIA

The Government intends to award multiple Indefinite Delivery Indefinite Quantity (IDIQ) contracts from this solicitation utilizing simplified acquisitions procedures in accordance with RFO part 12. The Government reserves the right not to award a contract and to make an award without discussions based solely upon initial quotes.

Basis for Award:

The Government will make an award to the quoter(s) with the proposed solution that is most advantageous to the Government, price and non-price factors considered. The evaluation factors are listed below in descending order of importance.

All non-price factors, when combined, are considered more important than price.

A quoter's failure to address any factor may be considered indicative of the quoter's lack of understanding of the Government's requirements and may result in the quotation being determined unacceptable.

Evaluation Factors:

1. Technical Capability:

a. Sub-factor 1: Base IDIQ: The Government will evaluate the quoter’s technical approach and capability in conducting the requirements of each task in the SOW to determine its overall understanding of the requirements and the extent to which its proposed approach will ensure successful performance of this effort.

b. Subfactor 2: Mock Task Order: The Government will evaluate the Offeror’s technical approach that will be used to fulfill the Mock Order. The purpose of the Mock Order is to enable NIST to evaluate the technical proficiency of the Offerors.

c. Subfactor 3: Program Management and Control Requirements: The Government will evaluate the offeror’s internal Engineering Quality Plan and methods of conflict resolution to determine if adequate procedures are in place to ensure successful performance of this effort.

2. Past Performance:

The Government will evaluate the quoter’s record of past performance to assess the confidence level it has in the quoter’s ability to successfully perform the requirements in the solicitation. The ability to adhere to schedules and successfully execute tasks similar to those being solicited will be evaluated. NIST will evaluate both the recency and relevancy of each quoter’s project submitted for past performance.

3. IDIQ Labor Rates/Mock Task Order Price: The proposed price will be evaluated. The evaluation will determine whether the proposed prices are reasonable in relation to the solicitation requirements
