(c) - Price Range. $250,000 to $500,000
(d) - Pre-Solicitation Tour. No pre-solicitation site tour is scheduled for this project. Due to winter weather, project access by vehicle is not likely from November 15th to June 1st in a typical year.
With limited access to the project while this contract solicitation is advertised for bidding, Contractors are encourage to utilize the drawings which include pictures for each of the work sites. Contractors may choose to visit sites by snowmobile or contact Larry Shepherd at the address below to review the bridge inspection files for any of the bridge structures. A St Joe Ranger District map can be requested to identify bridge locations to assist with formulation of mobilization costs by calling or e-mailing Larry Shepherd (see e-mail and phone number below). This is a project that Contractor’s should be able to submit a comprehensive price proposal based on solicitation documents without a site visit. If there are any work items that the Contractor believes may create risk in pricing without a site visit, please address these items and concerns and submit with your price proposal.
(e) - Pre-Bid Conference: A pre-bid conference is not scheduled for this project. Due to winter weather project access by vehicle is not likely from November 15th to June 1st in a typical year. Interested bidders may obtain additional information by contacting Larry Shepherd at:

(f) - Start Work. It is estimated that the notice to proceed under this contract will be issued in early February of 2010 to facilitate the contract submittal process and contractor’s ordering of prestressed concrete beams, precast concrete bridge components and treated timber bridge materials. On site work is anticipated for July 15, 2010 through October 1, 2011 (See Period of Performance for Cliff Creek Bridge Replacement below).
(g) - Period of Performance. See Part 1, Section F, Clause 53.211-10. All work under this contract has a completion date of October 1, 2011 with a mandatory construction period for specific phases of the project as follows:
· Cliff Creek Bridge Replacement – Due to this section of Road No. 326 being the concessionaire bus route for the Route of the Hiawatha Trail facility, this portion of the project must be completed between September 20, 2010 and October 15, 2010. See Section 156 of Supplemental Specification for the 12 day Road Closure Period allowed for the Cliff Creek Bridge replacement.
· Treated Timber Bridge Repairs – Due to the time it takes to secure the treated timber bridge components, number of bridge repair sites and fish window restrictions, this portion of the project will be completed by October 1, 2011.
(h) - Restrictions.
No temporary detour or work bridge will be allowed during removal and replacement of the Cliff Creek Bridge. It is the responsibility of the Contractor to schedule delivery of materials, equipment and all necessary supplies to the site to ensure that the bridge can be substantially completed without a work bridge within the above specified 12 day road closure. For delivery and setting of tri-deck bridge beams, there is a large staging area and turnaround on Road No. 326 at MP 2.9 (.03 miles from construction site). Beams will need to be delivered, turned around and backed from MP 2.9 to the bridge site at MP 3.2. If Contractor plans to use one large crane to set tri-deck beams, crane set up room is limited for crane and beam delivery truck positioning to set beams. Road access for delivery of beams from the other direction over Roland Pass Road No. 506 off I-90 on Montana side would have to be assessed by the Contractor.
Sheet 4 of 12 for Cliff Creek Bridge drawings show an area for Contractor to install 200 LF of orange safety fence north of the bridge construction site. This fenced area will be identified on the ground by the Forest Service, protected by Contractor with fence and is an archeological site that must not be disturbed during construction.
See Supplemental Specification Section156 (FP-03 Specifications) for road closure and traffic control signing requirements.
Project in-stream work for the project varies depending on work location within the Avery and Red Ives drainages that feed into the St Joe River and Clearwater River basins. In-stream work periods are established based on status of occupied bull trout and native cut throat streams. Contractor shall develop and submit an operating plan and erosion control plan 30 days prior to any in-stream work.
Site-by-site restrictions for in-stream work within the project area have been established contingent upon Contracting Officer’s approval of Contractor’s plan or operation to include BMP’s for sediment containment through the entire reach of each individual construction sites as follows:

The Contractor, whether or not directed by the Forest Service, shall immediately extinguish, without expense to the Government, all fires on or in the vicinity of the project which are caused by Contractor's employees, whether set directly or indirectly as a result of Contractor operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation resulting from fires set or caused by the Contractor's employees or resulting from contract operations.
(b) Other Fires. For the purpose of fighting forest fires on or in the vicinity of the project which are not caused by the Contractor or the Contractor’s employees, the Contractor when requested by the Contracting Officer shall place the employees and equipment temporarily at the disposal of the Forest Service. Payment for such services will be made by the Government at not less than the current rate for fire-fighting services established by the Forest Service in the area concerned.
Any employees and equipment furnished will be relieved from fire fighting as soon as the Forest Service finds that it is practicable to employ other labor and equipment adequate for the protection of the area.
An equitable adjustment in contract time may be made for this period.
(c) Fire Protection Requirements - Fire Plan. At all times during closed fire season period, as specified by State law, the Contractor shall comply with each of the following provisions to the extent applicable to the Contractor’s operation under the contract.

(ii) Obtain a burning permit from the District Ranger.
(iii) Use weather forecasts as far as possible in scheduling burning for more favorable dispersal of smoke.
(iv) Fuel shall be reasonably free of dirt and piled to facilitate rapid and complete combustion. Piles shall be tended during burning operations to maintain combustion and to eliminate unnecessary smudges. Piles shall be patrolled during off-work hours to avoid wildfires.
(v) Unless fire season controls dictate otherwise, burning shall be scheduled, as far as practicable, for the most favorable conditions during the burning period.
(vi) Under certain atmospheric conditions, smoke accumulations may become excessive and in these cases, the Regional Forester may, at his/her discretion, prohibit all open burning for definite periods within specific areas of the National Forest.
H- 2 - Loss, Damage, or Destruction
(a) Equipment furnished with operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.
All claims arising under this clause will be submitted to the Contracting Officer.
H- 3 - Incidental Payment Items
The intent of the contract is to provide for the complete construction of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for items shown.

The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.
"Domestic construction material" means--
(1) An unmanufactured construction material mined or produced in the United States; or
(2) A construction material manufactured in the United States.
"Foreign construction material" means a construction material other than a domestic construction material.
"Manufactured construction material" means any construction material that is not unmanufactured construction material.

(ii) The Buy American Act (41 U.S.C. 10a-10d) by providing a preference for unmanufactured domestic construction material.
(2) The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraph (b)(3) and (b)(4) of this clause.
(3) This requirement does not apply to the construction material or components listed by the Government as follows:
NONE
(4) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(3) of this clause if the Government determines that--
(i) The cost of domestic construction material would be unreasonable.
(A) The cost of domestic iron, steel, or other manufactured goods used as construction material is unreasonable when the cumulative cost of such material will increase the cost of the contract by more than 25 percent;
(B) The cost of unmanufactured construction material is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or
(iii) The application of the restriction of section 1605 of the Recovery Act or the Buy American Act to a particular construction material would be inconsistent with the public interest.
(c) Request for determination of inapplicability of Section 1605 of the Recovery Act or the Buy American Act. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(4) of this clause shall include adequate information for Government evaluation of the request, including--
