Summary of Addendum No. 3 – ITB 26-13-214320

This Addendum is issued by the Alaska Railroad Corporation (ARRC) to provide clarification and additional information regarding the Seward Freight Dock Expansion Fender System Invitation to Bid (ITB) 26-13-214320. The document addresses bidder inquiries concerning Buy America and Buy American requirements applicable to the project, which is funded in part by a MARAD (Maritime Administration) grant. Addendum No. 3 establishes that multiple federal certifications are required for bid submission, including FTA Buy America Certificate, FRA Buy America Certificate, Certification Regarding Use of Contract Funds for Lobbying, and the Build America, Buy America Act certification under 2 CFR 200.322 and Section 70914 of Public Law No. 117-58. The document specifies that the four-page Build America, Buy America Act form (Form #34) has been added as a required bid document and must be fully completed and submitted with bids. Bidders must acknowledge receipt of this addendum and all previous addenda in their Supply Bid Form (Form 395-0129). The bid deadline remains April 21, 2026, as extended by Addendum 2.

The Build America, Buy America Act certification requirements mandate that contractors and subcontractors certify that all iron, steel, manufactured products, and construction materials used in the project are produced in the United States, applicable to all federal-aid infrastructure contracts exceeding $250,000. For manufactured products, domestic content must comprise greater than 55 percent of total component costs unless another standard has been established under applicable law or regulation. The certification form requires detailed itemization of all materials, including material type, manufacturer name, product location, and description for up to 21 line items across two pages. Contractors must sign the certification affirming compliance with BABA requirements and understand that false statements are subject to provisions under 31 U.S.C. Chapter 38, Administrative Remedies for False Claims and Statements. The prime contractor bears responsibility for all subcontractors and must ensure that manufacturers and suppliers certify materials while maintaining documentation verifying compliance, with additional materials specified through formal Change Orders.

Required Contract Provisions for Federal-Aid Contracts [Revised April 2, 2026]

34. BUIILD AMERICA, BUY AMERICA ACT – 2 CFR 200.322; Section 70914 of Pub. L. No. 117- 58, div. G, tit. IX, subtit. A, 135 Stat. 429, 1298 (2021); 2 CFR Part 184 [Applies to all Federal-aid infrastructure contracts in excess of $250,000]

Contractors and their subcontractors who apply or bid for an award for an infrastructure project subject to the domestic preference requirement in the Build America, Buy America Act (BABA) shall file the required certification to ARRC with each bid or offer for an infrastructure project, unless a domestic preference requirement is waived by U.S. DOT. Contractors and subcontractors certify that no federal financial assistance funding for infrastructure projects will be provided unless all the iron, steel, manufactured projects, and construction materials used in the project are produced in the United States. BABA, Pub. L. No. 117-58, §§ 70901-52. Contractors and subcontractors shall also disclose any use of federal financial assistance for infrastructure projects that do not ensure compliance with BABA domestic preference requirements. Such disclosures shall be forwarded to ARRC which in turn will forward the disclosures to the federal awarding agency.

For contracts subject to BABA, contractors and subcontractors must sign and submit the following certification to the next tier (e.g., subcontractors submit to the contractor; contractors submit to the non-federal entity):

The undersigned certifies, to the best of its knowledge and belief, that:

The Build America, Buy America Act (BABA) requires that no federal financial assistance for “infrastructure” projects is provided “unless all of the iron, steel, manufactured products, and construction materials used in the project are produced in the United States.” Section 70914 of Public Law No. 117-58, §§ 70901-52.

The undersigned certifies that the iron, steel, manufactured products, and construction materials used in this contract are in full compliance with the BABA requirements including:

1. All iron and steel used in the project are produced in the United States. This means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States.

2. All manufactured products purchased with federal financial assistance must be produced in the United States. For a manufactured product to be considered produced in the United States, the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55% of the total cost of all components of the manufactured product, unless another standard for determining the minimum amount of domestic content of the manufactured product has been established under applicable law or regulation.

3. All construction materials are manufactured in the United States. This means that all manufacturing processes for the construction material occurred in the United States.

The undersigned certifies or affirms the truthfulness and accuracy of each statement of its certification and disclosure, if any. In addition, the undersigned understands and agrees that the provisions of 31 U.S.C.

Chap. 38, Administrative Remedies for False Claims and Statements, apply to this certification and disclosure, if any.
