B-1 MINIMUM AND MAXIMUM CONTRACT AMOUNTS (AGAR 452.216-73)(FEB 1988)

During the period specified in FAR clause 52.216-18 ORDERING, the Government shall place orders totaling a minimum of $2,000 for each awarded contract over the life of the contract (including any option years exercised), but not in excess of $1,000,000 aggregate for all awarded contracts inclusive of all option periods.

The Government anticipates up to four (4) awards resulting from this solicitation. Actual number of awards may be more or less, depending on offers received.

C-1 SCOPE OF CONTRACT

This contract covers multiple projects for Facility Site Improvement and Development which includes facility construction and maintenance in urban and remote locations administered by the USDA Forest Service on the Siuslaw, Willamette and Mt. Hood National Forests, as well as urban and remote locations governed by the USDI Bureau of Land Management on the Eugene and Salem BLM Districts. The Government anticipates making sufficient multiple awards to accommodate adequate task order competition. Contractors should be generalists, not specialists, capable of performing all aspects of construction, service, and maintenance requirements in order to complete the work.

Definitions

Facilities. Including but not limited to Government-owned facilities located within or around recreation sites, such as, flush and vault toilets, septic and water systems associated with recreation sites, parking lots, concrete walkways, picnic shelters, rental cabins, lookouts, barns, bunkhouses, offices, and hazmat storage buildings.

Recreational Site. Including but not limited to forest campgrounds, trailheads, boat docks, loading ramps, fee collection boxes, viewing sites, dispersed camping areas, picnic shelters, informational areas and associated signing.

Project Work

Construction – Includes all work associated with Administrative, Fire and Recreational Facilities.

Examples of the work may include, but is not limited to, the following: Construction of water and waste water systems, electrical, plumbing and HVAC systems; roofing and flooring removal, repair, or installation; interior and exterior painting; window sash, sill, pane repair or replacement; truss repair or replacement; subfloor and foundation repair or replacement; siding repair or replacement; installation or repair of interior and exterior doors; exterior and interior weather-damage repairs; all types of concrete or asphalt construction or repair; reconstruction and/or construction of campsites, trailheads and trails, other developed recreation-oriented amenities, and visitor information sites (viewpoints and other informational sites for example); construction to meet American Barrier Act (ABA) standards for accessibility which may include placement of a hardened surface (aggregate, concrete or asphalt) on walkways, trails and parking sites, and construction of access ramps. Site development for prefabricated toilet buildings, construction/reconstruction of existing camping sites to include pull-through access/parking to accommodate larger recreation vehicles; development of group sites and/or new campsites within campgrounds; additional site development to accommodate trailers and other recreation vehicles; repair and/or reconstruction of recreation sites made necessary due to vandalism, normal wear and tear, to protect investment and/or provide for safety; furnish and install picnic shelters;

construction of access ramps; placement of access barriers to prevent resource damage, and provide or repair of site drainage; site prep and installation of prefabricated toilet buildings; and emergency work such as removing or installing culverts, due to fire, flood or storm damage.

Service – Work includes but is not limited to: recreation site landscaping such as hazard tree removal, removal of trees needed for access, brush trimming or removal; maintaining trails and trailheads by clearing debris; hauling & dumping gravel or soil; toilet pumping; placement of large rocks to prevent resource damage; dismantle, demolition or removal of improvements; maintenance on systems or equipment; sign maintenance; campground maintenance; rodent and pest control which may include cleanup of excrement; work area management (traffic control); dust abatement; any emergency work resulting from fire, flood or storm damage.

Other information

While every effort will be made to insure facilities will not be occupied, some facilities in daily use may require additional project safety signing and barricades.

Rental cabins, campgrounds and bunkhouse/living quarters may have a mandatory performance period to insure vacancy. Restrictions will be noted on individual Task Orders.

Most recreation sites on the Forest have limited or no access to existing utilities. If available, Contractor will be provided access to existing utilities for camping and project use. This information will be noted on individual Task Orders.

Camping permits may be issued at the Line Officer’s discretion per Task Order.

Approved Sign Plan to MUTCD-standard, and site-specific Safety Plan shall be required for individual

Task Orders prior to issuance of the Notice-to-Proceed.

Individual Project Task Orders

This is an Indefinite Delivery Indefinite Quantity contract, allowing specific projects to be added via Individual Project Task Orders as they are developed.

Individual Projects will be packaged with the project-specific details that supplement the standard specifications and terms of the basic contract. These Individual Project requirements will include detailed payment items, special or supplemental project specifications, drawings, specialized inspection terms, performance period requirements, Government-furnished property, Government-furnished facilities, or Government-furnished services, special contract requirements, exhibits and other detailed requirements applicable to the specific Individual Project.

For each Individual Project a best-value analysis and source selection will be completed. Project-specific pricing and project-specific technical proposals will be requested as described herein. See Section G.

If a fair and reasonable price is negotiated through the Individual Project proposal process, an Individual Project Task Order will be prepared for that specific project. The actual contract value is based on the cumulative amounts of these Individual Project Task Orders and any subsequent modifications to them.

If a fair and reasonable price is not reached through the Individual Project proposal process, that Individual Project will be withdrawn for acquisition separate from this contract. Pricing of Individual Projects will be firm-fixed price.

Bonding requirements will be included with each Individual Project Task Order and will apply only to that specific Individual Project Task Order. There are no separate bonding requirements for the contract as a whole.

The Government reserves the right to determine whether any specific Individual Project is to be made available under this contract. Numerous projects that also use the standard specifications and terms covered under this contract may be acquired separately from this contract. Typical projects that may be contracted separately often involve work that is more specialized in nature. Other factors may also influence whether projects are applied under this contract.

C-2 INDIVIDUAL PROJECT LOCATION

The area covered by this contract includes the Siuslaw, Willamette and Mt. Hood National Forests and the Eugene and Salem Districts of the Bureau of Land Management. These areas include the following counties:

Lane, Linn, Marion, Coos, Douglas, Lincoln, Tillamook, Benton, Polk, Yamhill, Washington, Columbia, Multnomah, Wasco, Hood River and Clackamas. Administrative sites, recreation sites and other developed sites associated with these National Forests and BLM Districts are included.

C-3 ATTACHMENTS TO STATEMENT OF WORK/SPECIFICATIONS - AGAR 452.211-73 (FEB

1988)

The attachments to the Statement of Work/Specifications listed in Section J are hereby made part of this solicitation and any resultant contract.

C-4 BIO-PREFERRED

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products.

The Contractor shall utilize products and material made from biobased materials (e.g., biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer (CO).

The following are examples of products that may be used in this contract for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor shall provide data for their biobased products such as biobased content.

In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products.

The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification.

The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts.

A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.

C-5 APPLICABLE SPECIFICATIONS

CSI Projects: CSI Specifications will be provided with each individual project task order.

Road Projects: Standard and Supplemental Specifications for FP-03 will be provided with each individual project task order.

Trail Projects: Forest Service Standard Specifications for Construction of Trails (EM-7720-103) will be provided with each individual project task order.

C-6 SPECIFICATIONS APPLICABLE TO INDIVIDUAL PROJECTS

The standard specifications that apply will be identified with Individual Projects. A Specification List and the actual Special Project or Supplemental Project Specifications will be included.

C-7 SUBMITTALS

Submittals shall include the following unless otherwise required in the specification:

1. Date and revision dates

2. Project name and contract number

3. Names of contractor, subcontractor, supplier and manufacturer

4. Specifications section number

5. Field dimensions and relation to adjacent structures

6. Applicable standards such as ASTM or Federal Specifications

7. Contractor’s stamp, initial or signature, certifying the review of submittal, verification of field measurements and compliance with contract documents

Provide all submittals within 14 calendar days of contract award unless otherwise required by the specification.

E-2 INSPECTION AND ACCEPTANCE (AGAR 452.246-70) (FEB 1988)

(a) The Contracting Officer or the Contracting Officer's duly authorized representative will inspect and accept the supplies and/or services to be provided under this contract.

(b) Inspection and acceptance will be performed at the project location.

E-3 INSPECTION AND TESTING PERFORMED BY GOVERNMENT

The Government will perform sampling, testing and inspection of work in progress where these responsibilities are not expressly assigned to the Contractor by the Forest Service specifications or by the Supplemental Specifications.

E-4 CONFORMITY WITH DRAWINGS AND SPECIFICATIONS

Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the Drawings, indicated in the specifications, or designated on the ground. "Reasonably close conformity" is in compliance with reasonable and customary manufacturing and construction tolerances.

E-5 CLEANING UP (FAR 52.236-12)(APR 1984)

The Contractor shall at all times keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work and premises any rubbish, tools, scaffolding, equipment, and materials that are not the property of the Government. Upon completing the work, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the Contracting Officer.

E-6 PERFORMANCE REQUIREMENTS INSPECTION AND ACCEPTANCE FOR CONSTRUCTION

Performance requirements and inspection and acceptance procedures for construction are found in the construction specifications that will be referenced in individual task orders.

PERFORMANCE REQUIREMENTS – SERVICE WORK

All work shall be performed in accordance with performance based standard specifications attached to each Individual Project Task Order unless otherwise specified in a task order.

Acceptable Quality Levels (AQLs) for each performance standard are also established and will be identified in each Individual Project Task Order. AQLs may vary between forests. These AQLs will apply to all ordered work unless otherwise specified in a task order.

CONTRACTOR QUALITY CONTROL INSPECTION – SERVICE WORK

Contractor Quality Control

The successful Offeror(s) shall provide a written Quality Control Plan satisfactory to the Government describing how contractor will control work quality and document inspection results for each Individual Project Task Order.

Contractor shall conduct ongoing quality control inspections in accord with the approved plan.

Contractor shall also provide written certification for all invoiced work that was accomplished in accordance with the terms and conditions of the Individual Project Task Order.

Inspection shall be maintained concurrent with Individual Project Task Order. Contractor inspection results shall be available to the Contracting Officer at all times.

GOVERNMENT QUALITY ASSURANCE – SERVICE WORK

Government Quality Assurance Plan

The Government may make periodic inspections while work is in progress. After completion of a pay item, the Government may also inspect to determine compliance with performance standards and acceptable quality levels. Determination of the acceptability of the work performed will be based on these verification inspections and will be considered conclusive.

Task Orders issued prior to the end of the current Ordering Period may provide for work under those Task Orders to be completed at a later date. In order to allow reasonable time for actual construction work, specific project performance periods may extend beyond the Ordering Period by 12 months or longer. This will allow a Task Order placed in late September to be performed through the field season of the following year.

Performance time for all Task Orders will run concurrently within the contract period unless an exception is established by mutual agreement.

*Individual Project Task Orders may require much shorter completion periods. The dates shown above are for the purpose of providing a “latest date” limitation under the contract.

F-3 SUSPENSIONS OF WORK FOR OTHER THAN GOVERNMENT'S CONVENIENCE

The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of:

(1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to be muddy or unsuitable; or

(2) Failure of the Contractor to comply with specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by its operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for an equitable adjustment.

F-4 INDIVIDUAL PROJECT TASK ORDER PERFORMANCE PERIOD REQUIREMENTS

The following clause [FAR 52.211-10] shall apply to each Individual Project Task Order. A specific completion date and Notice to Proceed date will be included within the Individual Project Task Order. The specific days/dates included under an Individual Project Task Order will vary considerably. The allowed performance completion period for an Individual Project Task Order will be dependent upon factors such as project size, complexity, available work periods limitations, and date of issuance. Individual Project Task Order performance periods may range from 30 calendar days to 25 months.

F-5 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR

1984) ALTERNATE I (APR 1984)

The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than ____________. [For each Individual Project Task Order the Contracting Officer will specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.] The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by_______________[For each Individual Project Task Order the Contracting Officer will provide an assumed effective date for notice to proceed]. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

F-6 Maximum Workweek – Construction Schedule (AGAR 452.236-75)(NOV 1996)

Within 10 calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following information in writing for approval:

(a) A schedule as required by FAR clause 52.236-15, Schedules for Construction Contracts, and

(b) The hours (including the daily starting and stopping times) and days of the week the Contractor proposed to carry out the work.

The maximum workweek that will be approved is 6:00 a.m. to 7:00 p.m. Monday through Friday; no work to occur on major holidays from 12:00 noon the Friday before the holiday through Monday of the designated holiday. For the purpose of this contract, designated holidays are Memorial Day, Fourth of July, Labor Day, and Columbus Day.

SECTION G--CONTRACT ADMINISTRATION DATA

G-1 PROCESS FOR REQUESTING INDIVIDUAL PROJECT PROPOSALS AND AWARDING

TASK ORDERS

(a) After award of the Request for Proposals the Individual Project proposals and awards shall follow the process established in this section.

(b) Initial Source Selection for Individual Project Proposal Submission. It is the Government’s intent to provide each contract Awardee with a fair opportunity to be considered for each Individual Project.

“Awardees” refers to the Contractors receiving awarded contracts under the basic Request for Proposals.

A Contract Specialist from the Issuing Office will be assigned the responsibility for preparation of the Individual Project package. The assigned Contract Specialist may exercise broad discretion in determining which Awardees should be considered for a particular Individual Project. Whenever practicable all Awardees shall be provided Individual Project proposal requests, unless compelling reasons dictate otherwise. Prior to providing Individual Project proposal requests, all Awardees will be evaluated regarding the following:

Limitations on each awarded Contract based on Offeror Qualification Resources and Capabilities relating to the specific project Past Performance History Responsiveness to prior requests under the contract, if applicable Other factors such as pricing, availability and meeting minimum guarantees

Where these considerations cause any Awardees to be eliminated from further consideration, such decision shall be final.

Competitive proposals will be sought from the selected Awardees.

(c) Individual Project Proposal Packaging. As they are developed Individual Projects will be packaged with all necessary detailed requirements that supplement the basic contract. Supplemental information will be formatted to correlate with the basic contract format. Each Individual Project will include the following:

o ISSUING OFFICE shown o PROJECT Section completed including a response time/date o OFFER Section for completion by Offeror o AWARD Section for later execution by ISSUING OFFICE if awarded

Section H Special Contract Requirements – Supplements to the basic contract clauses. This will include any use and operational period limitations, additional submittal requirements and other details

Section I Contract Clauses – added regulatory clauses such as Option clauses Section J Attachments o Specification List, Special Project or Supplemental Specifications o Drawings o Current Wage Decision that will apply o Questionnaire for Technical Proposal, if needed o Other Exhibits or Attachments

(d) Individual Project Proposal Requests. Individual Project packages will be provided to the selected

Awardees, with a specified response date and time. Awardees shall submit their questions related to the project to the assigned Contract Specialist. Submission of written questions may be required. If necessary, a written Amendment to the project package will be issued with an adjusted response date where appropriate.

Individual Project Proposal Requests may require only a price proposal or may also require submission of a technical proposal that is specific to the project.

(e) Individual Project Proposal Submission. Proposals shall be submitted to the issuing office by the specified response date. Proposal submissions shall include:

Completed and signed “OFFER” section on the TASK ORDER form Completed Section B Bid Guarantee (20%) if the total offer amount exceeds $150,000.00 Technical Proposal, if required

Offers are considered firm for 30 calendar days after the response date. Offerors may withdraw their offer or modify their offer at any time prior to award.

(f) Source Selection for Award of Individual Projects. Source selection will be based on the best overall value to the Government, price and other factors considered. Other factors to be considered will be expressed in the Individual Project Proposal Request package. These factors may include one or more of the following:

Technical Capabilities relating to the specific project [including elements such as Project Sequencing, Scheduling, Resource Availability, Technical Experience] Past Performance History Other factors

(g) Award of Individual Projects. A written award mailed or otherwise provided to an Offeror shall result in a binding Individual Project Task Order.

(h) No Award of Individual Project Offerings. In the event a fair and reasonable price is not reached, the project will be formally withdrawn for acquisition separate from this contract.

(i) Bonding of Individual Projects Bonding requirements apply separately to each Individual Project Task

Order.

G-2 INDIVIDUAL PROJECT TASK ORDERS

Services to be provided hereunder will be ordered by issuance of a written Individual Project Task Order. Each Individual Project Task Order will refer to this contract and will be subject to all the terms and conditions herein. Each Individual Project Task Order will contain the following information.

Individual Project Task Orders will be firm-fixed price.

The contract minimum amount is offset by the value of awarded Individual Project Task Orders.

Any warranted Contracting Officer with proper delegated authority within Region 6 of the USDA Forest Service.

Any warranted Contracting Officer with the proper delegated authority within the Oregon/Washington BLM Office in Portland, or the Eugene and Salem BLM District Offices.

G-3 FAIR OPPORTUNITY

Each contract holder will be given fair opportunity for the Task Order issued. Past Performance, Quality Control, and price, prior to award and during contract performance will be considered on Task Orders.

Ombudsman. If a Contractor believes they are not being fairly considered for a particular Task Order, they may present the matter to the Contracting Officer. The Contractor may appeal the explanation or decision of the Contracting Officer to the Forest Service Ombudsman. The Ombudsman will review the Contractor’s complaint, and in coordination with the Contracting Officer, ensure that the Contractor is afforded a fair opportunity to be considered for the Task Order. Complaints to the USDA Forest Service Ombudsman must be forwarded to:

G-4 ADMINISTRATION OF INDIVIDUAL PROJECT TASK ORDERS

Wherever the term “contract” is used herein it shall be construed to apply equally to Individual Project Task Orders placed under the contract, as if each Individual Project Task Order was a separate contract.

For example, the clause FAR 52.232-5, Payments Under Fixed Price Construction Contracts requires the final payment to be dependent upon (1) completion and acceptance of all work, (2) a properly executed voucher, and (3) a release of claims. All three of these final payment conditions shall apply to each Individual Project Task Order.

As another example, the clause FAR 52.228-15, Performance And Payment Bonds – Construction states, “Original contract price means the award price of the contract…” The term “Individual Project Task Order” is substituted in like meaning and effect for “contract” in this clause.

As another example, the clause FAR 52.219-14, Limitations on Subcontracting states, “By submission of an offer and execution of a contract, the Offeror/Contractor agrees that in performance of the contract in the case of a contract for --

(1) Services (except construction). At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.

(3) General construction. The concern will perform at least 15 percent of the cost of the contract, not including the cost of materials, with its own employees.”

The term “Individual Project Task Order” is substituted in like meaning and effect for “contract” in this clause.

There are numerous other examples where reference to “contract” shall apply as if the term “Individual Project Task Order” was substituted. The Contractor shall refer all questions to the Contracting Officer if clarification is needed regarding the application of contract clauses to Individual Project Task Orders.

Each Individual Project Task Order is separable to the extent that it will be initiated, performed, administered, completed and closed independently.

1. Individual Project Task Orders may have separate Contracting Officers, Contracting Officer’s

Representatives and Inspectors.

2. Individual Project Task Orders will have unique performance terms and notices to proceed.

3. Individual Project Task Orders will require separate submittals, unless otherwise agreed.

4. Individual Project Task Orders will have separate payments.

G-5 BID AND BIDDER VERSUS PROPOSAL AND OFFEROR

Wherever the term “bid” is used it shall be construed to mean “proposal.” This applies in reference to the basic contract, to the Individual Project proposal and award process and to Individual Project Task Orders. The term “bidder” shall be construed to mean “offeror.”

G-6 INDIVIDUAL PROJECT PROPOSAL RESPONSES

After the basic Request for Proposals is awarded Individual Project proposals are requested periodically. These requests will be limited based on the Offer Qualifications and corresponding contract award limitations. It is understood that the Contractor will be balancing their other commercial work with any proposed work under the awarded contract. Nonetheless there is a general expectation that Contractors will respond affirmatively to the majority of Individual Project proposal requests with a reasonable price and performance proposal. Repetitive failure to respond may impact the source selection process for future Individual Project proposals.

G-7 ISSUING OFFICE ADMINISTRATION

The Issuing Office shall be responsible for fund obligation and payment processing. The Issuing Office shall complete all Federal Procurement Data System (FPDS) and other reporting.

G-8 DESIGNATION OF CONTRACTNG OFFICER’S REPRESENTATIVE

The Contracting Officer’s Representative (COR) is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order or other matter deviating from the terms of this contract be effective or binding upon the government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract. The Contracting Officer should be informed as soon as possible or any actions, or inactions, by the Contractor, or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual assignments which were issued by the COR provided they do not affect the delivery schedule or the performance period stated in the contract.)

On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer.

Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractural coverage, the Contracting Officer should be notified immediately, preferably in writing, if time permits. Proceeding with work without proper contractural coverage could result in nonpayment or necessitate submittal of a contract claim.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H-1 FAR 52.236-4 PHYSICAL DATA (APR 1984)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surface observations.

(b) Weather conditions typical for this area indicate the following normal work season and fire season:

Normal work season: June through October Restricted work season: October through May (due to heavy precipitation) Normal fire season: June through October

(c) Transportation facilities providing access to the site are identified elsewhere herein.

H-2 PRODUCT SUBSTITUTION

A. When submitted within 30 days after contract award, the Contracting Officer will consider formal requests for substitution of products, equipment and methods, in place of those specified. Requests submitted after 30 days will be considered only in case of product unavailability or other conditions beyond the control of Contractor. Requests shall provide the information and be in the format as specified in paragraph B below.

B. Submit separate request for each substitution. Support each request with:

1. Complete data substantiating compliance of proposed substitution with requirements stated in contract documents:

a. Product identification, including manufacturer's name and address.

b. Manufacturer's literature; identify:

1) Product description

2) Reference standards

3) Performance and test data

c. Samples, as applicable

d. Name and address of similar projects on which product has been used, and date of each installation.

e. Comparative data of item to be deleted by proposed substitution. Include drawings to same (or larger) scale as pertinent portion of contract documents and marked to show how differences will be accommodated.

f. Show complete system/assembly as revised to accommodate proposed alternate for difference in performance, size, configuration, connections, service, accessibility, or any other significant characteristics.

g. Show complete layout of system except that which is identical to contract documents unless unchanged portion must be shown to indicate clearances, etc.

h. Include complete detail drawings of supports for all substitute equipment and complete load calculations for adequacy of support prepared and signed by a registered structural engineer.

1. Itemized comparison of the proposed substitution with product specified; list significant variations.

2. Data relating to changes in construction schedule.

3. Any effect of substitution on separate contracts.

4. List of changes required in other work or products.

5. Accurate cost data comparing proposed substitution with product specified.

6. Proposed amount of change to the contract.

7. Designation of required license fees or royalties.

8. Designation of availability of maintenance services, sources of replacement materials.

C. Substitutions will NOT be considered for acceptance when:

1. They are merely indicated or implied on shop drawings or product data submittals without a formal request from Contractor.

2. They are requested directly by a subcontractor or supplier.

3. Acceptance will require substantial revision of contract documents.

4. Substitution has not been requested in accordance with this and related clauses.

D. Substitute products shall not be ordered or installed without written acceptance of the Contracting Officer.

E. Contracting Officer will determine acceptability of proposed substitutions.

F. Number of Substitution Submittals: Only one proposed alternative will be considered for each item.

Provide specified item if substitution proposal is rejected.

H-2.1 CONTRACTOR’S REPRESENTATION & RESPONSIBILITY

A. In making formal request for substitution the Contractor represents he/she:

1. Have investigated proposed product and determined that it is equal to or superior in all respects to that originally specified.

2. Will provide same warranties and bond for substitute as for originally specified product.

3. Will coordinate installation of accepted substitution into the work, and will make such changes as may be required for the work to be complete in all respects.

4. Will waive claims for additional costs caused by substitution, which may subsequently become apparent.

5. Cost data is complete and includes related costs under the contract, but not:

a. Costs under separate contracts.

b. Contracting Officer costs for redesign or revision of contract documents.

B. The Contractor assumes full responsibility that the substitution and/or alternate items or procedures proposed will meet the job requirements.

C. The Contractor is solely responsible for the cost of redesign and modifications to this and other parts of the work caused by the substitutions or alternates furnished.

H-3 STORAGE AND STOCKPILING OF MATERIALS

Materials shall be stored to assure the preservation of quality and fitness for the work. Stored materials shall be located to facilitate their prompt inspection. Sites on Forest Service administered land (identified elsewhere herein) and approved by the Forest Service may be used for storage purposes and for the placing of Contractor's plant equipment. All storage sites provided by the Forest Service shall be restored at the Contractor's expense.

Contractor shall be responsible for making arrangements for storage on other than Forest Service administered lands.

H-4 LANDSCAPE PRESERVATION

The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.

a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or other natural features or any other improvements in the work area unless specifically authorized by the Contracting Officer. Unless otherwise provided herein, the Contractor shall confine contract operations to within the areas designated in contract documents.

b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumens, calcium chloride, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Contracting Officer.

H-5 LOCAL DISPOSAL SITES

Debris encountered in the construction (i.e.; metals) and other waste materials generated in the construction (cartons, scrap, etc.) shall be removed and disposed off of National Forest System Land or Administrative Sites, unless other disposal means are authorized in the plans or specifications.

H-6 INDUSTRIAL CAMPS

Forest Service regulations for Use of Campgrounds prohibit occupancy of developed recreation sites for other than primarily recreation purposes. No industrial camping will be authorized at these sites. A special use permit is required on National Forest land for industrial camps.
