PRE-PROPOSAL CONFERENCE NOTES

Attendees:

Government – Andrea Stanbro, Tom Burry, Julie Tarvin Contractors – Larry Bankston, Raymond Osipovich representing Grayback Forestry, and Larry McCaulden representing Boise Cascade, and Chris and Donna Heffernan representing North Slope Resources.

Andrea Stanbro, Contract Specialist, led the discussion on the parts of the solicitation and explained the following acronyms: FAR – Federal Acquisition Regulations, AGAR – Department of Agriculture Acquisition Regulations, and FSAR – Forest Service Acquisition Regulations.

This project is not set-aside. Quotes are due August 29, 2011 at 4:30 PM. Mailed proposals to PO Box 907 Baker City, OR or hand-delivered proposals 1550 Dewey Avenue Baker City, OR will only be accepted. Faxed or emailed proposals will not be accepted.
Offerors must complete Blocks 17a, 26, and 30a-c on the Standard Form 1449.
The Schedule of Items lists the services and prices. Offerors must submit a unit price and total price for Line Items 1 and 2, and a price which they will pay for the timber in the middle of Page 3. Deposits for road use and surface replacement (Raods 5100, 5160, and 5175) in the amount of $7.02 per CCF shall be paid by the contractor, in addition to the price paid by the contractor for the timber products to be removed. This price shall be included in the service price, it is not part of the road maintenance.

Offerors must register in ORCA and CCR. Migrant & Seasonal Work Protection Act and Oregon Farm Forest Labor License apply to work item 1.

The clause, Addendum to FAR 52.212-1 Instructions to Offerors – Commercial Items provides instructions for what needs to be submitted with the price quote. Detailed proposals shall be provided and are encouraged. The number of copies required is listed in paragraph (a)(4). Offers must provide information on Past Performance, Technical Approach, Key Personnel (Overall Project Manager) and Utilization of Local Workforce. Follow the instructions carefully and provide the information that is requested in each of the factors.

FAR Clause 52.212-2 Evaluation – Commercial Items describes how the Government will evaluate. All technical factors when combined are approximately equal to price. Offerors Technical Approach and Utilization of Local Workforce will be incorporated into any resultant contract. The accepted proposal will take precedence if there is any inconsistency between the accepted proposal and the Government’s solicitation requirements.

The project objectives and location were discussed. This is a service contract with provisions for product removal. All supplies, equipment, labor and supervision shall be provided by the Contractor.

The Contractor shall identify the quality control system and the Government will use their quality assurance surveillance plan to monitor Contractor performance as stated in each Appendix.

Clause 52.211-10, discussed start work within 10 days after receipt of Notice to Proceed. Work is estimated to begin in the fall of 2011, but this is negotiable based on award date. All work items shall be completed no later than October 31, 2014. Contract time runs continuously without suspensions. Contract time has already taken into consideration fire shutdowns, ground conditions, restricted access, and hauling days.

The clauses that are unique to stewardship were briefly discussed. Although the Government is trading goods for services, based on our information, we know we will not have sufficient goods to cover the cost of the services, therefore the Government will make payments to the Contractor. Any payments made will be 30-day payments. Stewardship credits are accrued when service work activities are completed and accepted. Prior to harvesting any timber, the Contractor must make advance deposits to cover the value of the products expected to be cut in not less than 30 calendar days and not more than 60 calendar days. This amount is based on the offer the Contractor makes for purchasing the product material. On page 13, Clause Contractor Certification is a required monthly certification that must be completed by the Contractor.

Generally discussed the other contract clauses commonly seen in service contracts. The Key Personnel clause was discussed and the Project Manager can’t change within the first 90 days of the contract and the CO needs to be notified within 15 prior to a change being made. Fire requirements are the same from most service/construction contracts. Roads that can be used are listed in Appendix C. Safety is very important. Contractor will be required to submit a safety plan prior to start work. The clause Protection Measures needed for Plants, Animals, Cultural Resources, and Cave Resources was briefly discussed due to two sites, sensitive plant and goshawk located in project units. These are identified on the Contract Area Map.

Many clauses are incorporated by reference. Full text is available at the websites listed on page 37 of 60. Statement of Equivalent Rates is what the Forest Service would pay our employees. It is not a wage determination. The Contractor must pay employees based on the attached wage determination 1977-0079. Requirement of paying the base rate plus the fringe benefits was discussed.

Tom Burry and Julie Tarvin, COR, discussed the technical requirements in Appendix A, B, and C.

Appendix A – standard specifications for this Forest regarding precommercial thinning and piling of the Green Convertible Biomass.

The specifications in Appendix A address the trees of 4.0 – 6.9” DBH, does not apply to the pole size class. Each description of prescription was discussed for all cutting units.

Average spacing is 20 feet.

The order of preference for the leave trees was also reviewed.

Government inspections for the thinning will be visual and this process was discussed.

In regards to fule treatment, anything less than 4.0” DBH becomes slash and the minimum to be left is Listed in Table A-1 in the middle of page 3 of 4 in Appendix A.

Any slash needs to be piled at the landings and fuel pullback is only required at the landings.

There was some discussion on different techniques for removal of the Green Convertible Biomass within the objectives of the project. Suggestions are encouraged as stated in the Instructions for the Preparation of Technical and Business Proposals. A contractor can submit more than one technical proposal.

Government Inspections for the fuels treatment will also be visual and that process was discussed.

Appendix B and C – Timber Removal Requirements and Road Maintenance Requirements.

The entire Appendix B was reviewed briefly.
Individual Tree Designation table on page 11 of 16 was discussed.
All temp roads have to be approved by the FS prior to construction or use. Contractor shall be responsible for seasonal closures of temp roads as requested by the FS. Upon completion of use all temp roads shall be obliterated which may include scarification, re-contouring, slash scatter and/or placement of barricades as requested by the FS.

There are some fences that will need to be taken down and then replaced prior to permitted livestock entry and these fences are designated on the Contract Area Map.

Some units do not lend themselves to whole tree yarding.
Contractor shall apply seed but the seed will be Government-furnished.
In Appendix C – Road Maintenance Specifications was briefly discussed, along with the tables showing all required maintenance pre-haul, during haul, and post haul.
