About this file

This document is an Addendum to a federal solicitation for commercial products and services issued by the Environmental Protection Agency (EPA). The solicitation includes multiple Federal Acquisition Regulation (FAR) clauses and provisions, with key evaluation criteria focused on technical capability and price. The technical evaluation will use a confidence-based rating system (High, Some, or Low Confidence) to assess offerors' understanding of requirements and proposed approach, with technical factors rated equally and considered significantly more important than price.

The contract allows for potential extension up to five years and six months, with the government able to extend the contract term by providing 90 days' written notice. Specific provisions include clauses related to annual representations, service contract reporting, telecommunications equipment restrictions, and other standard commercial product procurement requirements. The solicitation emphasizes determining best value through a trade-off analysis that balances technical performance against pricing, with a clear directive not to award significantly higher prices for only marginally better performance.

*FAR 52.212-2 EVALUATION OF COMMERCIAL ITEMS (NOV 2021)

(a)The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The Government will use the following evaluation scheme to assign a rating for Technical Evaluation Factors 2a and 2b:

Rating Description

High Confidence The Government has high confidence that the Offeror understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no Government intervention

Some Confidence The Government has some confidence that the Offeror understands the requirement, proposes a sound approach, and will be successful in performing the contract with some Government intervention.

Low Confidence The Government has low confidence that the Offeror understands the requirement, proposes a sound approach, or will be successful in performing the contract even with Government intervention.

Price Evaluation:

The Offeror’s price shall represent the best price in response to the RFQ. The price shall be evaluated to determine fairness and reasonableness.

The Government will determine the best value to the Government by assessing the benefits or better performance versus the added price through trade-off analysis. However, the Government will not award at significantly higher prices to only achieve slightly better performance. As non-price factors become equal price becomes increasingly important. This is based on the Contracting Officer’s determination after an evaluation has been completed on all offers. The proposed prices/costs will be evaluated but not scored. The price evaluation will determine whether the proposed prices are fair and reasonable in relation to the solicitation requirements.

BASIS FOR AWARD:

Award shall be made to the quoter whose quotation offers the best value to the Government, considering technical capability and price. The Government will evaluate quotations based on the following evaluation criteria: (1) technical factors, which are all rated equally, and (2) price where the technical factors are equal and are significantly more important that price.

(End of clause)

*FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 90 days of contract end date; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 90 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five years and six months.

(End of clause)
