About this file

This document is an Addendum (Number 3) issued by the West Virginia Department of Environmental Protection (DEP) for the ARFQ DEP2500000055 Harrison County Multi-Well Plugging Package solicitation. The addendum includes technical questions and answers related to a multi-well plugging project involving 22 wells, with a standard 180-day performance period that DEP acknowledges may likely require contract extension. The solicitation is structured as a single line item for permitting, with each well bid individually for plugging and reclamation. DEP has indicated flexibility regarding the contract timeline, stating they will extend the contract as needed if the vendor is making progress.

The technical questions and answers provide additional clarification for potential bidders, addressing specific project details such as matting requirements (vendor discretion), tree-cutting restrictions (no bat law limitations), and potential contract modifications. The department maintains sole discretion to remove wells from the contract if necessary, though they currently have no intention of doing so. Bidders are advised to bid with the full intention of completing all contract obligations. The solicitation appears to be a state-funded project focusing on environmental remediation of multiple well sites in Harrison County, West Virginia.

TECHNICAL QUESTIONS & ANSWERS

1Q. Are composite or timber mats required on any of these well sites?

1A. No. Matting boards are at the discretion of the vendor.

2Q. Can you please confirm that no Bat Laws will interfere with timber removal?

2A. To the extent that tree-cutting is necessary, DEP is not imposing any time-based restrictions on this state-funded project.

3Q. Will the Department extend the contract term from 6 months to one year?

3A. The bid solicitation specifies a 180-day performance period, as is standard for all state-funded multiwell contracts. DEP acknowledges that it is unlikely to accomplish the contract terms within this time frame, and has stated directly on other county-level projects, that as long as the vendor is making progress, it will extend the contract as needed.

4Q. What would happen if a well was removed from the contract after award?

4A This bid solicitation is structured as a single line item for permitting with a quantity of 22

(one for each well on the solicitation), and each well is bid individually for its plugging and then reclamation. If DEP were to remove a well after the contract was awarded, these line items would remain unfulfilled. At the completion of the remaining work, those line items would be formally removed prior to contract closure. That being said, DEP has the sole ability to determine whether or not a well would be removed, and at present, has no intention of removing any wells from this solicitation. All wells should be bid with the intention of fully completing the contract obligations.
