C - Description/Specifications/Statement of Work

C-1 – Project Description and Location

Description of Work. Sullivan-Tenmile has three distinct types of work.

ITEM A includes almost 7 miles of new trail through lodgepole and old cutting units. Some areas have heavy brush. Excavation and clearing and grubbing are the main work items. The selected quoter will be required to install appropriate drainage on frequent intervals. Also included in this project are a few short sections of turnpike, culverts, 5 switchbacks.

ITEM B includes the road to trail conversion of over 2 miles of existing road. The road width varies from 6 feet to 24 feet. The 6 foot segment is at the beginning and while there is no minimum size requirement for excavators, bidders are strongly encouraged to visit the site to determine the best piece of equipment. The road is very rocky.

Included in the road to trail conversion are drain dips, turnpike, clearing and grubbing of the road, ditch, pipe installation and some excavator equipment hours. No sign installations shall take place on this item. All signs will be included in ITEM A.

ITEM C includes Seymour Trailhead Improvements including a bulletin board with registration box, accessible path and removal of many of the existing structures at the site. Please see the Seymour Trailhead Site Plan sheet 3 of the drawing for a complete summary of the work.

Project Location and Directions. To get to the project, travel south from Anaconda along the Mill Creek

Highway towards Wisdom. The Mill Creek Highway is about one mile outside of Anaconda on the east side of the town. Call MDT Butte District Office at 494-9600 for current road conditions, ongoing construction along

Mill Creek Road may close the road. Approximately 15 miles from the junction you’ll reach Upper Dry Creek

Road. You’ve gone too far if you reach the interpretive homestead site. Upper Dry Creek Road is at the top of a hill and has a cattleguard. Turn right or west onto Upper Dry Creek Road. Travel along Upper Dry for approximately 2 miles. After 2 miles there is a four-way intersection, take the route to the north (right) and drive as far as you feel comfortable. This road is in rough shape, and a 4X4 high clearance vehicle, or 4-wheeler is necessary to drive the length of the road. The road goes for about 3.5 miles through some meadows, then back in the woods, and finally dips down to the right or east. When the road dips to the east, look for a junction that is signed “no vehicles” and take that road/trail (no motorized vehicles please) for approximately one mile to the beginning of the work. Work begins in a meadow/old clear cut.

As shown on the map, there are many access routes to get close to the trail, but the trail does not intersect with these routes, and cross-country travel will not be permitted as part of this contract. The only available access mid-point for excavators will be the 2492 road. Additional work will be required on this road as an additive bid item to close to motorized vehicles once trail construction in this area is complete. For site visit purposes no motorized travel is currently allowed along this old road.

Site Visit. No formal site visit is planned. Please contact Kendra Bull, 406-683-3962 for more information.

Special Project Time Limitations. No mechanical equipment, blasting, or tree cutting shall occur from May 15th to July 15 th of any year. Work on this project shall begin after September 15 th , 2014 and shall be completed prior to September 1st, 2016.

The majority of this work occurs above 8,000 feet. It is expected that with almost 7 miles of new trail construction, this will be a long project with late start and early season end times. Quote accordingly, no time extensions will be granted for slow progress along the trail. Work window shall span three construction seasons for all items.

Use of Premises and Camping. Contractors are expected to keep a clean camp at all times and adhere to proper food storage. Camping will be allowed in close proximity to the work. Leave No Trace ethics shall be strictly enforced. Visit the Leave No Trace website for more information at http://www.lnt.org/programs/principles.php.

The Contracting Officer’s Representative or Inspector will inspect the Contractor’s camp as part of the final inspection. Bears frequent the area and proper food storage is now required. Food and other attractants must be hung or stored properly in hard sided vehicles, or bear boxes. A complete copy of food storage requirements will be given at the pre-work. This was a new order effective June 1 st , 2014.

Tools and Equipment. All tools and equipment shall be furnished by the contractor. Excavators shall be limited to a maximum 39-inch track width. 2-wheeled motor vehicles are allowed for construction purposes only, such as transportation of employees and materials. 4-wheeled motor vehicles are not allowed except along Road 2492 during construction. Motorized vehicles are not allowed for site visits on Road 2492. When not on site, keep valuable tools hidden from the trail.

Subcontractors. All subcontractors need to be identified by the time of the pre-work, and must be approved prior to the issuance of the Notice to Proceed. Contractors shall bring the SF 1413 to the pre-work conference for each subcontractor.

Submittals. Submittals shall be required for the following items: geotextile, pipe, signs, and posts. See specification 106.03. In addition to these submittals a blasting plan is required for all blasting work. See specification 205.05 for more details.

FAR 52.225-9 Buy American - Construction Materials. (MAY 2014)

(a) Definitions. As used in this clause-

Commercially available off-the-shelf (COTS) item- (1) Means any item of supply (including construction material) that is-

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

Construction material means an article, material, or supply brought to the construction site by the

Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

Cost of components means-

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Domestic construction material means-

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if-

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

Foreign construction material means a construction material other than a domestic construction material.

United States means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference. (1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR

12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph

(b)(2) of this clause if the Government determines that-

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy

American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United

States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material.

However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute or Balance of

Payments Program.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Foreign and Domestic Construction Materials Price Comparison

Construction material description Unit of Quantity Price measure (dollars)* Item 1:

Foreign construction material ________ ________ ________

Domestic construction material ________ ________ ________

Item 2:

Foreign construction material ________ ________ ________

Domestic construction material ________ ________ ________

* Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued).

List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.

Include other applicable supporting information.

FAR 52.228-13 Alternative Payment Protections. (JUL 2000)

(a) The Contractor shall submit one of the following payment protections:

Payment Bond

Irrevocable Letter of Credit

Certified or Cashier’s Check, Bank Drafts, Money Orders or Currency
