Such a concern is ""not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/ services/contractingopportunities/ sizestandardstopics/.

The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.

(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

(g) If the Contractor does not have representations and certifications in ORCA, or does not have a representation in ORCA for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

"Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American Act--Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American Act should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

L-9 TECHNICAL PROPOSAL INSTRUCTIONS

Proposals shall be submitted in two parts: a technical proposal and a price proposal. Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other. The price proposal shall be submitted with the solicitation forms. No breakdown of the unit price is required.

Offerors are cautioned that sufficient and detailed information must be presented in their technical proposals to enable the Government to evaluate their proposals fully in accordance with the evaluation and award criteria contained herein. The Government is not obligated to ask for additional information and in the absence of appropriate information, the proposal will be rated deficient.

At a minimum, the proposal must provide adequate information in the form of a brief narrative on each of the evaluation factors described in Section M, “Evaluation Factors for Award,” that clearly demonstrates the ability to perform the required work satisfactorily. Failure to provide this information may result in a complete rejection of the offer.

Relevant Past Performance: The offeror shall provide specific information about recent and relevant contracts which support Contractor’s performance over the past three years and shall provide references (current names and phone numbers) of people who can confirm Contractor’s past performance. The Experience Questionnaire, (see attachment), may be used as the submittal form. For those contracts with less than positive performance, Contractor is encouraged to provide a description of the problems and any efforts made to correct and to prevent future occurrences. For each relevant contract of reference, the offeror is requested to provide:

Agency/Company and Point of Contact and Phone Number Period of Performance and Dollar Value of Contract Contract Number and Type Brief Description of Work

•List or schedule of resources (personnel, equipment, and material not provided by the Government) which are planned for use on the project, and how realistic that plan is given concurrent obligations. Identify subcontractors and skilled key personnel. This information may be entered in the Experience Questionnaire (form separately attached).

•Provide a proposed schedule of work and general technical approach to the project, including assumed dates for ordering and receiving materials, coordinating subcontractors, in-stream work restrictions and other project milestones.

Section M—Evaluation Factors for Award

M-1 EVALUATIONS

The Government reserves the right to make a single award as a result of this solicitation. Award will be made to that offeror whose proposal is the most advantageous to the Government, price, relevant past performance, and technical approach and project management considered. Relevant past performance and technical approach and project management are approximately equal in importance to each other. All evaluation factors, other than price, when combined, are approximately equal in importance to price in the award decision. The Government may reject any or all offers if such action is determined to be in the best interest of the Government.

Each offeror’s proposal will be evaluated and assigned a color rating for each factor and sub-factor. Each factor and sub-factor will be given a color rating of blue, green, yellow, or red, as described below for each of the required evaluation areas.

M-2 RATING AND DESCRIPTION:

BLUE (Exceeds) – Contractor has completed a minimum of three construction projects requiring in-water work and stream dewatering. Contractor has demonstrated a positive attitude towards maintaining water quality during in-water work. Contractor performs high quality workmanship, stays on schedule, and complies with all specifications. M-3 TECHNICAL EVALUATION FACTOR

Relevant Past Performance: The offeror will be evaluated on performance over the past three years relative to experience on similar projects and types of work. Past performance sub-factors include experience on projects similar in scope and complexity to the proposed project, efficiency and effectiveness on past projects, whether the firm’s performance conformed to the terms and conditions of their contract, how reasonable and cooperative the firm was during performance, and the firm’s commitment to customer satisfaction. In accordance with FAR 15.305, in the case of an offeror without a record of relevant past performance, the offeror will not be evaluated either favorably or unfavorably in this area, but instead will receive a neutral rating in the area of past performance. Offeror may provide information on any problems encountered on the contracts and subcontracts listed and the corrective action taken to resolve the problems. The Government may obtain information from existing contract files. The offeror may refute any past contractual problems, and should do so in their original offer because discussions might not be held.

Technical Approach and Project Management: The offeror will be evaluated on project management criteria. That criteria is comprised of the offeror’s construction schedules and related implementation (technical approach), project coordination, evidence of understanding the project requirements, how the contractor shall ensure quality of workmanship and materials, plans for communication between the Forest Service and the contractor, and the resources (personnel, equipment, and materials) which are planned for use on the project, and how realistic that plan is given concurrent obligations. The quality and experience of subcontractors and skilled key personnel will be evaluated. Offerors will be evaluated on the reasonableness of the proposed schedule and actual approach to the project.

M-4 EVALUATION OF OPTIONS FAR 52.217-5 (JULY 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.
