About this file
The document is an Affirmation and Disclosure Form designed to ensure compliance with Executive Orders regarding offshore services and data location. The form requires contractors to disclose the principal business location, service performance locations, and data storage locations for both the primary contractor and any subcontractors. Contractors must explicitly affirm that they understand prohibitions on performing offshore services, locating state data offshore, or purchasing from Russian institutions or companies.
The form mandates ongoing transparency, with contractors required to immediately notify the state of any changes in service or data locations before, during, and after contract execution. The state retains the right to terminate the contract if services are performed outside the United States without a signed waiver. The document is a standard two-page form (Rev. 3/22) that must be signed by an authorized contractor representative, including their printed name, title, and the date of execution, and is intended to be incorporated as part of any potential state contract.
