SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C-1 - PROJECT DESCRIPTION
a) Introduction – The Forest Service (FS) is soliciting bids for the removal and replacement of several road-stream crossings, in Berlin, NH within the White Mountain National Forest, Androscoggin Ranger District.
The contractor shall provide all expertise, labor, supervision, services, equipment, tools, supplies, permits (as applicable), coordination with utilities, transportation, and incidentals necessary to complete the work described. The desired outcome is completed installation per the standards attached to this solicitation, and adherence to the contract awarded. The awarded contract shall constitute the entire agreement including all terms and conditions applicable to the contract. Work shall be completed as shown in the drawings, maps, specifications, and exhibits as referenced or included in this contract; and in accordance with applicable federal state and local regulations.
b) Description of Work – Work includes the removal of existing culverts, and installation of new precast concrete frame structures; including stream dewatering, excavations, furnish and place structures, constructing roadway embankments and structural backfill, furnish and place aggregate and asphalt surfacing, regrading of streams, and furnish and install bridge rails and related roadway appurtenances.
c) Project Location – Bog Dam Loop Road, NFSR #15 is located off of the York Pond Road, accessed from Highway 110 in Milan, New Hampshire approximately 10 miles north of Berlin, NH See also, vicinity maps on enclosed Plans.
d) Price Range – Between $250,000 and $500,000
e) Pre-bid Tour – A pre-bid tour is proposed on June 17, 2015. No additional pre-bid tour is planned.

f) Start Work – It is estimated that work will begin around August 10, 2015. Site disturbing activities shall be performed consistent with the periods of restriction noted in Plans, Permits, or other instruction.
g) Period of Performance – Work shall be completed by November 12, 2016. The Period of Performance includes pre-construction and construction activities such as: obtaining permit approvals, submittal of fabrication and manufacturing proposals, ordering and delivery of materials; and performance of the work.
h) Government Furnished Materials – None.
i) Use of Environmentally-Preferable Materials – Contractor shall use in the work, and incorporate into finished product, bio-preferred materials and supplies whenever available and practical. Submit to the CO for approval prior to ordering materials, product sheets and manufacturer’s information, indicating environmentally-preferable content.

C-2 - PROJECT OPERATIONS
C2-a) Permits – The Government has obtained permits for instream construction activities, as referenced in the solicitation. The Contractor shall obtain additional permits as necessary for the operations; such as transportation of heavy loads or hazardous materials, disposal of materials, crossing of railways, or similar, as required by local, state, and federal jurisdictions.
C2-b) Staging Area – The Contractor shall coordinate with the CO on a staging area location(s). The Contractor shall operate all equipment and store, transport, and handle materials in a manner that will not damage the existing roads, parking lots, and landscaping.
C2-c) Landscape Preservation – The Contractor shall confine operations to within the clearing limits designated, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside these limits.
Equipment shall be clean and properly-maintained. Leaking or faulty equipment shall be repaired or removed.
Refueling, greasing, or servicing of equipment shall be in controlled areas away from surface waters. Fording of streams or rivers with mechanized equipment shall not be allowed.
If, prior to or during excavation work, items of archaeological, paleontological, or historic value are reported or discovered, or an unknown deposit of such items is disturbed, the Contractor shall immediately cease excavation in the area so affected. Contractor will then notify the Forest Service and will not resume excavation until written approval is given by the authorized officer.
C2-d) Erosion Control – The Contractor is responsible for implementing temporary erosion control. Establish erosion protection and dewatering methods prior to conducting excavations. Maintain erosion control measures, and improve and replace immediately any non-functioning measures, throughout the course of the project and until site stabilization has been reestablished.
Schedule and conduct operations to minimize erosion of soils and to prevent silting or muddying of stream, rivers, irrigations systems, or impoundments.
C2-e) Dewatering – The Contractor is responsible for all dewatering activities. Conduct dewatering suitable to protect the landscape from the activities, and as needed to isolate the work from streams and protect the work from damage.
C2-f) Spill Prevention – The Contractor shall prepare for approval, and adhere to, a Spill Prevention, Control, and Countermeasures Plan suitable to protect environment from the Contractor’s operations.
Pollutants such as fuels, lubricants, bitumens, sewage, hazardous, or otherwise harmful shall be controlled at the site and prevented from release to the environment. All contaminated soil, vegetation or debris resulting from Contractor’s operation shall be immediately contained and within 24 hours shall be removed from site and legally disposed.

Control the discharge of non-hazardous wash water through sufficient siltation treatments, such as filters, barriers, or settlements. Dispose of any materials containing hazardous-substances legally off national forest system lands.
C2-g) Electrical – There is no electrical service on this project.
C2-h) Services – Potable Water and Toilet Facilities are not available in this location. The Contractor is responsible for providing temporary sanitation facilities as necessary.
C2-i) Existing Utilities – The Contractor shall ensure locations of any utilities prior to excavation, trenching, or other ground disturbing activity. The Contractor shall be responsible for protecting or otherwise replacing utilities damaged by Contractor’s operations.
C2-j) Security and Protection – Security is the Contractor’s responsibility. Limit access to the construction area to persons involved in the work. Provide secure storage for materials that are stored on site. Secure completed work as required to prevent loss.
Barricades, warning signs, and lights shall comply with standards and code requirements for erection of structurally adequate barricades. All road warning signs, barricades, and traffic control devices shall conform to MUTCD. Where appropriate and needed, provide lighting, including flashing red or amber warning lights.
The Contractor shall barricade and block all access to holes with orange plastic fence, flashing amber lights, or warning signs. Holes or trenches shall not be left open more than 24 hours unless approved by the CO.
C2-k) Maintenance of Traffic – The Contractor shall have all temporary construction signs and traffic control measures in place prior to beginning work. The Contractor is authorized to use roads under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to limitations and authorizations shown on the Plans or specified under this contract, when such use will not damage the roads or National Forest resources, and when traffic can be accommodated safely.
The roads shall remain open and maintained for public travel; except closure of the work locations, to minimum extent needed to conduct the work.
Any emergency vehicle shall be allowed immediate reasonable passage.
C2-l) Protection of Improvements – The Contractor shall complete sequences of construction activity in order to prevent damage to equipment, material, and articles incorporated into the work covered by this contract.
Contractor shall replace, or repair, as approved by the CO any improvements, covered under this contract or already existing, damaged by contractors operations.
Before shutting down operations, take all necessary precautions to prevent damage to the project, such as temporary detours, approaches, crossings, or intersections; and provide for protection of surface drainage and minimization of erosion and prevention of spills.
C2-m) Site Cleanup – The Contractor shall be responsible for solid waste disposal and personnel sanitation.
The Contractor shall at all times keep the area in a clean, neat, and orderly condition. Construction related debris including, but not limited; to used motor oil, oil cans, grease cartridges and refuse shall be removed

Berlin, New Hampshire promptly from the site and disposed of in a lawful manner off National Forest System lands. Fees for the use of landfills or transfer stations shall be paid for by the Contractor if there is a charge.
C2-n) Other Operations – The contractor shall avoid interference with the operations of other contractors or projects in the area.
The Forest Service intends to complete the removal and replacement of the road-stream crossing at Brandy Brook, approximate mile marker 12.2, on the same road as this project. The Brandy Brook work site may be closed and impassable at various times during performance of this project.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:
(1) When no longer needed for contract performance.
(2) Upon completion of the Contractor employee’s employment.
(3) Upon contract completion or termination.
(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.
(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.
52.222-37 Employment Reports on Veterans (JUL 2014)
(a) Definitions. As used in this clause, “Armed Forces service medal veteran,” “disabled veteran,” “active duty wartime or campaign badge veteran,” and “recently separated veteran,” have the meanings given in
FAR 22.1301.
(b) Unless the Contractor is a State or local government agency, the Contractor shall report at least annually, as required by the Secretary of Labor, on—
(1) The total number of employees in the contractor’s workforce, by job category and hiring location, who are disabled veterans, other protected veterans (i.e., active duty wartime or campaign badge veterans), Armed Forces service medal veterans, and recently separated veterans;
(2) The total number of new employees hired during the period covered by the report, and of the total, the number of disabled veterans, other protected veterans (i.e., active duty wartime or campaign badge veterans), Armed Forces service medal veterans, and recently separated veterans; and
(3) The maximum number and minimum number of employees of the Contractor or subcontractor at each hiring location during the period covered by the report.
(c) The Contractor shall report the above items by completing the Form VETS-100A, entitled “Federal Contractor Veterans’ Employment Report (VETS-100A Report).”
(d) The Contractor shall submit VETS-100A Reports no later than September 30 of each year.
(e) The employment activity report required by paragraphs (b)(2) and (b)(3) of this clause shall reflect total new hires, and maximum and minimum number of employees, during the most recent 12–month period preceding the ending date selected for the report. Contractors may select an ending date—
(1) As of the end of any pay period between July 1 and August 31 of the year the report is due; or
(2) As of December 31, if the Contractor has prior written approval from the Equal Employment
Opportunity Commission to do so for purposes of submitting the Employer Information Report EEO-1 (Standard Form 100).

(f) The number of veterans reported must be based on data known to the contractor when completing the VETS-100A. The contractor’s knowledge of veterans status may be obtained in a variety of ways, including an invitation to applicants to self-identify (in accordance with 41 CFR 60-300.42), voluntary self-disclosure by employees, or actual knowledge of veteran status by the contractor. This paragraph does not relieve an employer of liability for discrimination under 38 U.S.C. 4212.
(g) The Contractor shall insert the terms of this clause in subcontracts of $100,000 or more unless exempted by rules, regulations, or orders of the Secretary of Labor.
52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts
(SEP 2013)
(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—
(1) The product cannot be acquired—
(i) Competitively within a time frame providing for compliance with the contract performance schedule;
(ii) Meeting contract performance requirements; or
(iii) At a reasonable price.
(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:
(i) Spacecraft system and launch support equipment.
(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(a) Definitions. As used in this clause— “Postconsumer material” means a material or finished product that has served its intended use and has been discarded for disposal or recovery, having completed its life as a consumer item. Postconsumer material is a part of the broader category of “recovered material.”
“Recovered material” means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.
(b) The Contractor, on completion of this contract, shall—
(1) Estimate the percentage of the total recovered material content for EPA-designated item(s) delivered and/or used in contract performance, including, if applicable, the percentage of post-consumer material content; and
(2) Submit this estimate to R9 NEAT Contracting Officer complete in accordance with agency procedures].

(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—
(1) Means any item of supply (including construction material) that is—
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
“Component” means an article, material, or supply incorporated directly into a construction material.
“Construction material” means an article, material, or supply brought to the construction site by the
