The United States Department of Agriculture, Natural Resources Conservation Service (NRCS), Wisconsin is seeking a Contractor to furnish all labor, equipment, materials and incidentals required for native grassland revegetation and maintenance action in Avon Township in Rock County, WI. All work shall be done in accordance with the Statement of Work and the Specifications.
Work involves site preparation, seeding native species in specified areas and providing post-seeding maintenance (mowing) for the purpose of restoring and enhancing habitat on three (3) separate Wetland Reserve Program parcels in Rock County, Wisconsin.
Seeding shall be completed after October 22, 2010 and before snow cover exceeds 3 inches.
Post planting/seeding maintenance is scheduled periodically throughout 2011 and 2012.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

INVOICES
Contractor shall submit invoices to NRCS for review and acceptance. Upon completion and acceptance of each line item, an invoice may be submitted.
Invoices must be readable and include:
· date of the invoice
· invoice number
· description of supplies, quantity and prices
· payment amount
· name, phone number and e-mail address of Contractor point of contact for invoice questions
PAYMENTS
Payments will be made either by electronic deposit to the Contractor’s banking institution or by Government Purchase Card.

FAR 52.212-2 EVALUATION – COMMERCIAL ITEMS (JAN 1999)
(a) The Government intends to award one contract resulting from this solicitation to a responsible offeror whose offer conforms to the solicitation and will be advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Evaluation Factor #1: Similar Experience & Approach A. Describe similar work provided for the Federal Government, maximum 1 page.
B. Describe approach to ensure the quality control for seed is met, maximum 1 pages, see pages 11 of Attachment 2, Native Seeding & Cover Treatment Plan.
Evaluation Factor #2: Past performance Include a summary of the offerors’ most recent three similar projects.
For any past work stated, provide:
· applicable customer name
· size of project (in acres)
· contract dollar values
· description of work performed, and
· period of performance
· name, phone number and e-mail address of the person who can verify your past experience/performance.
Technical and past performance, when combined, are significantly more important than cost or price.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
OTHER: The Government intends to make award(s) without discussions.
FAR 52.212-3 Offeror Representations and Certifications—Commercial Items (AUG 2009)
ALL OFFERORS MUST COMPLETE THE ANNUAL REPRESENTATIONS AND CERTIFICATIONS AT HTTP://ORCA.BPN.GOV.
(2) The offeror has completed the annual representations and certifications electronically via the ORCA website at http://orca.bpn.gov. After reviewing the ORCA database information, the offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation).
AGAR 452.204-70 INQUIRIES (FEB 1988)
Inquiries and all correspondence concerning this solicitation shall be submitted in writing to Tami Lanier, Contracting Officer. Offerors should contact only the Contracting Officer.
452.237-71 Pre-Bid/Pre-Proposal Conference / Site Showing (FEB 1988)
(a) The Government is planning a site showing, during which potential offerors may obtain a better understanding of the work required.
(b) Offerors are encouraged to submit all questions in writing prior to the conference. Questions will be considered at any time prior to or during the conference; however, offerors will be asked to confirm verbal questions in writing. Subsequent to the conference, an amendment to the solicitation containing an abstract of the questions and answers, and a list of attendees, will be disseminated.
(c) In order to facilitate preparations, it is requested that Tami Lanier be e-mailed the number of persons who will attend.
(d) The Government assumes no responsibility for any expense incurred by an offeror prior to award.
(e) Offerors are cautioned that, notwithstanding any remarks or clarifications given at the conference, all terms and conditions of the solicitation remain unchanged unless they are changed by amendment to the solicitation. If the answers to conference questions, or any solicitation amendment, create ambiguities, it is the responsibility of the offeror to seek clarification prior to submitting an offer.
(f) The site showing is scheduled for Friday, September 3. The site showing will begin at 8:30AM at 10436 South Hopkins Road. It is on Hopkins Road between Beloit-Newark Road and Douglas Road, T1N R10E, Brodhead, WI 53520. 42.5431 -89.3257 After a brief meeting concerning the request for quote process and contract requirements, the group will receive a tour of the work sites.
