The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American Act, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested -

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

L-7 AGAR 452.237-71 Pre-Bid/Pre-Proposal Conference. (FEB 1988)

(a) The Government is planning a pre-bid/pre-proposal conference, during which potential offerors may obtain a better understanding of the work required.

(b) Offerors are encouraged to submit all questions in writing at least five (5) days prior to the conference. Questions will be considered at any time prior to or during the conference; however, offerors will be asked to confirm verbal questions in writing. Subsequent to the conference, an amendment to the solicitation containing an abstract of the questions and answers, and a list of attendees, will be disseminated.

(c) In order to facilitate conference preparations, it is requested that the person named on the Standard Form 33 of this solicitation be contacted and advised of the number of persons who will attend.

(d) The Government assumes no responsibility for any expense incurred by an offeror prior to contract award.

(e) Offerors are cautioned that, notwithstanding any remarks or clarifications given at the conference, all terms and conditions of the solicitation remain unchanged unless they are changed by amendment to the solicitation. If the answers to conference questions, or any solicitation amendment, create ambiguities, it is the responsibility of the offeror to seek clarification prior to submitting an offer.

(f) The conference will be held:

Date: August 28, 2013 Time: 9:00 am PST Location: Prairie City Ranger District Office; 327 SW Front Street; Prairie City, OR 97869 All interested parties at the office by 9:00 am will travel as a group out to the project sites.

L-8 Technical Proposal Instructions General Proposals shall be submitted in two parts: a technical proposal and a price proposal. Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other. The price proposal shall be submitted with the solicitation forms. No breakdown of the unit price is required.

Offerors are cautioned that sufficient and detailed information must be presented in their technical proposals to enable the Government to evaluate their proposals fully in accordance with the evaluation and award criteria contained herein. The Government is not obligated to ask for additional information and in the absence of appropriate information the proposal will be rated deficient.

At a minimum, the proposal must provide adequate information in the form of a brief narrative on each of the evaluation factors that clearly demonstrates the ability to perform the required work satisfactorily. Failure to provide this information may result in a complete rejection of the offer.

Relevant Past Performance: The offeror shall provide specific information about recent and relevant contracts which support Contractor’s performance over the past three years and shall provide references (current names and phone numbers) of people who can confirm Contractor’s past performance. The Experience Questionnaire, (see attachment), may be used as the submittal form. For those contracts with less than positive performance, Contractor is encouraged to provide a description of the problems and any efforts made to correct and to prevent future occurrences. For each relevant contract of reference, the offeror is requested to provide, at a minimum:

Agency/Company and Point of Contact and Phone Number Period of Performance and Dollar Value of Contract Contract Number and Type Brief Description of Work

The offeror may include letters of appreciation and/or previous evaluations for contracts and subcontracts previously completed.

The offeror may provide information on problems encountered on the contracts and subcontracts listed and the corrective actions taken to resolve those problems. The Government may obtain information from existing contract files. Because discussions might not be held, the offeror may refute any problems in the original offer.

The Office of Management and Budget (OMB) has authorized Federal agencies to collect past performance information under OMB clearance number 9000-0142.

Technical Approach: In order to understand Contractor’s capacity to obtain the necessary supplies/equipment and complete the specified work, the offeror shall provide specific information on: 1) how the Contractor will obtain all of the necessary materials, supplies, and equipment to successfully complete the contract and 2) how the Contractor will construct all fence types explaining in depth items such as handling heavy rolls of wire and successfully constructing a high quality and tight fence.

Benefit to the Local Community and Its Workforce: Contractor shall provide information on the Contractor’s (and subcontractor’s if applicable) planned workforce for this project, including each employee’s qualifications and area of residence. Contractors shall describe how the award of this contract will benefit the local communities and their workforce. The local community is defined as Grant and Harney County, Oregon. The Contractor’s local community benefit proposal will become a part of any resultant contract.

SECTION M - Evaluation Factors for Award

M-1 EVALUATIONS

The Government reserves the right to make a single award as a result of this solicitation. Award will be made to that offeror whose proposal is the most advantageous to the Government, relevant past performance, technical approach, benefit to the local community and its workforce, and price considered. All technical evaluation factors are approximately equal to each other in importance. All evaluation factors, other than price, when combined, are approximately equal in importance to price in the award decision. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

The Government is not obligated to request additional information and in the absence of appropriate information. If necessary, the Government may conduct discussions with any or all Contractors.

M-2 TECHNICAL EVALUATION FACTORS

The government will evaluate technical criteria as follows:

Relevant past performance.

Relevant past performance will be evaluated in terms of Contractor’s (and subcontractor’s if applicable) performance on recent fence construction work based on information obtained from references provided by Contractor and other sources. If Contractor has no record of past performance, this technical factor will be rated neutrally.

The Government will consider the relevance of past performance information obtained in relation to the scope of this procurement with respect to similar efforts, the length and scope, number, complexity, and diversity of contracts completed by the firm. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort will be given additional weight in the evaluation process.

Contractors with past performance data will be evaluated in the same manner as all other evaluation factors; however, those Contractors with no past performance data will be treated as an unknown performance risk and neither be evaluated favorably nor unfavorably. Therefore, Contractors will receive credit for good past performance, lose credit for poor past performance, and neither receive nor lose credit for no relevant past performance.

*An excellent rating would be achieved under relevant past performance if, in the last three years, the Contractor (and subcontractor if applicable) has completed at least 2 projects similar to that being solicited in a timely manner, with a pay range of 95-100%, with high customer satisfaction/business relations in fence construction contracts. (Government evaluators will select contract administrators to contact regarding customer satisfaction.)

Technical Approach.

Technical Approach will be evaluated in terms of the Contractor’s understanding and ability to successfully complete the requirements of this project.

*An excellent rating would be achieved under technical approach if the Contractor illustrated an understanding off all requirements, the capability to acquire all supplies, materials, equipment, and other resources necessary, and a reasonable and acceptable plan for successfully building all types of fence required under the resultant contract.

Benefit to the local community and workforce.

The Government will evaluate the methods proposed by each contractor (and subcontractor if applicable) for benefiting the local community and workforce. The evaluation will include a determination as to how realistic and achievable the proposed methods are with added consideration for the impact and magnitude to which the local community will benefit from their operations. Local community for this solicitation means Grant & Harney County being the most important and adjoining counties next.

*An excellent rating would be achieved under benefit to the local community if the Contractor (and subcontractor if applicable) is located in a local, economically disadvantaged rural community and whose workforce participating on the resultant contract will be made up of at least 90% Grant or Harney County, year-around residents.

M-3 AWARD DETERMINATION

A. Award will be made to that offeror (1) whose proposal is technically acceptable and (2) whose technical/cost relationship is the most advantageous to the Government. All evaluation factors other than price, when combined, are approximately equal to price. The critical factor in making any price/technical trade-off is not the spread between the technical ratings but, rather, the significance of that difference. The significance of the spread of ratings will be determined on the basis of what the difference might mean in terms of performance and what it would cost the Government to take advantage of it.

B. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for the successful performance of the work. The Government reserves the right to make price/technical trade-offs that are in the best interest and advantageous to the Government.

C. Award may be made without further discussions. Offers should be submitted initially on the most favorable terms, from a price and technical standpoint, which the Contractor can submit to the Government. The Government may, after evaluation of proposals, conduct further oral or written discussion as appropriate, with all offerors whose proposals are within a competitive range.
