Version: July 3, 2024
I. PROJECT DESCRIPTION
This Statement of Work (SOW) is for builder services, providing for the construction of an updated Entry Security Screening Station (ESSS). The project site is located at the Hugo L.
Black U.S. Courthouse, 1729 5th Ave. N., Birmingham, Alabama. The courthouse was constructed in 1987, facing the intersection of 5th Avenue North and 18th Street in downtown Birmingham. The nine-story, 194,518 square foot building was designed by KPS Group and constructed by Brasfield & Gorrie, as the general contractor. It houses multiple U.S. Circuit, District, and Magistrate judge chambers and courtrooms, the U.S. District Court Clerk’s Office, and the U.S. Marshals Service (USMS). Per the current Occupancy Agreements, the building contains 124,181 usable (assignable) square feet (USF). Court components occupy approximately 88% of the usable space in the building.
Project Goals and Objectives
The U.S. District Court for the Northern District of Alabama (USDC) intends to construct the project as detailed below and according to Final Construction Documents. All necessary security equipment required for the project will be funded through court security appropriations.
Construct a new ESSS, to include the following elements:
• Modify the current ESSS and adjacent USDC public display space to reconfigure and expand the ESSS;
• Install necessary infrastructure to support anticipated security equipment;
• Install automatic egress gating;
• Tie all controls into the Physical Access Control System (PACS);
• Comply with the Architectural Barriers Act Accessibility Standard (ABAAS); and
• Any necessary hazardous material abatement – minimal abatement anticipated.
To ensure receipt of Initial and Final Construction Documents, please contact Andrea Southern, the Clerk’s Office Procurement Administrator, at andrea_southern@alnd.uscourts.gov. Final Construction Documents to be provided to all requesters by August 2, 2024. Initial Construction Documents include the following:
• Final Design Update, dated June 24, 2024
• Design Development Drawings, dated April 19, 2024
• Design Development Project Manual, dated April 19, 2024
• USMS Design Markups, received April 4, 2024
• Initial Phasing Document, received April 12, 2024
Project Delivery Approach
This project is to be accomplished utilizing a construction general contractor (GC) for demolition and construction work and a separate construction management – agency (CMa) contractor for general oversight, management, and expertise. The incident SOW relates to the GC and construction. A future solicitation will include an SOW for the CMa.

II. GENERAL REQUIREMENTS
This Statement of Work is organized according to the following breakdown into major phases:
• Pre-Construction Stage
• Construction Stage
• Commissioning Stage
• Closeout Stage
The requirements set forth in this section apply to all stages and phases of the project as described in the Scope of Services section below.
As a general matter, the Facilities Standards for the Public Buildings Service (P-100) represents the overarching document that governs the GC’s performance. In addition, other policies and procedures (e.g., the U.S. Courts Design Guide and the USMS Publication 64) provide detailed requirements that the GC shall follow. The purpose of this SOW is to set forth services that the GC shall provide in addition to the services outlined in other documents.
A. Owner’s Program of Requirements (POR)
1. The Owner’s POR
The Final Construction Documents will be provided to all potential bidders and are intended to set the general requirements and parameters of work for this project. The GC may validate and refine those concepts, with concurrence by the CMa and approval by USDC, to create the necessary solutions and appropriate infrastructure which can be safely and effectively integrated into the existing courthouse.
2. Building Design Standards
To preserve the original design and ensure consistency in all future alterations, a national program called Building Design Standards shall be incorporated into the building design.
The GC shall comply with these standards.
The construction design contractor (DLR Group) will provide a submittal that shall contain all relevant information with regards to finishes, hardware, lighting, and signage schedule. This information shall include at a minimum: wall, floor, ceiling, and specialty finishes, as well as hardware (door, window, cabinet, and specialty, etc.) and lighting fixture specifications as designed. This document will guide the selection of finishes in all future alterations to the building, preserving the original design intent as established by the design contractor.
B. Project Duration and Schedule Milestones
1. Pre-Construction Stage
a. Begins at Award, through a Notice-to-Proceed (NTP) date
2. Construction Stage
a. NTP within 180 days of Award
b. Substantial Completion within 210 days of NTP
3. Commissioning Stage
a. Punch Walk within 240 days of NTP
4. Closeout Stage
a. Final Closeout and Complete Payments within 270 of NTP
C. Reference Materials
The Initial and Final Construction Documents detail all projected upgrades.
1. Applicability
The GC shall review, become familiar with, and fully comply in all materials terms with the Reference Materials. The Government will use the References Materials to determine whether the GC’s work complies with the contract requirements. The GC shall provide all services in accordance with the version of the Reference Materials current at the time of contract award. The GC shall report any conflicts or ambiguities within or among the Reference Materials to the Contracting Officer (CO) in writing for clarification and reconciliation. Similarly, the GC shall submit any requests for deviations from the Reference Materials in writing to the CO.
2. If a requirement contained in the Reference Materials exceeds that required by the P- 100, the GC shall comply with the most stringent requirement unless otherwise directed by the CO. The GC’s work may exceed requirements contained in the Reference Materials to accomplish programmatic and functional goals for the project, including but not limited to energy performance, sustainability, or industry best practices. However, the GC is still responsible for complying with other portions of the contract, including FAR 52.236-22 (Design within Funding Limitations).
3. Standards and Criteria Documents consist mainly of GSA-issued or tenant agency-issued policies, guidelines, or requirements. All design work and related submissions must comply with the documents listed below. The applicable version of each document must be the version current at the time of award. In the event of a conflict between the requirements stated in these documents and requirements provided elsewhere in this SOW, the GC must bring the discrepancy to the attention of the Clerk’s Office Procurement Administrator.
