PHASE II Questions and Answers Massabesic Road and Watershed Restoration

AG-4419-S-10-0002

1. Who is the prime? The Design or the Construction Contractor.

a. The construction contractor is the prime under Design Build.

2. Is it public information as to how many teams are short-listed and who they are?

a. There is no reference in the Federal Acquisition Regulations that directs providing this information.

3. The cover letter calls for the proposal to be submitted via US Mail no later than noon on 1/15/2010; however the solicitation attached indicates it should be received by 2:00pm on 1/15/2010. Can you confirm the correct time?

a. 2:00 pm, EST.

4. We have downloaded a clear version of a blank SF1442. The SF1442 included with the solicitation is very difficult to read, and some of the dates for submittal have changed. Should we use the information in the solicitation version to fill out the blank version, or is there an updated/more clear version available?

a. See attached

5. >>> is the lead engineering consultant for the project, and we have one other consulting engineer providing geotechnical engineering. Do we need to submit an SF330 for both firms, or just our firm, as the major engineering design provider?

a. List the consultants as usual at the bottom of the form with a separate page reflecting the level of effort anticipated for each consultant.

6. The solicitation requests “verification of financial status of the company, credit information” under Financial Responsibility – can you confirm what documents would satisfy this requirement, and is this just for the contractor, or do we need to provide this information for the lead engineer and subconsultant engineer?

a. Prime Contractor only. No particular documents required, credit references or year end financial statements are the usual.

7) Do you select the Design-Build Team that will work on this project from the Phase II submission?

a. Yes

8) Is the pricing that we submit with Phase II submission considered the "final price" or is it adjusted as the design work progresses and the Design-Build Team works with the USDA toward the final……?

Price would be finalized at the established submission during the design process.

9) The SF 1442, Section 13 states that an offer guarantee is required. What percentage of the offer does the guarantee need to be?

a. Page 80 of the RFP – FAR 52.228-1 500,000 or 100% whichever is less.

10) Depending on the answer to # 2 above, how does the offer guarantee work in Phase II submission if the pricing is negotiated with the USDA as the design work moves forward and narrows down the actual scope of work and pricing?

a. Bid bond is only needed until award????? Price will not be finalized until long after award.

11) Our firm is working on the project approach and price proposal for submission next week. We understand a Bid Bond is required, per SF 1442. Could you please briefly inform us of the % of coverage the USDA is looking for? 5% or 10% is typical from our experience. We would just like to know the exact requirement.

a. See number 9 above
