About this file
This is Addendum No. 1 to a Request for Quotes (RFQ) issued by the West Virginia Department of Environmental Protection (WVDEP), Division of Mining and Reclamation, for the Kempton Refuse Rehabilitation project (ARFQ DEP2500000009). The project involves rehabilitation work at a former coal refuse site, including the construction of channel repairs, access roads, stabilized construction entrances, and limestone pond rehabilitation. Significant modifications were made following a pre-bid conference held on August 15, 2024, resulting in the removal of a proposed waste site and related infrastructure on the northern side of West Kempton Road. The bid closing date has been extended to September 24, 2024, with a vendor question submission deadline of September 17, 2024. A pre-bid meeting was conducted, and all prospective bidders must be registered on the WV Oasis website to submit electronic bids. Contractors must complete the project within 180 calendar days, with a liquidated damages clause of $1,000 per day for delays.
The Engineer's Estimate for the project is $2,449,505.00. Contractors must provide public liability and comprehensive vehicle liability insurance of not less than $2,000,000.00 for bodily injury and property damage per occurrence and in the aggregate, along with a five percent bid bond and a 100 percent performance and labor and material payment bond. The project is funded through Infrastructure Investment and Jobs Act (IIJA) funding and is subject to Davis-Bacon prevailing wage requirements and certified weekly payroll submission. Buy American and Barrier Act (BABA) requirements apply to the project. Contractors must comply with OSHA safety requirements, maintain West Virginia Worker's Compensation Insurance and unemployment compensation for all employees and subcontractors, and track and report all former or displaced coal mine industry workers performing work on the project to WVDEP-AML.
