Newsome Creek Reach 2 Special Provisions

Project Overview This project, referred to as the Newsome Creek Reach 2 Stream Habitat Improvement Project, is located on Newsome Creek in Idaho County, Idaho upstream of the Newsome Town Site, approximately 10 miles northwest of Elk City, Idaho. Refer to the Drawings in Appendix B (Sheet CS) for an illustration of the overall project vicinity. Access to the site is from Idaho State Highway 14 to Newsome Creek Road 1858 which passes through Newsome Townsite. Beyond Newsome Townsite, past MP 7 of Road 1858, a 0.9-mile long primitive access route to the right provides access to the project.

Newsome Creek Reach 2 has been diverted out of its historic channel as a result of past mining operations, negatively impacting the existing floodplain and riparian environment. The purpose of this project is to improve channel morphology and stream function utilizing as much of the restored valley bottom and floodplain as feasible and to increase fish habitat primarily through the use of stream habitat features (pools, riffles, glides, etc.) and large woody debris.

In general, the project consists of the following components: development and decommissioning of an access route; earthwork operations for construction of channel diversion structures, constructed channel segments, off-channel habitat, and floodplain swales; sod harvest, replant, and storage; construction of habitat structures; addition of floodplain roughness, logs, and slash; and coordination with the Forest Service Contracting Officer (Government) or their representative for dewatering and fish salvage, revegetation, and adherence to various site controls.

General Work Description Contractor assumes full and sole responsibility for the capability of selected construction techniques to complete the Work specified herein. Contractor also assumes full and sole responsibility for safety and environmental protection with the selected construction techniques. Submittal review by Government in no way relieves Contractor of these responsibilities.

Acceptance of the Work will be made when the Work is completed and will be determined by the Government through a work area inspection. Work acceptance will be based on adherence to the Work specifications stated herein.

Revegetation, aside from clump planting, harvested sod, and plants integral to Brush Fascine (BF) treatments (see Bid Item 12), will be completed under a separate contract in a subsequent year.

Contractor shall provide all labor, tools, equipment, materials, and incidentals necessary to complete the Work as specified herein.

Permits:

Government shall be responsible for all stream construction-related permits and will provide copies of all relevant information prior to the start of construction.

Facilities:

Contractor shall provide all necessary mobile office and sanitation facilities for Contractor’s operations. Contractor shall locate facilities at the Site and as approved by Government.

Endangered Fish Species:

If a listed fish is found in imminent peril of death or harm, such as finding a live fish out of water in a drying pool, the Contractor shall take immediate steps to rescue the fish by transferring it to flowing water or other safe location, even if those efforts may accidentally kill the fish. If possible, or without further jeopardizing the fish, the Contractor should photograph the affected fish before moving it, and note the number, size, and location of fish rescued or killed. The finder must notify the CO as soon as possible.

If the Contractor encounters a steelhead that is sick, injured, or killed as a result of project-related activities, and if the fish would not benefit from rescue, the Contractor should leave the fish alone, make note of any circumstances likely causing the death or injury, location and number of fish involved, and take photographs, if possible. If the fish in question appears capable of recovering if rescued, photograph the fish (if possible), transport the fish to a suitable location, and record the information described above. Adult fish should generally not be disturbed unless circumstances arise where an adult fish has obviously been mortally injured or killed by project activities or some unnatural cause. The Contractor must contact the CO as soon as possible. The Contractor may be asked to carry out instructions provided by Law enforcement to collect specimens or take other measures to ensure that evidence intrinsic to the specimen is preserved.

Fish passage through the project area will be maintained at all times.

If Forest Service redd surveys locate steelhead, Chinook, or bull trout redds, at crossings on the designated access route, the Contractor will, under the direction of the CO, construct a temporary or alternate access at the site. If the above situation arises, a request for an equitable adjustment to contract price and the delivery deadline may be submitted to the CO for consideration.

Quality Control and Quality Assurance Quality control to assure that construction complies with the requirements of the Project Drawings and Special Provisions is the responsibility of Contractor. Quality assurance is the responsibility of Government. Government will perform quality assurance in the form of construction oversight and additional testing, as necessary, to ensure that the Work performed by Contractor meets all applicable requirements.

Specific Contractor quality control testing, sampling, and analysis requirements, if applicable, are described for each Bid Item in the Work Description paragraph of these Special Provisions. Contractor shall be responsible for overall construction quality management. All submittals shall be reviewed and approved by Government in accordance with the Submittals Section 7.0 of these Special Provisions.

Construction grade tolerances shall be as specified below, unless noted otherwise in the Plans. Final grade for the floodplain surfaces shall be plus or minus 0.5 feet to allow for roughness and preservation of high-value vegetation as stated herein. Final elevations shall be plus or minus 0.2 feet for all stream channel construction, and in-stream or streambank structures. Structure locations noted on the plans are approximate and can be field-fitted to accommodate existing mature vegetation and site conditions as approved by Government. It is Contractor’s responsibility to construct to the established tolerances. Work resulting in grades and alignments not within the specified tolerances will be rejected. Contractor shall remove the rejected or defective Work and complete the Work to the specified requirements or tolerances at Contractor’s expense.

General Measurement and Payment The total price for each Bid Item shall cover all Work shown on the Drawings and described herein. All costs in connection with the Work include: furnishing all materials, equipment, supplies, and appurtenances; providing all construction equipment, tools, and incidentals; and performing all necessary labor and supervision to fully complete the Work, all of which shall be included in the unit and lump sum bid prices listed on the Bid Form. No item that is required by the Contract Documents for the proper and successful Work completion will be paid for outside or in addition to the prices submitted in the Bid.

Estimated Quantities:

All estimated quantities provided on the Bid Form (Table 1) are approximate and are to be used only as a basis for estimating the probable cost of Work and for the purpose of comparing the Bids submitted for the Work. The actual quantity of Work performed may differ from the estimated quantities. The measurement method for determining final payment for each Bid Item will be by the Actual, Design, or Lump Sum Quantities, as described below and as shown on the Bid Form. Contractor will make no claim for damages, cost of materials, anticipated profits, or otherwise on account of any difference between the amount of Work actually performed and the estimated amount herein, unless disputing a Design Quantity Bid Item (see below).

Design Quantities denote the final number of units to be paid for under the terms of the Contract. They are based upon the original design data available prior to the project’s advertisement. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the Contract. Changes in the number of units DESIGNATED ON THE BID FORM may be authorized under any of the following conditions:

1. Changes in the Work authorized by the Government.

1. A determination by the Government that errors exist in the original design that cause a Bid Item quantity to change by 15 percent or more.

1. A written request by the Contractor submitted to the Government showing evidence of errors in the original design that cause the Bid Item quantity to change by 15 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is in error.

Actual Quantities are determined from measurements of completed work. Measurement will be made by the Government and/or authorized representative.

Lump Sum Quantities denote one complete unit of work as required by or described in the Contract, including necessary materials, equipment, and labor to complete the job. Lump Sum Bid Items based upon estimated quantities are not subject to adjustment for actual quantities. The lump sum price reflects a reasonable compromise of the Government and Contractor’s risk that the actual material quantity may be higher or lower than the estimate.

All estimated quantities designated as cubic yard (CY) shall be considered “bank” CY unless otherwise noted. An excavated “bank” CY is the quantity of material removed as measured in its original position. A placed “bank” CY is the quantity of material as measured in its final resting position.

Incidentals Unless otherwise provided, Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provision of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered incidental to and included in the payment for the items shown.

Three known incidentals to the Work are described as follows.

Provide Water:

Contractor shall obtain and apply water for dust control at the Site, moisture conditioning for compaction during filling operations, to water brush fascines, to keep harvested sod and wetland sod damp as required, and to water surfaces prior to sod installation. Water can be pumped from Newsome Creek with an appropriate pump.

If a pump is used, Contractor shall provide a pump with a screened inlet for pumping water from the river. Pump water inlet must have a 3/32-inch mesh screen or other Government-approved device to prevent fish entrainment or impingement.

Floodplain Roughness:

All disturbed or constructed floodplain surfaces shall be left in a roughened condition upon completion of the Work. This treatment creates areas to trap seed, water, and organic matter for new plant growth.

Floodplain roughness shall be incidental to the Work described herein and no additional payment shall be made.

Slash and Logs:

Slash and logs, when laid on the ground surface, create roughness, provide shelter and organic matter for reestablishing plants, and help deter future use of access routes. Slash and logs shall be used on disturbed areas, channel fill areas, decompacted access routes, and around and on channel diversion structures.

Large logs found on the Site will be used to build Brush Fascines (Bid Item 12) and Large Wood Structures (Bid Items 13-15) and will be placed throughout the floodplain in accordance with Bid Item 16. In addition to these specific Work items, slash and logs will be used to provide roughness in areas that are disturbed or that require additional protection from erosion. Suitable slash and logs for this purpose are defined as any woody material including dead woody vegetation and miscellaneous vegetative material such as logs, stumps, brush, roots, branches, and dead bushes. Slash and logs currently cover the existing floodplain surface at the Site. Slash and logs shall be obtained through specified Work that requires moving these materials out of the Work area including but not limited to: Floodplain Temporary Access Routes (Bid Item 5), Constructed Channel (Bid Item 9), and Off-Channel Habitat (Bid Item 11). Contractor shall place slash and logs at the spacing and densities described herein.

Contractor shall place slash and logs on those areas disturbed by heavy equipment, the decompacted Floodplain Temporary Access Routes (Bid Item 5), on and around Channel Diversion Structures (Bid Item 8) and in Fill Areas (Bid Item 10). Slash and logs are incidental to each of these respective Bid Items and any other Bid Items that require slash and logs to cover disturbed areas.

Work Description, Measurement, and Payment The Work, measurement methods, and payment methods for each Bid Item are discussed below. The Drawings, in their entirety, are applicable to the Work. All materials shall be approved by the Government prior to their use by the Contractor. Contractor shall perform the Work described in this section. A list of materials to be generated and used on this project is shown in Table 2.

Materials staging within the Site must not impact the riparian environment or interfere with other Work. Staging areas must be approved by the Government.

All materials shall be approved by the Government prior to their use.

The government does not endorse any of these specific products and urges contractors to perform independent research regarding the performance characteristics of each product.

Site security and public safety shall be the responsibility of Contractor. Contractor shall limit public access to the Site during construction. At a minimum, this includes ensuring the locked gate at the entrance to the project access road is maintained.

Turbidity:

All state and local water quality regulations will be met. The contractor will limit turbidity by strategic location of equipment, for example by working from stream banks with stable banks, rather than instream. Excavation equipment will avoid working on undercut banks. Damage to riparian areas will be avoided. State of Idaho (IDAPA 58.01.02 page 148(e)) Department of Environmental Quality turbidity criterion for water quality standards are as follows: Turbidity, below any applicable mixing zone set by the Department, shall not exceed background turbidity by more than (50) NTU instantaneously or more than twenty-five (25) NTU for more than (10) consecutive days and/or for up to 3 continuous hours. When/If (50) NTUs above background levels are detected, the contractor will cease instream work. Activities will be allowed to proceed once the readings return to background levels or (10) NTUs.

Stormwater Controls:

Contractor shall submit to Government a completed Stormwater Pollution Prevention Plan (SWPPP) based on Government-provided template (see SWPPP template in Appendix A). Additional data required includes, at a minimum, names and contact information for project personnel, list of subcontractors, and project schedule and sequence.

Contractor shall maintain on Site at all times adequate numbers of certified weed-free biodegradable straw wattles or certified weed-free straw bales to provide sediment control for all exposed surfaces in the event of rainfall in accordance with the SWPPP. Contractor shall be responsible for adhering to all conditions stipulated in the SWPPP including installation, maintenance, and removal (if not permanent) Best Management Practices (BMPs) for stormwater control in the event that precipitation is predicted or expected during the project Work window. Contractor shall have a supply of basic erosion control materials on site before work begins. Such materials include but are not limited to water pumps and weed free straw bales, Contractor shall document, provide, install, and maintain all necessary BMPs that will be used during construction activities for erosion control and stormwater management purposes. All BMPs installed by Contractor shall meet the applicable requirements of the Drawings, Special Provisions, and permits. Depending on actual Site conditions encountered during construction, additional BMPs may be necessary to adequately complete the Work.

Turbidity monitoring including personnel and equipment will be provided by the Contracting Officer.

If turbidity levels exceed 50 NTUs over background levels 600 feet downstream of the point of discharge, the Contractor must stop work and take measures to reduce turbidity before continuing.

Contractor shall install any additional BMPs at Government’s discretion and in accordance with the guidance documents listed below:

Idaho Department of Environmental Quality, Catalog of Stormwater Best Management Practices for Idaho Cities and Counties, September 2005.

U.S. Environmental Protection Agency (USEPA), Storm Water Management for Construction Activities; Developing Pollution Prevention Plans and Best Management Practices, October 1992.

Payment:

Payment for Bid Item 1 – Mobilization and Demobilization will be based on the lump sum price bid as shown on the Bid Form. Fifty percent (50%) payment for this Bid Item will be allowed once Contractor fully mobilizes to the Site and obtains approval on all submittals required before starting construction. Full payment for this item will be allowed once Contractor completes the specified Work and fully demobilizes equipment and materials from the Site. The lump sum bid price for this item must not exceed ten percent (10%) of the total bid price.

Bid Item 2 – Construction Staking Contractor shall provide all construction staking of project features including, but not limited to: constructed channel alignment (Bid Item 9), swale perimeter (Bid Item 11), side channel alignment (Bid Item 11), brush fascine limits (Bid Item 12), flow deflecting habitat structure locations (Bid Item 13), channel-spanning key structure locations (Bid Item 14), and foot trail location (Bid Item 18). Conduct all construction staking under the direction of a licensed professional engineer or land surveyor who is closely associated and familiar with construction staking. Government will provide electronic files in XML format containing design features and control point locations.

Measurement:

No measurement for Bid Item 2 – Construction Staking will be made.

Payment:

Payment for Bid Item 2 – Construction Staking will be by the lump sum price bid as shown on the Bid Form of the Contract Documents.

Bid Item 3 – Water Management Description:

This Bid Item describes the Work required to provide and install channel dewatering systems and provide water control and dewatering for construction. Water management is needed to dewater portions of the existing Newsome Creek channel to build a Channel Diversion Structure (Bid Item 8) and fill the old creek channel (Bid Item 10) and to ensure turbidity standards are met as described in Bid Item 1– Mobilization.

Only one creek segment shall be dewatered at any one time. Contractor shall notify Government two (2) business days before starting any dewatering operation. Coordination of this Work with the Government will be necessary as the Government conducts fish salvage operations in the dewatered river section. Fish salvage may cause delay of in-stream work by up to three (3) calendar days per creek segment. Work outside the active stream channel can continue during in-stream delay. Government will install fish isolation features as appropriate upstream and downstream of dewatering area before dewatering begins.

Contractor shall submit to Government its Water Management Plan in accordance with the Submittals Section 7.0 of these Special Provisions. Water management shall be executed in accordance with the Water Management Plan and as described below.

Materials:

Contractor shall provide all labor, equipment, tools, materials, and incidentals necessary to complete the Work as specified.

Contractor shall provide a coffer dam, water control device(s), and pumps as needed for water reduction and water adjustment during fish salvage operations.

Contractor shall provide pump(s) capable of completing the Work described herein. Pump water inlet must have a 3/32-inch mesh screen or other Government-approved device to prevent fish entrainment or impingement.

Execution:

Work includes, at a minimum:

Contractor shall provide water control devices capable of an estimated flow rate of 0 to 40 cubic feet per second (cfs) based on historical flow records. Actual flow rate in the existing creek shall be verified prior to the start of the work and water control devices sized accordingly at no additional cost to the Government.

Contractor shall implement a water control device(s) and reduce or increase flow in the existing channel as requested by Government and in accordance with the procedure outlined below.

Contractor shall coordinate and work closely with Government to provide dewatering and rewatering as requested as they conduct fish salvage in the dewatered reach and to control water and sediment flowing in the constructed channel.

Contractor shall receive from Government approval of all constructed project features in the design channel alignment prior to diverting water into that reach of the design channel alignment.

Introduction of water into newly constructed channel shall be conducted according to the following procedure:

1. Contractor shall pre-wash the newly excavated channel before re-watering. Turbid wash water will be detained and pumped to the floodplain or into a reach equipped with sediment capture devices such as a Sedimat®, rather than discharging to fish-bearing waters.

2. Starting in the early morning, introduce 1/3 of the flow into the new channel over a period of 1-2 hours. If turbidity is approaching 50 NTU, modify the activity to reduce turbidity. In this case, this might mean decreasing the amount of flow entering the new channel and/or correcting any other issues that are causing turbidity (for example – correct a bank that is sloughing, install or correct a BMP, etc.)

3. Contractor shall coordinate with Government on turbidity monitoring.

4. Once turbidity meets the standard, move on to the next watering stage.

5. Prepare to introduce the second 1/3 of the flow (up to a total of 66%) to the new channel by installing seine at upstream end of old channel in order to prevent fish from moving into a partially dewatered channel. Introduce the second 1/3 of the flow over the next 1-2 hours.

6. Government will salvage fish from the old channel at this time, so that the old channel is fish-free before dropping below 1/3 of the flow. (Note that fish will be temporarily blocked from moving downstream into either channel until 2/3 of the flow has been transitioned to the new channel. This blockage to downstream fish passage is expected to persist for roughly 12 to 14 hours, but fish will still be able to volitionally move out of the channel in the downstream direction.)

7. After the second 1/3 of flow is introduced over 2 hours, and if turbidity criteria are met, Government will remove seine nets from the new channel and allow fish to move downstream into that channel. Introduce the final 1/3 of flow. Once 100% of the flow is in the new channel, Government will pull nets from old channel.

8. Contractor can now proceed with required Work in the old (Existing) channel.

Contractor shall coordinate this Bid Item with Bid Item 8 – Channel Diversion Structure and Bid Item 10 – Fill Areas.

Measurement:

No measurement for Bid Item 3 – Water Management will be made.

Payment:

Payment for Bid Item 3 – Water Management will be by the lump sum price bid as shown on the Bid Form of the Contract Documents.

Bid Items 4 & 5 – Construction Access This general category of work is separated into Bid Item 4 – Construction Access Route and Bid Item 5 – Floodplain Temporary Access Routes.

Contractor shall provide an Access Improvement Plan, which describes how the project access routes will be improved, maintained, and decommissioned throughout the performance period to provide for construction equipment transportation and crew/fuel access. Include measures that will be taken to mitigate, minimize or eliminate the introduction of sediment into the stream system and other detrimental effects of equipment/personnel accessing the project area. Describe the manner and methods in which the project area will be accessed throughout the period of performance including methods and locations for Temporary River Crossing Structures. Include a description of the types of equipment to be used for crew/fuel transport and measures planned to cross Newsome Creek as needed to complete the Work Bid Item 4 – Construction Access Route Description:

A primitive access route off NF-1858 (Newsome Creek Road) leads to the Site as shown on the Drawings (Sheet C2).
