PERFORMANCE WORK STATEMENT (PWS)

FOR

21st CIVIL ENGINEERING

REAL PROPERTY SUPPORT SERVICES

AT

PETERSON SPACE FORCE BASE (PSFB), CO

13 December 2022

SECTION I: DESCRIPTION OF SERVICES

1. SCOPE OF WORK: In Provide non-personal administrative support for real property actions to include: inventory building customers, assist with inventory actions, validate real property Key Supporting Documents (KSD), review DD Form 1354s Transfer and Acceptance of DoD Real Property for completeness, review real property instruments including in-grants and out-grants/assist with processing, assist in developing off base lease package documents, Major Land Acquisition Waiver (MLAW) packages, Economic Analysis inputs, develop instruments for entities without Civil Engineer real property instruments in place, resolve problems with hard copy real property folders, generate DD Form 1354s for assets left to process/still need to be capitalized, go through hard copy real property folders and ensure folder contents match what is on the ground, ensure real property folders match Automated Civil Engineer System – Real Property (ACES-RP), rectify KSD discrepancies, review host tenant support agreements and incorporate new real property language into the agreements. The contractor will provide Real Property Support services to 21 Civil Engineer Squadron (21 CES) in the execution of this program. The contractor shall perform to the standards established in the PWS.

1.1. The contractor shall provide a full range of services and deliverables in support of 21

CES. Services and deliverables will support real property actions. The contractor will be located at Peterson Space Force Base (PSFB) as described in paragraph 6.0 below. In the future, an increased level of these same or similar services may be required, which will likely require additional labor hours

2. MISSION. The 21 CES mission is to develop resilient engineers, optimize sustainable installations, safeguard the Front Range community and provide premier customer service to support global space superiority. This order supports this mission.

2.1. ORGANIZATION BEING SUPPORTED

21st Civil Engineer Squadron 580 Goodfellow Street Peterson SFB, CO 80914-2370

3. OVERVIEW OF SERVICES REQUIRED

3.1. PSFB: The services described in paragraph 4.0 and 5.0 below will be performed at

PSFB. The Government anticipates the need for approximately 4464 work hours per year. Workload will consist of processing and coordinating the following packages: legal instrument templates (50 each), AF Form 123 (75 each), DD Form 1354 (500 each), AF Form 300 (20 each), Existence and Completion facility site visits ACES-RP record annotation/corrections and GeoBase ArcMap hardcopy annotations/ corrections (3,000 each), Physical Inventory facility site visits ACES-RP work with facility managers, annotate space changes, customer changes, new or modified real property corrections/updates, Inventory Form and Picture Packages (600 each), Host Tenant Support Agreement (HTSA) reviews and language incorporation (80 each).

3.2. ORGANIZATIONAL CONFLICT OF INTEREST. This PWS will require contractors to provide documents that support real property actions. Due to the nature of this requirement, there may be an Organizational Conflict of Interest (OCI) for future acquisitions that may occur. Contractors will not be allowed to work on future acquisitions in accordance with FAR 9.5. The Contractor shall comply with requirements IAW FAR 3.11, Preventing Personal Conflicts of Interest for Contractor Employees Performing Acquisition Functions.

3.3. QUALIFICATIONS/EDUCATION/CERTIFICATIONS.

3.3.1. Real Property personnel providing services shall have, at a minimum, 1 year of experience as a Real Property Accountable Officer (RPAO) or civilian equivalent.

Relevant experience includes but is not limited to: a knowledge of the DD Form 1354 Transfer and Acceptance capitalization process, training tradesman, technicians, civilian workers and assisting them to walk through and prepare DD Form 1354s, assist RPAOs with review, validation, transfer, acceptance of new or improved real property assets. Update ACES-RP and NexGen IT records to achieve OSD Financial Improvement Audit Readiness (FIAR) goals. Perform physical inventory requirements and inspect necessary components including verifying equipment, facility occupants, correct category codes, review facility folder, annotate floor plan changes, space allocations, Real Property Installed Equipment (RPIE), linear segmentation and ensure ACESRP, NexGen IT and GeoBase records accurately reflect updates. Initiate and complete real property instrument in-grants and out-grants, prepare real property appraisals, economic analysis (business case analysis), military land acquisition moratorium waivers (MLAW), work with in-grant and out-grant proponents, US Army Corps of Engineers (USACE), AFCEC/CIT, AFIMSC/RMC Financial Management Center of Expertise and GSA.

Ensure real property transactions are cost effective and withstand close scrutiny from legal challenges. Assist RPAOs in preparing AF Form 300 disposal packages, completing HUD and McKinney Act checklists. Review host tenant support agreements and incorporate new real property language into the agreements.

Additionally, personnel shall have experience utilizing NexGen IT, ACES-RP and Microsoft Office applications.

4. REAL PROPERTY MANAGEMENT – The contractor shall:

4.1. Provide assistance surveying buildings and developing documentation to resolve real property action discrepancies. The contractor will conduct ACES-RP and NexGen IT data entry, data quality assurance & data quality control in support of 21 CES.

4.2. Work with customers to update the inventory of building customers and prepare documentation in support of real property actions. The contractor’s workload will vary each month but will be expected to complete an average of 5-10 real property actions per month. Coordinate with other governmental personnel, as necessary, to define real property requirements, ensure compliance with Federal, State, local and Air Force regulations.

4.3. The contractor will follow all applicable laws, Department of Defense issuances and Air

Force Instructions when capitalizing project work.

4.4. The contactor will perform Real Property Accountability and Reporting (Inventory) for a building or structure in accordance with DAFI 32-9005(dated 13 Sept 2022), as required.

5. ADDITIONAL DELIVERABLES. The contractor shall submit a Project Status Report (PSR) which will include a running list of all projects programmed and prepared for acquisition. Report shall include the date project was assigned and completed, or the estimated completion date for ongoing projects. Reports shall be delivered to 21 CES COR on the first business day of the month. Contractor format is acceptable as long as it contains all required information.

6. GOVERNMENT FACILITIES AND SUPPLIES. The Government shall provide two (2) workspaces in Building 1324 on Peterson SFB. Workspace will include desk space, chairs, with access to the Non-Classified Internet Protocol Router Network (NIPRNET), and use of laptops, telephones, copiers, and scanners. Al Government furnished supplies shall remain at the Government facility or workspace provided.

7. GOVERNMENT FURNISHED INFORMATION. Government personnel shall be available for technical exchanges with the contractor. Government personnel shall provide technical input, answer questions, review and accept completed work, assist in any stalled coordination efforts, and provide feedback regarding contractor efforts.

8. PRODUCT OWNERSHIP. All products produced by the contractor in performance of this

PWS are the property of the Government.

9. PROPRIETARY DATA. The contractor shall request Government approval prior to the use of any proprietary data or software tools to fulfill the requirements of this PWS.

10. The contractor shall not retain unclassified material generated or received under this contract after the contract ends without approval of the appropriate office of primary responsibility.

11. All deliverables and data under this contract are the sole and exclusive property of the

Government and may not be used by the contractor for any purpose outside the performance requirements of this contract. The contractor shall not use any materials or work samples pertaining to this order for business development or any other vendor strategic purposes, however, the contractor is authorized to include summary performance information in proposals to be submitted to satisfy past performance information requirements.

12. HOURS OF OPERATION.

12.1. NORMAL DUTY HOURS. Work performance is required to be on-site at

PSFB. The contractor will perform services required under this contract within the following hours: 7:00 a.m. to 5:00 p.m., Monday through Friday. Although expected to be extremely rare, in some cases the Government may require the contractor to work non-standard duty hours (approximately 5 hours per year).

12.2. HOLIDAYS.

The contractor is not required to provide service on the following days:

12.3. BASE CLOSURE/GOVERNMENT MORALE AND RECREATIONAL

ACTIVITIES. Situations may arise where Government facilities may not be available for performance of requirements (i.e., base closure due to weather, force protection conditions, etc.). There may also be occasions when support contractors are invited to participate in morale and recreational activities (e.g., holiday parties, golf outings, sports day and other various social events). Under these circumstances, contractor employees shall comply with individual company policy in accordance with company compensation system. Because the Government does not have an employer/employee relationship with contractor employees, it is not authorized to grant administrative leave or expend Government resources to compensate contractor employees for hours expended on activities not included in the PWS.

12.4. SERVICE DURING CRISIS. The performance of these services are not considered to be mission essential during times of crisis. Should a crisis be declared, the CO or their representative will verbally advise the Contractor if service is required or if temporary suspension of these activities is necessary, followed by a written notification.

A representative of the CO will further notify the Contractor verbally when the crisis has ended with written notification to follow. Any price changes resulting from this crisis will be negotiated in accordance with FAR clauses for “Changes”.

13. SECURITY REQUIREMENTS. The contractor personnel will not require access to any classified documents or information. The Contractor and all contractor employees will comply with all Peterson SFB security requirement imposed by the local installation commander at all times while on the premises, to include not using cell phones while operating a vehicle on base. The Contractor will obtain necessary badges(s) required for access to Peterson SFB.

13.1. BADGE REQUEST(S). The Contractor shall send a letter to the Contracting

Office on the template provided by the Contracting Officer to both the Contracting Officer and the COR. Anytime a badge is requested for a new employee, an updated employee list will accompany a request letter by the Contractor to the Contracting Officer and the COR.

13.2. Contractor employees will apply for individual identification badges at the Peterson SFB Security Force Squadron Visitor’s Control Center. It is incumbent upon the Contractor to check the Visitor Center’s hours of operation and appointment requirements prior to arrival. Upon completion or termination of the contract or termination of a Contractor employee, the Contractor employee will surrender any identification badges and vehicle identification to the Contracting Office no later than the following business day.

13.3. Vehicle Requirement. Proper state vehicle registration, proof of insurance, and a valid driver’s license are required to drive on base.

13.4. Safety on an Air Force Installation: The procedures outlined in Air Force Instruction (AFI) 91-207 “USAF Traffic Safety Program”, Chapter 3, are mandatory for each individual while on all Air Force (AF) Installations.

13.5. The contractor employees shall be required to obtain a Common Access Card

(CAC), which requires a security investigation and clearance. It is the responsibility of the contractor to ensure their employees are able to obtain and maintain the applicable clearance required for a CAC.

14. TRAINING REQUIREMENTS.

14.1. Antiterrorism (AT) Standards. IAW Department of Defense Instruction (DoDI)

2000.16, DoD Antiterrorism (AT) Standards, paragraph E3.18.6, a contractor with employees performing work on a DoD installation will meet DoD AT Level I training requirements. The contractor shall submit certificates of completion to the COR and to the CO, within 30 calendar days after contract start date. All new employees who begin performance under this contract during the contract period of performance must submit certificates of completion within 30 calendar days of performance start date. AT Level 1 awareness training is available at the following website: https://atlevel1.dtic.mil/at.

14.2. DoD Information Assurance Awareness (IAA) Cyber Awareness. IAW DoD

8570.01-M, Information Assurance (IA) Workforce Improvement Program, contractors with access to DoD Information Technology systems are required to receive and complete IA orientation awareness training before being granted access to these system(s) and annual IAA to retain access. All personnel must complete the DoD IAA Cyber Awareness Challenge training in Air Force MyLearning (https://lms.jets.cce.af.mil).

14.3. ACES-RP and NexGen IT. The contractor shall submit certificates of completion for ACES-RP and NexGen IT to the COR and to the CO, within 30 calendar days after contract start date. 14.4. Additional Training: None

14.5. On-the-Job Training (OJT): Training for other applicable systems (e.g. ACES-

RP, NexGen IT, etc.) will be provided by the Government during normal working hours.

15. TRAVEL. None

16. MATERIALS AND OTHER DIRECT COSTS (ODC). None

17. NON-PERSONAL SERVICES. The contractor shall understand the prohibitions imposed on the U.S. Government regarding personal services contracts and will report instances where the Government attempts to control or supervise contractor’s employees to the Contracting Officer (CO) immediately. Contractor shall ensure its personnel do not perform inherently governmental activities. Contractor shall ensure its personnel do not attempt to represent the Government of the United States to any other person or entity, U.S., or foreign, except for delivering a Government-approved message or position.

18. SERVICES SUMMARY (SS): The contract service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. An SS item shall be “Unacceptable” when the contractor exceeds the allowable number of defects during the period as identified in the Performance Threshold column (i.e., quarterly or annually). A defect is a service that does not meet the requirements of the PWS.

Even though the contractor is responsible for all of the requirements as listed in this PWS, the below listed services have been identified as critical to mission success.
