About this file

This is Addendum 4 to a solicitation issued by the West Virginia Department of Environmental Protection (WVDEP) for land reclamation services at the Energy Marketing Co., Inc. UO-885 project in Barbour County, West Virginia. The solicitation requests excavation, grading, and site restoration work including unclassified excavation (400,000 cubic yards), ditch construction and lining, road maintenance, fencing (3,700 linear feet), sediment pond construction, cattle waterer installation, and HDPE pipe conveyance systems. The addendum modifies the original bid opening date to December 21, 2023, and provides clarifications to 33 pre-bid conference questions addressing material specifications, compaction requirements, refuse placement, soil cover depths, water well sealing procedures, and payment mechanisms. Revised quantities and new line items include Ditch 5 (580 linear feet), Unclassified Excavation (400,000 cubic yards), Farm Fence and Gates (3,700 linear feet), 2-inch HDPE DR 17 Conveyance Line (500 linear feet), Sediment Pond (1 lump sum), and Cattle Waterer (1 each). Revised and added technical specifications and drawings were incorporated to reflect these modifications.

The solicitation employs unit-price bidding for most items and lump-sum bidding for the sediment pond and cattle waterer. Contractors must survey refuse areas to ensure accurate cubic yard payment and are responsible for obtaining offsite borrow and disposal areas at no cost to WVDEP. Backfill compaction requirements vary by application, with non-structural highwall backfill requiring 90 percent maximum dry density compaction verified through proof rolling. Coal refuse must be undercut to one foot depth and replaced with clean soil, with quantities determined by survey. Contractors must comply with NEPA requirements for any offsite borrow or disposal areas and provide documentation of compliance. The project expects to commence in February 2024, though no cost escalation adjustment mechanism exists for fuel price increases. An existing water well must be sealed by a certified West Virginia well driller in accordance with state standards, and a small on-site stream may be used for compaction and dust control. Heavy equipment access requires coordination with active mining operations and compliance with MSHA requirements.

Addendum 4 - Questions During The Pre-Bid Conference For

Energy Marketing Co., Inc. UO-885 Reclamation Project

ARFQ DEP24*33

The following questions were identified at the Pre-Bid Conference (PBC) conducted on-site on 09

November 2023 and questions received from DEP Procurement. The answers and clarifications provided herein take precedence over verbal answers at the PBC and previously provided specifications and descriptions provided in the Solicitation should there be any conflicts between the two.

Q1: Is the Incidental Stone item to be used for Road Maintenance?

A1: Yes, please see Technical Specification 5-2, Road Maintenance, subsection 1.0.A.

Q2: Is it required that all refuse yardages be surveyed to ensure payment by cubic yard?

A2: Yes, a pre-construction survey should be completed in addition to intermittent surveys and a final survey to ensure accuracy. If the yardage is not properly surveyed, then WVDEP will be unable to properly compensate the awarded contractor for the work.

Q3: The Refuse Area is about 100,000 cubic yards, where does the other fill material come from for backfilling the highwall?

A3: When originally stripped mined, the overburden was stockpiled further up the valley on the hillside just past the highwall. This is marked as the Borrow area in the drawings.

Q4: What are the compaction requirements for the backfill? How will compaction be measured?

A4: Please see Technical Specification 6-5, 2, which calls for 90 percent maximum dry density compaction of the highwall backfill. Compaction testing shall be by “proof rolling”, as per

Technical Specification 4-3.C.

Q5: What is the largest boulder allowed in the backfill?

A5: Typically, no boulder larger than 3 feet on a side is allowed in the non-structural backfill, however, the Inspector may allow larger boulders depending upon the size, depth of fill, and location. Please see Technical Specification 6-5.C.2.b and c.

Q6: How high should the Refuse and other AMD producing potential material be placed off the base of the backfill?

A6: Refuse should be a minimum of four feet off the floor of the backfill, and away from the highwall, as per Technical Specification 6-5.5.

Q7: Where are the details for the benches?

A7: Please see Sheet 26 of the drawings.

Q8: What is to be done with the Clear and Grubbed material?

A8: All Cleared and Grubbed vegetative material is to be burned to ash, as per Technical

Specification 5-1.H.5.

Q9: With respect to the excavation numbers shown on sheet 9, what group of numbers refer to which area?

Addendum 4 - Questions During The Pre-Bid Conference F or Energy Marketing Co., Inc. UO-885 Reclamation Project

A9: The group “Regrade with Benches” refers to the highwall backfill area, the “2% area + bridge” refers to the Refuse pile area, and the “Borrow Area – 3” refers to the borrow area.

Q10: The scales of the profile sheets seem to be wrong. What are the correct scales?

A10: The sheets are set to be printed out on 36 inch by 24 inch paper, landscape orientation. A check of the individual profiles did not show any scale errors.

Q11: What type of E&S control is required for the green lines shown on drawings 29,30,31 &

32?

A11: The contractor may use super silt fence, silt fence, hay bales, or silt socks. Whatever type is used, it must work.

Q12: Please clarify the breakdown for the 390,000 CY of unclassified excavation.

A12: Please see Sheets 09 and 21 of the drawings.

Q13: Does a qualified Geotechnical Engineer need to be present during filling or proof rolling operations?

A13: No.

Q14: Since the quantity of tires to be disposed of is unknown, can the awarded contractor be paid for the disposal of the tires at an agreed upon rate?

A14: The site has been made available for viewing at the contractor’s convenience. The contractor must determine what trash or garbage must be disposed of in preparing his bid.

Trash removal is paid for in the Site Preparation line item, which is a lump sum bid item.

Q15. What is the approximate depth of the water well?

A15. The exact depth is unknown. It is believed to be about two hundred feet deep.

Q16: Are any gates required for the fence bid item?

A16: Yes, a gate will be required on the sediment pond.

Q17: Can the client extend the bid date until 12 December 2023?

A17: The bid date has been extended to 14 December 2023.

Q18: Can the client extend the questions due date by two weeks until 30 November 2023?

A18: No, questions are due by 16 November 2023.

Q19: What type of liner is required for Ditch 10?

A19: 60 mil HDPE liner.

Q20: The plans call for a 3X3 underdrain, but I can not find a detail on it and it is not listed as a bid item. Is this to be installed?

A20: Yes, please see Sheet 28 for a standard detail of an underdrain, but note that this seep collector is to be of 8 inch DR17 HDPE, not PVC. It is Bid Item Number 30.

Q21: Since the project is not expected to start until February 2024 will the contractor be compensated for any significant changes in fuel prices?

A21: Currently, no mechanism exists for a WV State contract to take into account a situation such as this.

Q22: Can the concrete foundations, including rebar and minor steel, be processed into smaller chunks and left onsite in the fill area? Can any cinder blocks be left on site in the fill area?

A22: Yes. Any concrete should be broken up into pieces no larger than 3 feet on a side and buried in the highwall backfill. Cinder blocks need to be crushed before placing in the backfill.

Q23: Are there any bore holes for the coal refuse pile or designated borrow area?

A23: No.

Q24: Since we are placing loose fill to 90% compaction next to a highwall rock face, what will the procedure be if the fill area settles during the warranty period?

A24: If the fill settles and creates any cracks, the contractor would need to bring it back to grade and seal off any cracks at their expense under warranty. It is the responsibility of the contractor to figure out what procedure and equipment will be used.

Q25: What is the casing size for the water well that needs to be capped? Is there still a pump?

A25: The well is about a six inch diameter cased well. No pump is in the well. Please note that the well must be sealed by a certified WV well driller in accordance with the West

Virginia Bureau of Public Health Water Well Design Standards 64-46-12, Water Well

Abandonment.

Q26: Will the contractor be able to use a water source on site for compaction and dust control?

A26: There is a small stream that runs through the Impoundment Area.

Q27: Is the intent of the project to only use on site borrow and coal waste for the highwall fill?

A27: Yes.

Q28: Are the ditches to be lined with Mirafi fabric or 60 mil HDPE?

A28: The ditch schedule on Sheet 24 notes that only Ditch 10 is to have a HDPE liner, the other lined ditches are Mirafi fabric.

Q29: If the contractor reaches grade in the refuse pile area and the black material is present, will the contractor be required to undercut a certain depth and replace with clean dirt? If so, how will the contractor be compensated for undercutting?

A29: Yes, undercut the area to one foot of depth into clean soil. Quantities will be based upon the surveys made of the area.

Q30: Have the existing structures been inspected for asbestos or lead?

A30: No.

Q31: The line item quantity for ditch 5 is 280’ but the drawings indicate 580’. Which is correct?

A31: The drawings are correct.

Q32: Can the DEP clarify if they have received permission from the coal company to access the project via the existing mine site?

A32: Yes.

Q33: Will the contractor be permitted to bring stone deliveries through the mine property?

A33: Yes, the contractor must co-ordinate with the active mine operations for access.
