SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

DIVISION 100 – GENERAL SPECIFICATIONS

110 – Scope of Contract Provide all equipment, labor, materials, tools and other incidentals and execute all work necessary to perform the required trail maintenance on the designated National Forest trails in accordance with the specifications. The work consists of routine maintenance activities normally associated with gravel and native-surfaced trails.

120 – Equipment Requirements & Transportation All equipment proposed to be used for performance of the work shall be the size, type, and in such condition to properly pursue the requirements of this contract.

Equipment requirements are as follows:

121 - The Contactor’s proposed equipment shall be made available to the Contracting Officer for inspection and approval prior to award of this contract.

122 - The Contractor shall consider the limitations on all segments of the trail when deciding on equipment size and maneuverability. The contractor may need to provide multiple pieces of equipment for each trail to complete the necessary maintenance items. The following equipment restrictions apply:

1. Grading equipment to be used shall have a width not greater than 66 linear inches. Some sections of the trail located on old roads can accomadate wider equipment, with prior approval by CO.

2. Width Restrictions for rollers: The roller (drum), shall have a maximum width of 60 linear inches and rubber tire rear wheels.

3. Excavators shall be tracked and have a maximum width of 66 linear inches. Excavator buckets shall be eqipped with both smooth edge and teeth.

4. Stone haulers shall be a maximum of 66” wide and be fitted with an adapter to reduce pour to 36” width.

5. The Contractor may propose alternate equipment meeting the size requirements for trail work, for CO approval.

123 - Any movement or transportation of equipment to or from the work area(s) required to complete the work, or for repair or replacement, is considered incidental and shall be accomplished at the Contractor’s expense.

130 – Work Hours & Inspections Work hours will be during daylight hours, Monday through Friday. No evening work or work on weekends or federal holidays will be allowed without approval of the Contracting Officer’s. Inspections will be performed weekly and work will be accepted prior to contractor shutting down for the weekend.

DIVISION 200 – TECHNICAL SPECIFICATIONS

210 –Maintenance Activities for Trails Maintain the trail prism to keep drainage functional and to alleviate erosion or sedimentation on or from the trail. Blading operations shall be conducted where applicable and shall include removal of ruts, potholes (drain standing water), corrugations and berms. If segments of trail are stable and properly drained, in accordance with design template, no work is required. The contractor shall be held liable for any damage to culverts, bridges, signposts and pipelines. Locations of known pipelines will be identified with the contractor.

211 - Restoring Surface The contractor shall reclaim all suitable material, which has been worked onto the edges of trails by traffic or maintenance activities, back onto the trail.

The total trailbed width shall be bladed and shaped to produce a surface which is uniform, consistent to grade, and crowned or cross-sloped as indicated by the character of the existing surface. Established grasses and other vegetation shall not be removed from areas outside the traveled way except as incidental to providing drainage.

Undercutting of the trail surface at the trailbed edge and leaving material berms is unacceptable.

The finished surface including transitions between different cross sections shall provide a uniform driving surface. At intersections, the side trails and roads, which are not closed to vehicular use, shall be bladed to assure a smooth transition.

212 - Restore Drainage Restore drainage dips and ditches to reestablish drainage by removing obstructions such as accumulated soil or berms, rocks, roots and sticks to make dips and ditches free draining.

No material shall be deposited in ditches, or in such places as to interfere with the trail drainage. Material shall be “feathered out” such that no berms are created. All ditches shall be maintained in their original location to the shape and grade required to insure drainage of the trail. Handwork required to properly connect ditch flow lines to drainage structure inlets is considered a part of this activity.

Unsuitable material shall be wasted. Unsuitable material will be feathered out in a manner as to not create berms, and so the material does not re-enter any culverts, or inlet/outlet ditches. Spoil shall be seeded and mulched.

Leadoff ditches shall be opened to provide drainage away from the trail. No material excavated from the structures shall be reclaimed onto the trail. Spoil shall be seeded and mulched.

213 - Compacting Surface

The trail surface shall be at a sufficient moisture content suitable for compaction.

Determination to be made by on site FS inspector.

Compaction equipment shall be operated over the full width of trail until visual displacement ceases, but not fewer than two complete passes.

Compaction equipment shall be a smooth drum vibratory roller, rubber-tire driven, capable of obtaining the compaction requirements without detrimentally affecting the compacted material.

Compaction shall be completed at the end of each workday, if conditions permit, over the segments of trail completed that day.

220 – Payment Payment, in arrears, will be authorized upon bid item completion and acceptance and upon receipt of properly completed invoice (FS 6300-30). Vendor is encouraged to notify Contracting Officer’s immediately upon completion of specific item(s), if progress payments are desired/approved by Contracting Officer. Note that payment(s) made under any ensuing contract will be made by Electronic Funds Transfer (for additional information see clause 52.213-4 (g), Section “I”).

230 - Safety It is required that warning signs be posted, in accordance with the Manual on Uniform Traffic Control Devices, at the end of each trail section being worked. Trail needs to be passable for users. No hazards shall be left in the trail over night.

It is the contractor’s responsibility to ensure that the work environment is safe for themselves as well as their employees. If the contractor feels that a requirement in this contract would place them or their employees in an unsafe environment, then work should stop on that area of work and the contractor should contact the CO. Work on other areas of the contract that the contractor does not view as unsafe should continue.

Work may be stopped by CO for unsafe work environment.

Contractor is required to follow all applicable OSHA standard(s) while working on job site. In addition, it is recommended that the successful contractor utilize appropriate personal protective safety equipment/clothing, which may include, but is not limited to, a hard hat, leg protection, ear protection, eye protection, and hand protection, while working in project areas. Contractor must keep the District Office posted as to current site of work.

AGAR 452.211-72 Statement Of Work/Specifications (FEB 1988)

The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

PROJECT NAME: ATV HEAVY TRAIL MAINTENANCE

(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00 [insert dollar figure or quantity], the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of $200,000.00 [insert dollar figure or quantity];

(2) Any order for a combination of items in excess of $200,000.00 [insert dollar figure or quantity]; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if https://www.acquisition.gov/far/current/html/52_216.html#wp1115057

the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 12/31/2020.

52.217-7 Option for Increased quantity – Separately Priced Line Item (MAR 1989)

52.217-9 Option to Extend the Term of the Contract (Mar 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 (years).

(b) The contracting activity is responsible for administering the contract and taking any action on behalf of the Government under the terms and conditions of the contract. However, the contracting activity shall give advance notice to the SBA before it issues a final notice terminating performance, either in whole or in part, under the contract. The contracting activity shall also coordinate with SBA prior to processing any novation agreement. The contacting activity may assign contract administration functions to a contract administration office.

(c) The contractor agrees:

(1) to notify the Contracting Officer, simultaneous with its notification to SBA (as required by SBA's 8(a) regulations), when the owner or owners upon whom 8(a) eligibility is based plan to relinquish ownership or control of the concern. Consistent with 15 U.S.C. 637(a)(21), transfer of ownership or controls hall result in termination of the contract for convenience, unless SBA waives the requirement for termination prior to the actual relinquishing of ownership and control.

(2) it will adhere to the requirements of 52.219-14, Limitations on subcontracting.

52.222-37 Employment Reports on Veterans (Oct 2015)

(a) Definitions. As used in this clause, “Armed Forces service medal veteran,” “disabled veteran,”

“active duty wartime or campaign badge veteran,” and “recently separated veteran,” have the meanings given in FAR 22.1301.

(b) Unless the Contractor is a State or local government agency, the Contractor shall report at least annually, as required by the Secretary of Labor, on— https://acquisition.gov/far/current/html/Subpart%2022_13.html#wp1085590

(1) The total number of employees in the contractor’s workforce, by job category and hiring location, who are disabled veterans, other protected veterans (i.e., active duty wartime or campaign badge veterans), Armed Forces service medal veterans, and recently separated veterans;

(2) The total number of new employees hired during the period covered by the report, and of the total, the number of disabled veterans, other protected veterans (i.e., active duty wartime or campaign badge veterans), Armed Forces service medal veterans, and recently separated veterans; and

(3) The maximum number and minimum number of employees of the Contractor or subcontractor at each hiring location during the period covered by the report.

(c) The Contractor shall report the above items by completing the Form VETS-100A, entitled “Federal Contractor Veterans’ Employment Report (VETS-100A Report).”

(d) The Contractor shall submit VETS-100A Reports no later than September 30 of each year.

(e) The employment activity report required by paragraphs (b)(2) and (b)(3) of this clause shall reflect total new hires, and maximum and minimum number of employees, during the most recent 12–month period preceding the ending date selected for the report. Contractors may select an ending date—

(1) As of the end of any pay period between July 1 and August 31 of the year the report is due; or

(2) As of December 31, if the Contractor has prior written approval from the Equal Employment

Opportunity Commission to do so for purposes of submitting the Employer Information Report EEO-1 (Standard Form 100).

(f) The number of veterans reported must be based on data known to the contractor when completing the VETS-100A. The contractor’s knowledge of veterans status may be obtained in a variety of ways, including an invitation to applicants to self-identify (in accordance with 41 CFR 60-300.42), voluntary self-disclosure by employees, or actual knowledge of veteran status by the contractor. This paragraph does not relieve an employer of liability for discrimination under 38 U.S.C. 4212.

(g) The Contractor shall insert the terms of this clause in subcontracts of $100,000 or more unless exempted by rules, regulations, or orders of the Secretary of Labor.

(1) The product cannot be acquired—

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) October 31 of each year during contract performance; and

(ii) At the end of contract performance.

52.225-9 Buy American Act-Construction Materials (MAY 2014)

(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the

Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means—

(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or https://acquisition.gov/far/current/html/Subpart%202_1.html#wp1145508 http://uscode.house.gov/

(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

[Contracting Officer to list applicable excepted materials or indicate “none”]

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic…
