About this file

This is a Questions and Answers document for NASA's Announcement for Proposals (AFP) regarding Enhanced Use Leases for Exploration Park Parcels 3 and 4 at Kennedy Space Center. The solicitation was open for question submissions between September 4, 2026, and September 25, 2026, with proposals due November 6, 2026, by 5:00 pm ET. Proposal evaluations will begin the week of November 9, 2026, and typically take 1-3 months to complete.

Key lease terms clarified include: Title pages and tables of contents are excluded from the 30-page proposal limit; the two parcels may be leased together or separately under one or multiple lease instruments; each parcel can be subdivided for partial leasing depending on the situation; and desired lease terms should be included in proposals as NASA will not negotiate lease provisions post-selection. NASA will select an independent appraiser via NASA contract and pay for the appraisal at mandatory re-appraisal intervals; any base rent adjustments will be forward-looking only with no retroactive refunds. The NASA appraisal for term extensions will be based on unimproved ground lease value, excluding tenant improvements. Support Amounts and Support Services are separate from environmental due diligence provided via Reimbursable Space Act Agreements (RSAA). Diversification criteria for KSC's user base include new capabilities, mission types, customers, or complementary uses. Sustainable design principles are encouraged to the extent commercially reasonable. This is a new Enhanced Use Lease opportunity with no incumbent recompete. Environmental due diligence includes Phase I Environmental Site Assessments, with potential PFAS contamination noted in groundwater and surface water near both parcels requiring interim land use controls and possible additional NEPA analysis prior to lease execution.

AFP-KSC-ExParkParcels3and4-2026 Questions and NASA Answers

Introduction NASA received the following questions regarding the Announcement for Proposals for Exploration Park Parcels 3 and 4 at Kennedy Space Center between September 4, 2026, and September 25, 2026. NASA’s responded as follows:

1. "Proposals are limited to thirty (30) total pages." Are any pages (e.g., Title page, Table of Contents) excluded from the page count?Response:

Confirming, those items are excluded from the page count, as is typical.

2. "Land adjacent to Space Commerce Way (SCW) in Exploration Park at Kennedy Space Center." What previous tenants or owners have occupied this land, and what use cases have they used on the land, including a description of products, services, processes, materials, inputs, and hazards or pollutants have been provided or used on the land, and what documentation does NASA hold of each?

3. "Site Preparation - " Is the site currently subject to any active permits, uses, environmental and/or NEPA classification or actions, and/or any other land use, environmental, or other agreements, restrictions, covenants, or other legal obligations or entitlements? Please provide documentation of same.

Response to Q’s 2 and 3 above:

National Environmental Policy Act (NEPA) As stated in the Announcement for Proposals (AFP), existing National Environmental Policy Act (NEPA) documentation, Space Commerce District Environmental Assessment, related to these parcels can be found at:

https://netspublic.grc.nasa.gov/EA_EIS_Documents.cfm?key=KSC.

The selectee may be required to conduct additional NEPA analysis and prepare additional NEPA documentation based on the selectee’s proposed site use and activities. The additional NEPA analysis and documentation must be completed prior to the execution of the lease agreement.

The Space Commerce District Environmental Assessment also contains environmental information about the parcels.

Existing Environmental Permits There are existing permitted stormwater management systems adjacent to the parcels. Information about these permits can be found on the St. Johns River Water Management District website. The permit numbers are 16508, 67717, 23969, 24159, 128795, and 143199.

https://netspublic.grc.nasa.gov/EA_EIS_Documents.cfm?key=KSC

NASA operates a permitted borrow pit adjacent to Parcel 4. Information about this permit can be found on the St. Johns River Water Management District website. The permit number is 16858.

As stated in the model agreement in the AFP, NASA holds a Resource Conservation and Recovery Act (RCRA) hazardous waste operating permit for KSC. As such, all KSC property, including property leased to tenants, is subject to the hazardous material cleanup and remediation provisions under the permit, RCRA Corrective Action regulations, and State of Florida cleanup regulations (e.g., Florida Administrative Code Chapters 62-777 and 62-780). The permit can be found on the Florida Department of Environmental Protection (FDEP) website.

Environmental Condition Information As stated in the AFP, prior to the execution of the lease agreement, the selectee will be required to execute a Reimbursable Space Act Agreement (RSAA) to have NASA perform environmental due diligence for the parcels and prepare a Phase I Environmental Site Assessment. The Phase I Environmental Site Assessment will be incorporated into the lease agreement. The selectee may also choose to sample environmental media (soil, groundwater, etc.) at the parcels for contaminants as part of the environmental due diligence process.

Solid Waste Management Unit (SWMU) or Potential Release Location (PRL) designations are assigned to sites being assessed and/or remediated under the NASA KSC RCRA hazardous waste operating permit. A SWMU or PRL designation means a site has had historical operations which may have potentially impacted the environment.

Parcel 3 There are four active SWMUs and PRLs immediately adjacent to Parcel 3 and these site boundaries may extend into Parcel 3. These sites are SWMU #010 (GSA Reclamation Yard), SWMU #021 (Ransom Road Sandblast Area), SWMU #036 (GSA Reclamation Yard West), and PRL #237 (Center-wide Per- and Polyfluoroalkyl Substances).

NASA KSC has conducted limited groundwater and surface water sampling near Parcel 3 in the process of investigating releases of per- and polyfluoroalkyl substances (PFAS) under PRL #237. PFAS have been detected in groundwater and surface water immediately north of Parcel 3. Perfluorooctanesulfonic acid (PFOS), perfluorooctanoic acid (PFOA), and perfluorohexanesulfonic acid (PFHxS) were detected in groundwater above the current (November 2024) U.S. Environmental Protection Agency Regional Screening Level (RSL) for Tap Water. PFOS and PFOA were also detected in groundwater above the current (March 2022) State of Florida provisional Groundwater Cleanup Target Level (pGCTL). PFOS was detected in surface water above the current (March 2022) State of Florida provisional Surface

Water Screening Level (pSWSL) based on human health. Sampling results can be found in the September 2025 Site Assessment Report (https://ntrs.nasa.gov/api/citations/20250008632/downloads/NASA_KSC_GSRY_PF AS%20SAR_Final1_r0_sealed.pdf). While no PFAS groundwater sampling has been conducted within the Parcel 3 boundary, there is a potential that levels of one or more PFAS in groundwater could exceed the RSL at Parcel 3 based on the proximity and magnitude of PFAS detections to the north.

The four active SWMUs and PRLs have land use controls (LUCs) as follows:

• SWMU #010: LUCs are in place to prevent groundwater use, prohibit residential use of the property, and restrict access to contaminated soil. The LUC areas are outside of Parcel 3.

• SWMU #021: LUCs are in place to prohibit residential use of the property and restrict access to contaminated soil. The LUC areas are outside of Parcel 3.

• SWMU #036: LUCs are in place to prohibit residential use of the property and restrict access to contaminated soil. The LUC area overlaps a portion of Parcel 3 in the northwest corner.

• PRL #237: While federal and state PFAS regulations are in development, NASA has implemented interim LUCs that are applicable to the north side of Parcel 3. The LUC area is subject to change based on changes to federal and/or state regulations and NASA’s future investigation of this PRL. The current interim LUCs include hazard communication to site workers about the potential presence of contamination in groundwater and surface water and special requirements when conducting borings, horizontal directional drilling, and/or dewatering.

There is one closed PRL, PRL #153 (Property Disposal Office M6-1723), adjacent to the northeast corner of Parcel 3. Thirteen tons of contaminated soil were excavated and properly disposed of offsite. The FDEP issued a No Further Action letter to NASA for the site on July 15, 2010.

There is one closed PRL, PRL #173 (Area 1 Write-Off Sites), within the boundary of Parcel 3.

There was one building, Facility M6-2021, in the northwest corner of the intersection of Space Commerce Way and Kennedy Parkway South. Facility M6-2021 was initially a private residence and was later converted into an office building. There were also seven temporary trailers at the site. These facilities were demolished in the mid-1960s. Based on past activities at this location, NASA and the regulatory agencies determined that further investigations were not warranted. The FDEP issued a No Further Action letter to NASA for the site on December 16, 2008.

Parcel 4 https://ntrs.nasa.gov/api/citations/20250008632/downloads/NASA_KSC_GSRY_PFAS%20SAR_Final1_r0_sealed.pdf https://ntrs.nasa.gov/api/citations/20250008632/downloads/NASA_KSC_GSRY_PFAS%20SAR_Final1_r0_sealed.pdf

There is one active PRL, PRL #237 (Center-wide Per- and Polyfluoroalkyl Substances), immediately adjacent to Parcel 4. NASA KSC has conducted sampling of groundwater and surface water near Parcel 4 in the process of investigating releases of PFAS. PFAS has been detected in groundwater along Jerome Road west of Kennedy Parkway South and to the south of Parcel 4. PFOS was detected above the current (November 2024) U.S. Environmental Protection Agency Regional Screening Level (RSL) for Tap Water. While no PFAS groundwater sampling has been conducted within the Parcel 4 boundary, there is a potential that levels of one or more PFAS in groundwater could exceed the RSL at Parcel 4 based on the proximity and magnitude of PFAS detections to the south. Surface water samples collected from the ditch immediately south of Parcel 4 were analyzed for PFAS. PFOS was detected above the current (March 2022) Florida provisional Surface Water Screening Level. While federal and state PFAS regulations are in development, NASA has implemented interim LUCs that are applicable to the south side of Parcel 4. The current interim LUCs include hazard communication to site workers about the potential presence of contamination in groundwater and surface water and special requirements when conducting borings, horizontal directional drilling, and/or dewatering. The LUC area is subject to change based on changes to federal and/or state regulations and NASA’s future investigation of this PRL.

There is one closed SWMU, SWMU #097 (Agricultural Sheds), within the boundary of Parcel 4. This SWMU consists of 11 agricultural sheds, pole barns, and buildings used to support former citrus grove operations in the area. Investigations and corrective actions were limited to these facilities and their surrounding areas and did not extend into the adjacent citrus grove areas. Contamination was detected in soil and the contaminated soil was excavated and properly disposed of offsite. The FDEP issued a No Further Action letter to NASA for the site on August 20, 2019.

4. "The Property can be leased in whole or in part." Are the two parcels necessarily subject to the same lease instrument, or may they be subject to multiple separate leases? The preference would be one lease.

Response:

They may be leased together or separately depending on the situation.

5. "The Property can be leased in whole or in part." Is the acreage of each parcel subject to subdivision for partial leasing, or does the entirety of one parcel need to be leased?

Each parcel can be subdivided depending on the situation.

6. "Diversify the user base and operations at KSC." What criteria determine diversification of the user base at KSC?

Response:

The diversification of KSC’s user base provides NASA Programs with greater options to meet Administration priorities. NASA may consider how a proposed use contributes to the diversity of KSC’s overall user base, including whether it brings new capabilities, mission types, customers, or other uses to the Center and complements existing activities.

7. "Mandatory re-appraisal of the Base Rent." How is an appraiser selected for this process, and how is payment to the appraiser determined?

Response:

NASA selects the independent appraiser via a NASA contract and NASA pays for the NASA appraisal. Lessee would be welcomed to conduct their own separate appraisal at that time.

8. "Mandatory re-appraisal of the Base Rent." If a re-appraisal determines that rent escalations have exceeded Fair Market Value, will Base Rent decrease, and is the Lessee entitled to a refund of previously overcharged rent?

Response:

No. The appraisal is forward looking only and the base rent going forward would be adjusted appropriately.

9. Section 5.2(C)(iv)(a) of the Model Lease describes sustainable design requirements.

What is the process for getting this process changed or waived?

Response:

Environmental Stewardship. Tenant is encouraged to participate in recycling, energy conservation and water conservation programs. Tenant is encouraged to apply, to the extent commercially reasonable, sustainable design principles to the design and construction of any Improvements and any alterations and/or modifications to the Property.

10. Section 2.2(C) of the Model Lease provides that NASA can reappraise the property in the event of a term extension. Would this reappraisal exclude the value of improvements Tenant has made to the land during the initial term?

The NASA appraisal would be based on the unimproved value of the ground lease.

11. "During the Question-and-Answer (Q&A) Period, proposers may request alternate base or renewal terms based on their business model for NASA's consideration if the NASA-proposed term is insufficient."

Response:

Desired lease terms should be part of company proposals. Per the AFP: ‘Upon selecting a potential proposal, NASA will send the potential selectee a draft lease in the form attached as the Model Lease and with blanks completed and exhibits finalized by NASA in reference to the particulars identified in the proposal...'

12. "Support Amount (defined in the Model Lease) for the Support Services." Are these Support Amounts and Support Services separate from what is provided via RSAA?

It is separate as mentioned in Article 3 of the Model Lease. See Article 3.1(B)(ii).

13. "The Proposer must notify NASA in writing of such Proposer-required modifications to the Model Lease during the Question-and-Answer Period (defined herein)."

Response:

14. Per the AFP: ‘If there is a particular reason the Proposer is not able or willing to agree to any of the provisions of the Model Lease, the Proposer must notify NASA in writing of such Proposer-required modifications to the Model Lease during the Question-and- Answer Period (defined herein). Each Proposer-required modification will be assessed by NASA to determine if NASA is willing to accommodate the required modifications.

NASA may choose to accept the required modifications, may choose to reach out to Proposer to discuss the required modifications further, or may choose to reject the required modifications, and will so notify Proposer. Proposers shall reference the Model Lease and provide an acknowledgement of those terms and conditions as part of their proposals.’ NASA will not negotiate the terms of the Model EUL post-selection. If Proposer desires any changes to the terms and conditions of the Model Lease, those must be requested during the Question-and-Answer period.

15. Is there any incumbent/recompete or is this a brand-new project? If yes, could you please provide us with their award number or even if the customer bought similar services in the past.

This is a new Enhanced Use Lease opportunity.

16. What is the expected review period for responses to AFP-KSC-ExParkParcels3and4- 2026?

Response:

• September 4, 2026 – September 25, 2026 – Question Submittals

• November 6, 2026, NLT 5:00 pm ET – Proposals Due

• Proposal evaluations will begin the week of November 9, 2026, and typically take 1-3 months to complete, depending on numerous factors which can impact the schedule.
