About this file

This is an Addendum to FAR Clause 52.212-2 (Evaluation of Offers - Commercial Items) for a federal procurement. The addendum modifies standard commercial item evaluation procedures as incorporated into the Request for Quotation (RFQ) solicitation number 15A00026Q00000093 issued by the Department of Justice Bureau of Alcohol Tobacco Firearms and Explosives. The addendum provides supplemental terms and conditions that apply to the evaluation of vendor proposals in addition to the base clause language referenced in the solicitation.

The RFQ seeks preventative maintenance and support services for Leica microscope cleaning across three laboratory facilities: FSL W, FSL A, and NFEA Beltsville. This is a 100% small business set-aside procurement with an estimated period of performance from September 30, 2026 through September 29, 2031, resulting in up to two firm fixed price contracts. Questions must be submitted to Steven Jaimes at steven.jaimes@atf.gov by 1000 EST on September 8, 2026, and all quotes must be received by the date specified in Block 8 of the SF1449 form. The NAICS code is 811210, and additional procurement details including contract line item numbers, quantities, and evaluation criteria are contained in the Statement of Work and SF1449 form.

Addendum to FAR 52.212-2 Evaluation—Commercial Products and Commercial Services.

(a) The Government will award a contract for each location to the offeror/s with the lowest evaluated price whose quote meets or exceeds all minimum technical requirements of the RFQ.

Factor 1, Eligibility: Technical Acceptability- The Offeror/s shall demonstrate its ability to provide all the requirements addressed in the SOW by submitting a technical quote for each location listed in the SOW (one quote for FSL-W & one quote for NFEA Beltsville with FSL-A), for which it wishes to be considered, that clearly describes how they will meet it. Offerors do not have to submit a quote for each location; however, offerors shall clearly address if they are not submitting a quote for each location for which it chooses not to submit a quote. Submitting only a pricing quote will be considered technically unacceptable and remove the offer from award consideration. If a subcontractor is proposed, Offeror shall provide details of its subcontractor (location and point of contact) as well as the subcontractor’s ability to demonstrate its ability to meet the services addressed in the SOW.

For evaluation and awarding purposes, to be considered technically acceptable, an offeror must quote all requirements identified in the SOW for each location the offeror chooses to quote. Partial quotes (those quotes not quoting all requirements for each location quoted) will not be considered unacceptable and will not be reviewed. Only quotes quoting all requirements for each location quoted will be reviewed. Only the Offerors with the lowest and technically acceptable quote for each location will be sent the official SF1449 for review/award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision) The Government will evaluate said quotations in a simplified process (efficient and minimally-burdensome fashion) using the below, evaluation criteria consisting of non-price factors and price factors for each location (FSL-W, NFEA Beltsville and FSL-A).

The Government will determine which offerors quotes the best value to the Government based on their demonstrated ability(ies) and capability(ies) in relation to this requirement as well as their demonstrated feasibility of successful implementation of said requirement.

The Government reserves the right to reject any quotation that’s non-compliant with the solicitation, unreasonable, or doesn’t comprehend the complexity or risks associated with the work to be performed.

Factor 1, Eligibility – Technical Acceptability The Government will evaluate whether the Offeror demonstrated its ability to provide all the required services OR some of the required services addressed in the PWS to include its subcontractor (if proposed). To be found “Acceptable,” the Offeror’s quote must effectively demonstrate its knowledge, understanding, and technical ability to successfully perform and manage the requirements of the SOW. The Offeror's demonstrated ability must meet/exceed the specifications provided within this RFQ to be further considered for award.

The Government will award a contract for each location to the offeror/s with the lowest evaluated price whose quote meets or exceeds all minimum technical requirements of the RFQ.
