AWARD OF CONTRACT(S)
The Government anticipates awarding one multi-year, indefinite-quantity, firm fixed-price single-award contract with economic price adjustment. Fixed-price task orders will be issued against the contract, as the need arises. To be considered for award, offerors must at a minimum submit pricing for all items in sections B.1 and B.2.
If the contracting officer decides to establish a competitive range and conduct negotiations, the competitive range can be limited for purposes of efficiency [see FAR 52.215-1(f)(4)].
One Award will be made. The award decision will be made on a best-value basis as spelled out in the solicitation.
MINIMUM QUANTITY
The guaranteed minimum for each program year of the contract will be the sum of 32,500 green tons of cut-tree material from a) service work and b) removal of goods. There is no dollar amount associated with the guaranteed minimum.
MAXIMUM QUANTITY
The maximum quantity that can be ordered annually will be the sum of 75,000 green tons of cut-tree material from a) service work and b) removal of goods.
PERFORMANCE TIME
The period of performance for each Task Order will be specified in the Task Order. If the government exceeds the amount of work the contractor stated they could accomplish in their Technical Proposal, the government and contractor will negotiate the period of performance.
Notwithstanding what is written anywhere else in this contract, all work under this contract -including all task orders - must be completed by the end of the 10th program-year unless this deadline is waived by the CO in writing. At the beginning of the 10th program-year, if the government and the contractor cannot agree on an operating schedule that will insure the accomplishment of all task orders issued previously (in years 1-9) plus the accomplishment of task orders to be issued in year 10, the 10th-year task order will be subtracted from the annual minimum guarantee and the government’s responsibility to provide those acres shall be considered satisfied.
Issuance of Task Orders: Any Region 2 Forest Service Contracting Officer can issue task orders up to the limit of their warrant authority. Task orders may be issued electronically via fax or email.
Construction Work: Construction work is not included in the schedule of items but is considered to be within the scope of stewardship contracts when it is used to meet one of the land management goals authorized in Section 323 of Consolidated Appropriations Act for FY 2003, Public Law 108-7. Pricing for any construction work will be negotiated at the task-order level prior to issuance. The appropriate Davis Bacon Act wage determination shall be incorporated into the task order at time of issuance.
Economic Price Adjustment: There are 3 categories of items for which prices need to be adjusted throughout the term of the contract:
a) service work,
b) road maintenance, and
c) temporary road construction.
These adjustments are clarified below.
a) Service Work: The government will apply two indexes to adjust the price of the service work. The adjustments will be made as described below.
The first adjustment will be made on an annual basis using the index titled: Consumer Price Index (CPI) – Urban Wage Earners and Clerical Workers, Area: U.S. City Average, Series ID:
CWUR0000SA0L1E, Item: All items less food and energy. The base period price will be the price provided by the contractor and accepted by the government at the time of contract award.
An annual price adjustment will be made within 40 calendar days of the anniversary date of contract award. The annual rate of price increase or decrease will be applied to each price listed in Sections B.1 and B.1A. The new prices will be rounded to the nearest penny. The new prices will not be retroactive to any outstanding task orders; the new prices will only apply to task orders issued after the date of price adjustment. Regardless of the increase or decrease of the referenced index, the government limits the annual increase or decrease in prices that is based on this index to no more than 4% in any given year. Increases in price above 4% in any given year shall be borne by the contractor. Decreases in price greater than 4% in any given year shall be borne by the government. The CPI referenced above is published by the U.S. Department of Labor, Bureau of Labor Statistics and can be found on their website at:
http://www.bls.gov/cpi/home.htm. Once the annual price adjustment has been incorporated into the contract, the prices will not be changed even if the Bureau of Labor Statistics issues revised numbers for the period of adjustment. This first adjustment is to compensate the contractor for annual increases in labor and materials - exclusive of diesel fuel. It is intended to compensate the contractor for any increased wage and/or fringe benefits required by the incorporation of an updated wage determination under the Service Contract Act. If the contractor claims that this adjustment is inadequate to compensate for an updated wage determination, the contracting officer shall take into consideration the amount of adjustment made herein and subtract that amount from any amount determined to be due under the Service Contract Act.
The second adjustment, referred to as the Diesel Adjustment, will be made and applied to each task order at the time of issuance. The Diesel Adjustment will apply to All Schedule Item Numbers in B.1. The Diesel Adjustment will be made based on data provided by the Energy Information Administration. The statistic that will be used is: Weekly Retail On-Highway Diesel
Prices, Average All Types, Region: Rocky Mountain. This statistic is currently available on the Energy Information Administration’s website at: http://www.eia.doe.gov/. The Base Period Price will be $ 3.85 per gallon. The base period price will not change; it will remain the same throughout the contract term. The Item Number Prices for the Task Order will be determined by applying the most recent Weekly Retail price information available, in the manner described by the 3 formulas below.
(Weekly Retail Price – Base Period Price) X .10 = Percentage of Adjustment Base Period Price
(Percentage of Adjustment X Current Bid Item Price) = Dollar value of Adjustment
Dollar value of Adjustment + Current Bid Item Price = Item Number Price for Task Order
Here is an example of how the formulas work when the Weekly Retail Price exceeds the Base Period Price:
($4.00 - $3.85) X .1 = .0039(rounded to 4 decimal places) $3.85
.0039 x $650.00 = $ 2.54(rounded to nearest penny) $2.54 + $650.00 = $652.54
Here is an example of how the formulas work when the Weekly Retail Price is less than the Base Period Price:
($3.00 - $3.85) X .1 = - 0.0221(rounded to 4 decimal places) $3.85
-0.0221 x $ 650.00 = - $ 14.37(rounded to nearest penny)
- $ 14.37 + $650.00 = $635.63
If at any time during the contract either of the two indices used above is discontinued, the contracting officer shall choose a suitable replacement.
b) Product Value: The government will use K-D.3.5#, Scheduled Rate Redetermination, located in Appendix B, to re-determine the value of Sawtimber and POL. Under no circumstances will the value of the product be reduced to less than the minimum bid amount listed in B.2, Timber Removal Price Schedule. The new prices will not be retroactive to any outstanding task orders; the new prices will only apply to task orders issued after the date of price adjustment.
c) Road Maintenance: The allowances in Section G are estimated from data compiled in the “Cost Estimating Guide for Road Construction” (CEGRC), or from the San Juan National Forest “Basis for Road Maintenance Cost Estimate” (BRMCE). (The CEGRC is updated annually as part of a Forest Service multi-regional effort; the BRMCE is updated as needed, depending on changing costs.) Price adjustment will be made at the time of Scheduled Rate Redeterminations required under K-D.35# and will be based on the version of the CEGRC that is in effect for Region 2 at the time of revision unless more accurate costs are developed locally in an updated BRMCE. The versions of CEGRC and BRMCE, used in this solicitation, are located in Appendix E and F, respectively.
New prices will not be retroactive to any outstanding task orders; new prices will only apply to task orders issued after the date of price adjustment.
d) Temporary Road Construction: Like c), above, allowances in Section G.10.1 and G.10.2 were estimated from data in the CEGRC or the BRMCE. Price adjustment will be made at the time of Scheduled Rate Redeterminations required under K-D.35# and will be based on the version of the CEGRC that is in effect for Region 2 at the time of revision.
New prices will not be retroactive to any outstanding task orders; new prices will only apply to task orders issued after the date of price adjustment.
B.1 Schedule of Items – Stewardship Work Activities (“Services”)
Assumptions for Stewardship Work Activities
Work Activity -- Tree cutting and removal and associated work, Items 1A, 1B, 1C, through 10A, 10B, 10C:
Tree species, stand density, and cut-tree material, is more consistent by cover type than by other site factors, such as slope, aspect, or elevation. Cover types included within this contract, as identified below by work activities, include Ponderosa Pine, warm-dry Mixed Conifer, cool-moist Mixed Conifer, Aspen-with-Conifer, and (pure) Aspen. (See Definitions, Appendix A, for more information by Cover Type.) Tree species to be cut and removed include ponderosa pine, juniper, aspen, white fir, Douglas-fir, blue and Engelmann spruce, subalpine and corkbark fir, and pinyon pine.
Two cover types, cool-moist Mixed Conifer and Aspen-with-Conifer, have additional compositional complexities and treatment prescriptions. These two types are further delineated into two categories each, of varying treatment:
a) cool-moist Mixed Conifer: i) group selection/patchcut, and thinning, and ii) clearcut;
b) Aspen-with-Conifer: i) remove conifer, and ii) clearcut.
Haul distances for removal of cut-tree material from Task Order project areas to a Contractor’s disposal site* will be delineated into three mileage-range categories – 0 to 20 miles, 21 to 35 miles, and 36 to 50 miles. (*At time of initial solicitation, a default “site”, centrally located, is assumed to be the junction of US 160 and Archuleta County Road 600 [Piedra Road], approximately three miles west of downtown Pagosa Springs, CO.)
Treatment units, as identified in individual Task Orders, will be delineated by work activity Item #’s based on: a) the dominant cover type across the treatment unit (and treatment) and b) the weighted average haul-mile range from the treatment unit to the disposal site.
Specifications for cutting and removal of designated trees are found in Appendix A.
Work Activity – Pre-Use Road Maintenance, Items 11 through 14B:
Pre-use road maintenance commonly needed prior to operations are Ditch Cleaning, Surface Blading, Drainage Structures maintenance, and maintenance of Miscellaneous Structures (e.g., cattleguards and gates). Specifications for maintenance are found in Appendix C.
Note that other road maintenance items that are typically not needed prior to operations, but may be necessary more infrequently (and also detailed in Appendix C), will have cost allowances which are found in G.10.1.
Work Activity – Temporary Road Reconstruction/Opening, and Decommissioning/Closure, Items 15 through 17C:
Temporary road work service items that are common to most projects, and relatively consistent in cost, are a) reconstruction of existing non-system roads, b) decommissioning of roads, and c) construction (or purchase), installation, and removal of temporary road gates. Specifications for these items are found in Appendix D.
Other temporary road work items that may or may not be included in projects (Task Orders), such as clearing, excavation, or construction of drainage structures, and can vary based on ground conditions, will have cost allowances which are found in G.10.2. Specifications for these items are also found in Appendix D.

PAYMENTS, per TASK ORDER, for B.1.a./B.1.b. Service Work
The service work summarized above includes both required and optional items tied to cutting and removal of designated trees. As noted under B.2, Schedule of Items, Timber Products (and noted elsewhere in this contract), there is additional required cutting of designated trees 10.0” DBH and larger and removal of associated sawtimber. (For this contract, sawtimber minimum diameter is 10.0” DBH. See Division A, Appendix B, Timber Removal Specifications.) Given the value associated with sawtimber, service work payments will not be made for cutting and removal of sawtimber. Service work payments will be made for the removal of tops and limbs (miscellaneous biomass) resulting from the cutting of sawtimber-sized trees. In order to determine payment for service work under B.1.a. (and B.1.b., if included in a Task Order), a weighted average rate per green ton of sawtimber, pol, and miscellaneous biomass will be determined in accordance with the Example Weighted Average Rate for Task Order table shown below, coupled with the BID (flat) per green ton submitted with the proposal, and green tons per species and product.

*Contractor will not be paid for cutting and removal of sawtimber products. The service work bid per green ton will be $0.00 for the cutting and removal of sawtimber products.
Instructions: To determine the weighted average rate per green ton on each task order:
Step 1. The Weighted Average Rate for Task Order #____ table (example shown above) will be completed for each species/product required to be removed. The columns for Quantity, Bid, and Total Value will be completed for each task order.
Step 2. The “bid per green ton” is the BID (“unit price”) per Green Ton value from B.1.a.
“Cutting and Removal of Designated Trees” (and B.1.b., if applicable) table(s).
Step 3. All estimated quantities will be totaled. Miscellaneous biomass, from trees required to be removed, will be included.
Step 4. The Total Value Bid by species for POL and miscellaneous biomass products will be determined.
Step 5. To determine the Weighted Average Rate per Green Ton for sawtimber, POL, and miscellaneous biomass products, the sum of total value bid for POL and miscellaneous biomass will be divided by the total estimated quantity of green tons for the Task Order.
All additional sawtimber, POL, and miscellaneous biomass material designated to be cut by the Forest Service as part of “Construction Clearing”, or “Other Authorized Clearing” (provisions
H.10.3, H.10.4, respectively) will have payments based on the Weighted Average rate per Green Ton calculated for the Task Order.

B.2 Schedule of Items – Timber Products (“Goods”)
Assumptions for Timber Products
Timber Products includes two key components: a) cut-tree material, in green tons, from the cutting and removal of sawtimber from designated trees, and b) cut-tree material, in green tons, from the cutting and removal of designated trees, and products, specified in B.1.a and B.1.b, described above in Service Work Activities. Note that cutting of sawtimber-sized trees, and removal of associated sawtimber, is a requirement of this contract, does not result in service-work payment, and does require payment for green tons removed from Forest to Contractor’s disposal or utilization site. Cut-tree material derived from service-work activities and removed from the Forest, also requires payment for green tons removed.
Timber product value can vary by product class and species. This contract, for valuation purposes, differentiates products as follows.
Timber products are broken into three product classes, depending on the original size of the cut-tree material:
a) sawtimber, from trees 10.0” DBH and larger;
b) POL (products other than logs), from trees 5.0-9.9” DBH; and
c) miscellaneous biomass, or i) the remaining cut-tree material including topwood (the portion of the stem(s) above and smaller than sawtimber or POL), limbs, and foliage, and ii) any cut-tree material from whole trees less than 5.0” DBH (see B.1.b, above).
Sawtimber and POL are further delineated into species classes, as follows:
a) sawtimber – ponderosa pine, true fir and other species*, Douglas-fir, and spruce (blue and Engelmann);
b) POL – aspen, and all conifer.
*True fir includes white fir, subalpine fir, and corkbark fir. Other species may include juniper, pinon pine, or other species in small quantities not listed above.
Valuation, by product and species, will be conducted following standard appraisal policies established by the Forest Service. Values for products derived from this contract will not fall below minimum rates established by the Forest Service.
Bids are to be submitted according to the following Timber Products Removal Price Schedule table – that is, by species and product, per green ton. The bid per green ton will remain constant (“flat”) for the Contract period unless modified by Rate Redetermination.

Volume Estimates -- Quantities of timber products are determined by Forest Service in accordance with acceptable cruising methods, including appropriate statistical standards, volume equations and sampling methods. (These methods, and standards, and associated policy, are found in the Forest Service Cruising Handbook, 2409.12.) Individual project areas and associated Task Orders will have site-specific cruise plans and cruise results/files that will be available for review by Contractors. Timber product quantities, derived from sampling, are estimates; hence, Contractors are urged to examine the contract area and make their own estimates.
Cruise sampling data is run through a nationally-accepted software program to calculate cubic feet from sawtimber,and POL products, and from associated topwood, or the portion of the stem(s) above and smaller than the sawtimber or POL product. Estimates of cubic feet (CF) are then converted to green tons via weight factors. Weight factors have been derived from sample weight testing of cut material, by species. Cruise software directly converts the remaining portion of miscellaneous biomass, other than topwood (i.e., limbs and foliage) into green tons.
(Green ton calculations for limbs and foliage are derived from various biomass studies and samples and incorporated into the National Biomass Estimator Library by nationally-adopted formulas.) For this contract the final unit of measure for Timber Products will be in green tons.
Note that the cruise estimates will typically include a defect deduction for rot and broken pieces that are lost in the process of cutting and removal of trees. It will vary by project area. (Refer to specific Task Orders and accompanying cruise information.)

SECTION C – DESCRIPTION AND SPECIFICATIONS
C.1 Project Description
C.1.a Project Summary -- Objectives and Activities
Overall objectives for this project are to reduce hazardous fuels, restore forest conditions to ensure long-term sustainability and resilience, and to improve forest health.
The stewardship activities are intended to:
- reduce fuels based on fire regime condition class, ecosystem components at risk, and proximity to values at risk (e.g., communities of concern, municipal watersheds);
- reduce and manipulate fuels to enable initiation and fostering of fire for resource benefit;
- reestablish appropriate species composition and structure by cover type;
- create conditions conducive to forest restoration via activities that foster prescribed fire;
- remove trees reflecting high incidence of infestation by insects, disease, or parasitic plants;
- reduce the areal extent of tree species that are more susceptible to infestation by insects, disease, or parasitic plants while favoring tree species resistant to infestations;
- reduce or remove excessive host habitat in anticipation of infestation;
- reduce the areal extent of tree species more susceptible to drought while favoring drought-resistant species.
Work required by this contract includes all of the requirements outlined herein and in the attachments, and includes, but is not limited to:
1. a. Cutting of designated trees 5.0-9.9” DBH (POL), and removal from treatment area of approximately 95% of the cut trees, including boles, limbs, and tops, plus removal of tops and limbs from trees cut in 1.b. below. See Appendix A for details of this service work.
b. Cutting of designated trees 10.0” DBH and larger and removal from treatment area of associated sawtimber, similar to 1.a., above, but falling under Timber Products, or Goods, that will be paid for by the Contractor.
c. Cutting of designated trees less than 5.0” DBH when required by the Forest Service.
d. Contractor compliance with Timber Removal specifications, including payment for removal of Timber Products resulting from activities 1.a. through 1.c., above. See Appendix B for details of timber removal specifications.
2. Maintenance of National Forest Service Roads used to accomplish work item 1, above, including, as needed, pre-use, during-use, and post-use maintenance. See Appendix C for details of Road Maintenance requirements.
3. Construction and maintenance of temporary roads, and closure of such roads following use, to accomplish work item 1, above. See Appendix D for details of Temporary Road work requirements.
4. Erosion control of skid or forwarder trails, and landings, as needed, to accomplish work item 1, above. This may include construction of water-diverting structures (“waterbars”), scarification prior to seeding, seeding with specified seed mixes, or other measures.
5. Miscellaneous items, as part of accomplishment of work item 1, above:
a. Felling of Damaged Trees: Contractor shall fell all live trees over 2-inches DBH damaged through contractor’s operation. Upon approval by the Forest Service, cut-tree material from damaged trees may be removed from site, as Timber Products, with payment by Contractor at weighted average rate per green ton specified by Task Order. (See Definition for “damaged trees”.)
b. Slash Treatment: All activity-generated slash that is not removed for utilization purposes shall be lopped and scattered so as to lie within 24” of the ground.
(Exceptions to maximum slash depth may occur around developed sites, such as campgrounds, or within or near special-use authorizations, such as powerline corridors. In such cases, maximum slash depths would be reduced. Such exceptions will be specified by Task Order.)
Items 2-5 are incorporated – or assumed – within Item 1, B.1.a., Schedule of Items, as associated activities, except for the following:
the Contractor will be paid for pre-use maintenance of National Forest System Roads by bid items 11 through 14B, in B.1.c., or through cost allowances in G.10.1.; and the Contractor will be paid for construction or closure/obliteration of temporary roads by bid items 15 through 17C, in B.1.d., or through cost allowances in G.10.2The contractor shall provide everything necessary to perform this contract unless such items are specifically identified herein as Government-furnished property.
