52.204-11 American Recovery and Reinvestment Act—Reporting Requirements. (JUL 2010)
(a) Definitions. For definitions related to this clause (e.g., contract, first-tier subcontract, total compensation etc.) see the Frequently Asked Questions (FAQs) available at http://www.whitehouse.gov/omb/recovery_faqs_contractors. These FAQs are also linked under http://www.FederalReporting.gov.
(b) This contract requires the contractor to provide products and/or services that are funded under the American Recovery and Reinvestment Act of 2009 (Recovery Act). Section 1512(c) of the Recovery Act requires each contractor to report on its use of Recovery Act funds under this contract. These reports will be made available to the public.
(c) Reports from the Contractor for all work funded, in whole or in part, by the Recovery Act, are due no later than the 10th day following the end of each calendar quarter. The Contractor shall review the Frequently Asked Questions (FAQs) for Federal Contractors before each reporting cycle and prior to submitting each quarterly report as the FAQs may be updated from time-to-time. The first report is due no later than the 10th day after the end of the calendar quarter in which the Contractor received the award. Thereafter, reports shall be submitted no later than the 10th day after the end of each calendar quarter. For information on when the Contractor shall submit its final report, see http://www.whitehouse.gov/omb/recovery_faqs_contractors.

A job cannot be reported as both created and retained. See an example of how to calculate the number of jobs at http://www.whitehouse.gov/omb/recorery_faqs_contractors.

M.2 EVALUATION FACTORS
Acceptability of the Offer The Government will determine the acceptability of each offer on a pass or fail basis. An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the RFP, including attachments. If an offeror takes an exception to any of the terms and conditions of the RFP, then the Government will consider its offer to be unacceptable.
Capability of the Offeror The Government will assess the capability of each offeror on the basis of the following criteria which are of approximately equal value: (1) Prior Experience and Past Performance, (2) Capacity, and (3) Understanding of the Government's requirements. The Government will not assess capability on a pass/fail basis, but will use its assessments of capability as a basis for comparing offerors to determine best value. The Government will evaluate each offeror's relative understanding of the Government's requirements on the basis of its written submittals addressing the following factors and subfactors:
1. Prior Experience and Past Performance:
a) Prior Experience: Show and describe in detail all work on projects within the last 5 years (at least 1 and no more than 5 recent projects) that relates to the work as described in this solicitation. List subcontractors and work performed if used.
b) Past Performance: Describe your company’s performance and completion of past projects as it relates to the work proposed in this solicitation.
c) Provide references from past projects that are familiar with your work and had positions of oversight for those projects. At least 1 and no more than 3 references per project listed above.
2. Capacity:
a) Describe your ability to accomplish this project in its required timeframe, including a narrative or tabular work schedule.
b) Describe your proposed workforce (on hand or proposed, including subcontractors) and equipment
(owned or rented) planned to complete this project, and describe how realistic your workforce and equipment plan is in relation to concurrent obligations. Include estimated production rates, if applicable.
c) List subcontractors/fabricators for major components (tunnel, bridge, soil nail walls, water line relocation).
3. Understanding of the Government’s Requirements:
a) A site visit is highly recommended. Describe the extent to which the site for this project was visited and the conclusions made as a result of the visit.
b) Describe your plan to complete the project as described. Include enough information to demonstrate your understanding of the difficulty of the project. Provided a plan for supervision and for meeting project deadlines.
c) Describe your plan to complete the tunnel within the allocated time frame.
d) Include a site-specific safety plan. Identify specific hazards, and includes plans to mitigate risk.
Price will be evaluated after the technical evaluation is completed. The award decision will be made in accordance with the award statement.
NOTE: Failure to provide a technical proposal will disqualify you from award of the resulting contract.
