SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
PART I - THE SCHEDULE
SIX RIVERS NATIONAL FOREST
UKONOM RANGER DISTRICT
HAYPRESS TRAIL BRIDGE REPLACEMENT
C-1 GENERAL SPECIFICATIONS
C-1.1 - SCOPE OF CONTRACT
The intent for this contract is to secure services for replacing an existing steel truss trail bridge that was damaged in 2007 by a large tree falling across it on the Ukonom District of the Klamath National Forest that is administered by Six Rivers National Forest. The primary work items include: removal of the existing bridge, surveying, installation of a new bridge, installing retaining walls adjacent to the existing abutments, clearing and grubbing to remove debris near the abutments, removal of approximately 6 downed trees on the trail near the bridge, logging out approximately ½ mile of trail, and falling designated hazard trees at the project site. The Schedule of Items and the Plan sheets contain the full listing of included work; the General Notes further describes and clarifies the work.
The existing abutments and ends of the bridge deck are covered with soil and debris. A site survey is not available and the contract design is based on a field trip that indicates the bridge was built based on drawings for the existing truss. No drawings have been found for the abutments, so the dimensions shown on the drawings are estimated.
It is anticipated that the construction sequence will be broken down into stages. Stage 1 will require the contractor to clear the existing abutments, provide a site survey and detailed field verification of the abutment dimensions, and horizontal and vertical alignment. Once these dimensions are verified, and the Forest Service has accepted the survey, condition and structural capacity of the abutments, the contractor can proceed with ordering the design and fabrication of the bridge truss. After the bridge has been fabricated, stage 2 would include air lifting the existing bridge out and installing the new bridge. Other items or work would be incorporated into the various stages.
Unless otherwise provided, the Contractor shall furnish all labor, transportation, equipment, tools, supervision, materials and any incidentals necessary to accomplish work on the Ukonom District administered by the Six Rivers National Forest.
The contractor shall carefully examine the existing conditions and information, shall become familiar with the nature and location of the work, the conformation of the ground slopes and terrain, the nature of the soil and subsoil condition, nature and extent of the materials that will be encountered during the construction operations and any existing site conditions that may affect the project, prior to the beginning of work.
C-1.2 - PROJECT LOCATION AND ACCESS
C-1.2-1 - Location
The project area is located within the Marble Mountain Wilderness Area and is located on the Ukonom District of the Klamath Rivers National Forest administered by the Six Rivers National Forest. The project location is approximately 7 miles in off the closest road along the Wooley

Creek Trail (#5832). The legal location is in Township12 North, Range 7 East, and Section 16 along the Humboldt Meridian. The geographic coordinates are Latitude 41.43325° N, Longitude 123.38061° W, and elevation 1,300 feet. Project lies within Siskiyou County near the town of Somes Bar, California. Refer to Section J for site-specific location maps.
C-1.2-2 - Access
From Eureka, California travel Highway 101 north to Arcata and take Highway 299 east to the town of Willow Creek, and then take Highway 96 North to the past the town of Orleans and approximately another 10 miles to the town of Somes Bar. From here travel east along the Salmon River Road approximately 3 miles to the Wooley Creek Trailhead. The project site is approximately 7 miles up the trail, approximately ¼ mile northeast of the private inholdings referred to “Wooley Camp” on the maps. Refer to the Location Maps in Section J for details.
C-1.3 – OPERATING SEASON
Seasonal restrictions require no contract activities from January 1st to August 31st. After October 15 wet weather operation restrictions shall apply and work shall be tightly controlled and monitored for erosion control and erosion preventative measures. At the Forest Service discretion, work may be suspended for winter weather when conditions warrant.
C-1.4 - EQUIPMENT
All equipment shall be suitable for the purpose intended and shall meet all requirements of the Occupational Safety and Health Act. The Contracting Officer may order the removal or require the replacement of any unsatisfactory equipment.
In the staging area all vehicles and machinery shall have flashing lights or rotary beacons operated continuously while work is in progress. All equipment shall be equipped with a standard slow moving vehicle emblem. Truck headlights shall be on while operated. Backup warning devices shall be required on self-propelled equipment in excess of 8,000 pounds gross vehicular weight.
Vehicles and machinery not currently in use shall be parked off the traveled way at the approved location to minimize interference with normal use of the road and trailhead.
C-1.5 - EQUIPMENT CLEANING
To prevent the spread of the root disease Phytophora lateralis in the Port Orford cedar (POC) and to prevent the spread of non-native plant species and invasive weeds, the following will be required on the Ukonom Ranger District administered by the Six Rivers National Forest.
Unless otherwise agreed, Contractor shall clean all vehicles and equipment before entry into the district unless Forest Service waives the cleaning requirement in writing. Thereafter, all vehicles and equipment that leave the district or enter infected portions of the district must be cleaned prior to their reentry, unless waived by the Forest Service. All cleaning of vehicles or equipment shall be done at sites agreed to by Forest Service and the Contractor. The water used for washing will be from a source in non-infected drainages. Forest Service shall inspect all equipment prior to entry, as appropriate and determined necessary. Forest Service will determine infected and uninfected areas. Cleaning shall include the removal of soil by steam cleaning or use of high-pressure water spray.

C-2.1 Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (FP-03 U.S. Customary Units) is included in this solicitation by reference only. The requirements contained in these Standard Specifications are hereby made part of this Solicitation and any resultant contract.
C-2 SUPPLEMENTAL PROJECT SPECIFICATIONS
Supplemental Specifications are applicable to this Solicitation and any resultant contract. Special Project Specifications reference the Standard Specifications and delete, supplement or substitute information contained therein. See the Table of Contents under Supplemental Specifications for Construction of Roads and Bridges on Federal Highway Projects contained within for a full listing.

SECTION G--CONTRACT ADMINISTRATION DATA
DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The Contracting Officer designates the Contracting Officer's Representative(s) (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
SECTION H--SPECIAL CONTRACT REQUIREMENTS
MOISTURE SENSITIVE SOILS
Contractors are cautioned that the roadway structure is designed so that the completed road will support highway legal loads during a limited use season. Construction equipment often subjects the uncompleted roadway structure to loadings it is not designed to support. This is especially critical during periods of excessive moisture. Materials on this project are sensitive to excessive moisture and will require careful selection and scheduling of equipment to permit efficient operation. Any damage resulting from operations, which renders the material unsuitable for use or results in potential siltation of streams, will be corrected by the Contractor at Contractor's expense.
AGAR 452.215-73 POST AWARD CONFERENCE (NOV 1996)
A post award conference with the successful offeror is required. It will be scheduled and held within 10 days after the date of contract award. The conference will be held at a mutually agreeable location.
AGAR 452.236-77 EMERGENCY RESPONSE (NOV 1996)
(a) Contractor's Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agents or employees.

(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
( c) Contractor's Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-4.
LANDSCAPE PRESERVATION
The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.
a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or other natural features or any other improvements in the work area unless specifically authorized by the Contracting Officer. Unless otherwise provided herein, the Contractor shall confine contract operations to within the areas designated in contract documents.
b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumens, calcium chloride, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Contracting Officer.
CONTRACTOR'S USE OF EXISTING ROADS
The Contractor is authorized to use roads in the immediate construction project area for performance of work under this contract. The authorization is limited to roads necessary for direct access between the construction area and storage sites, disposal areas, and other work areas designated in the contract.
The roads authorized for use will be subject to the following general conditions:
(1) State laws governing traffic rules and equipment requirements on State and County Highways.
(2) Federal Regulations contained in 36 CFR 261.12. These regulations prohibit use in excess of
State Codes for weight and size, damaging a road while using it, and blocking a road open to use by others.
The Contractor shall be responsible for and perform road maintenance commensurate with his use of Forest Service roads in the construction area.

FAR 52.225-9 BUY AMERICAN ACT—CONSTRUCTION MATERIALS (SEP 2010)
(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—
(1) Means any item of supply (including construction material) that is—
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984
( 46 U.S.C. App. 1702), such as agricultural products and petroleum products.
“Component” means an article, material, or supply incorporated directly into a construction material.
“Construction material” means an article, material, or supply brought to the construction site by the
Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.
“Cost of components” means—
(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
“Domestic construction material” means—
(1) An unmanufactured construction material mined or produced in the United States;

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
“Foreign construction material” means a construction material other than a domestic construction material.
“United States” means the 50 States, the District of Columbia, and outlying areas.
(b) Domestic preference.
(1) This clause implements the Buy American Act (41 U.S.C. 10a - 10d) by providing a preference for domestic construction material. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for construction material that is a COTS item (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.
(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows: NONE]
(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—
(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or
(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.
(c) Request for determination of inapplicability of the Buy American Act.
(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—
(A) A description of the foreign and domestic construction materials;
(B) Unit of measure;
(C) Quantity;
(D) Price;
(E) Time of delivery or availability;
(F) Location of the construction project;
(G) Name and address of the proposed supplier; and
(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.
(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.
(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).
(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.
(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act.
(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

FAR 52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States. The Contracting Officer will return bid guarantees, other than bid bonds –
(1) To unsuccessful bidders as soon as practicable after the opening of bids, and (2) To the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3 Million, whichever is less.
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

AGAR 452.209 – 71 REPRESENTATION BY CORPORATIONS REGARDING AN UNPAID TAX
LIABILITY OR A FELONY CONVICTION (DEVIATION 2012-01) (FEB 2012) (Alternate 1 Feb 2012)
(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L.
No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and
(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.
(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.
