About this file

This document is an Addendum No. 2 issued by the Maryland Transit Administration (MTA) for the MARC IV Truck Overhaul contract (MRC-23-022-MT). The addendum includes responses to additional bidder questions and a conformed Invitation for Bid (IFB) and Scope of Work (SOW). The bid due date has been extended to October 18, 2023. The SOW covers the overhaul of MARC IV railcar trucks, including replacement of wheel-axle-disc-bearing sets, reconditioning of bearings, requalification of axles and brake discs, and replacement of a percentage of wheels. The contract includes 30-day run tests for conditional and final acceptance. The IFB outlines insurance requirements, Buy America compliance, and milestone payments. The design review process has been consolidated to a single review, and the number of trucks that can be out of service at one time has been clarified. Pricing for repairs beyond the scope and damages discovered during inspection will be handled through the Miscellaneous Work Allowance or a Change Order.

Regarding pricing, the IFB does not allow for removal of the liquidated damages requirement or the professional liability insurance requirement. Railroad protective liability insurance is required for any company entering the MTA rail yard. The contractor must provide their last two years of financial statements with the bid.

ADDITIONAL BIDDER QUESTIONS AND RESPONSES

Question Response

Scope states that wheelsets are to be replaced. Could you confirm that includes axles, and wheels that fall within usable range (or are these parts inspected and re-used if they pass)?

The Scope of Work (Section

2.2.2) has been revised regarding disposition of wheel-axle-disc-bearing sets.

General Clarification: The bid documents refer to both a conditional and final acceptance. However, it does not clearly define the time frames associated. Please confirm our understanding is correct. If not, please provide detailed timelines associated with each item. For conditional acceptance, our understanding is that will be paid upon receipt of the trucks. For final acceptance, our understanding is that the invoice will be paid upon completion of the 30-day run test.

See definitions in the SOW

Section 1.14

Appendix 3: Truck Overhaul Scope of Work Section 2.2.2.A to 2.2.2G.

This section notes that all wheel and axle sets will be replaced with new. This is out of the ordinary for overhauls. Typically, wheelsets are overhauled and not replaced with new. Section 2.2.2.D repeats itself with Section 2.2.2.F.

Section 2.2.2.E repeats itself with Section 2.2.2.G. We assume that if wheelsets were replaced with new that would also include new axles and new wheels not mentioned in the specification. Please confirm. We would suggest that all the wheelsets instead be overhauled whereby the bearings are reconditioned, axles requalified, brake discs requalified, and wheels replaced with new. Then a percentage replacement could be established for brake discs

(suggestion: 25%), axles (suggestion: 10%), and bearings (suggestion: 20%).

Any replacement parts over and above the percentages estimated would go against the Miscellaneous Work Allowance.

See response to question 1

Part 3 Contractor Requirements: General Section 3.4: We suggest the following insurance amounts be replaced with the current specification:

a. Commercial General Liability:

i. Specification: $5M

ii. Request: $5M

b. Workers Compensation

i. Specification: $1M

ii. Request: $1M

c. Commercial Automobile

i. Specification: $1M

ii. Request: $1M

d. Excess or Umbrella Liability - Specification: $5M, Suggestion: $5M

e. Railroad Protective Liability - Specification: $5M per, $10M aggregate Suggestion: $0M – work will not be performed on the railroad and therefore this is unnecessary.

f. Professional Liability (Errors and Omissions) -

Specification: $5M per, $5M aggregate Suggestion: $0M

g. Contractor Pollution Liability Specification: $5M

Suggestion: $0M

No change in requirements

Addendum 2 – MARC IV Truck Overhaul MRC-23-022-MT 3 of 7

For railroad protective liability insurance, will freight carriers be required to cross active rail lines to pick up and deliver the MARC IV railcar trucks?

Are the crossings single or double track, gated, and what is the number of scheduled passenger and freight trains per day on those lines? If there are any ungated crossings, will MTA-MARC provide flagging assistance?

Freight carriers may be required to cross yard railroad tracks in the MARC maintenance facility. Train movement on these tracks is dependent upon scheduled maintenance activities.

Upon arrival at the facility, the shipping company shall check in at the main office and will be escorted at all times.

Buy America Section 4.27.9

1. As the IFB references 49 C.F.R. Parts 661.5 and 661.11, with this being a

"Truck OH," please confirm whether 661.5 (manufactured products) or

661.11 (rolling stock) is the regulation for which we should comply?

2. Will there be a "Pre-Award Audit" for Buy America?

This contract is for the overhaul of “trucks”;

therefore, it is NOT rolling stock.

A “pre-award audit” is not required.

Trucks Out of Service

Section 5.3.10: Trucks Out of Service - it is mentioned that a "not-to-exceed quantity of six (6) MARC III coaches removed" and later in the paragraph

"The not-to-exceed limit of six (6) trucks includes trucks that are not available for revenue service"

Please confirm if the not-to-exceed quantity is 6 MARC IV coaches, so 12

MARC IV trucks or 6 MARC IV trucks.

All references to MARC III in the IFB/SOW have been changed to MARC IV. See revisions to Scope of Work

5.3.10.

Milestone Payments

Given the duration of performance and sequence of the work, the milestone payment terms are not favorable for the Contractor from a cash perspective.

Would the State consider changing the milestone payments in 3.2.5 to provide the first milestone payment at NTP instead of after CDRL approval and revising the subsequent milestones to permit Contractor payment greater than 60% at conditional acceptance of stage 2?

Milestones in IFB 3.2.5

Adjusted.

Design Reviews

Section 5.7.2: The multitude of design reviews (PDR, CDR and FDR) and the requirements associated do not seem relevant for a standard 6-year component overhaul. Could the State agree to lighten the design process prior to the first overhaul?

Revised Design Review process. Consolidated to one design review. Changed SOW
