About this file

This document is Addendum 2 for Solicitation Number ARFQ DEP2500000067, issued by a state agency related to a Clean Water State Revolving Fund (CWSRF) Audit. The addendum provides responses to vendor questions regarding the audit requirements, federal grant programs, and specific reporting details. The document clarifies that the audit will cover multiple federal grant programs, including the 66.447 OSG Program and the 66.458 Clean Water State Revolving Fund, with projected expenditures ranging from $1,000,000 to $27.7 million across fiscal years.

The addendum addresses key points such as the use of "Equivalency" in federal program reporting, clarifying that equivalency loans are funded with an amount equal to the capitalization grant and must meet specific federal requirements. The agency confirms they will allow progress billings throughout the audit, contrary to the initial request for a single payment. Additionally, the document references CWSRF Regulations (40 CFR Part 35.31) to explain the reporting requirements, specifically noting that EPA issued regulations in 1990 to supplement the Clean Water Act and codify major requirements applicable to the CWSRF program.

CWSRF Audit

Q1: Historically, the Fund has reported only one program on it’s schedule of expenditures of federal awards. In the RFQ Specifications, you listed several federal grant programs. Can you please provide an estimate of expenditures by assistance listing number and year of the audit contract?

A1: The 66.447 OSG Program is currently (for FY2025) comprised of two active grants. FFY2022 = $853,000 and FFY2023 = 1,149,000. FFY2024 is estimated at $1,000.000. It is projected that these projects will be completed by FY2029.

The 66.458 Clean Water State Revolving Fund has expenditures averaging

$27.7 million per fiscal year over the last five fiscal years.

Q2: Can you please describe for everyone the Funds use of “Equivalency” in it’s federal program and how that impacts federal gran compliance and reporting on the schedule of expenditures of federal awards?

A2: 2024 Compliance Supplement – 2 CFR Part 200 Appendix XI (May 2024)

Part-4 Equivalency loans are funded with an amount equal to the capitalization grant and reported in the OMB Federal Funding

Accountability and Transparency Act (FFATA) Subaward Report System.

These loans are considered to be federal loans. To achieve consistency in meeting program requirements and eliminate the possibility of over-reporting information under FFATA, equivalency loans must meet all equivalency requirements: federal cross-cutters, single audit, architectural and engineering (A/E) procurement, disadvantage business enterprise (DBE), and signage.

While any of the sources of funds in the CWSRF may be used for equivalency loans, it should be understood that these funds would be considered federal funds once they are deemed equivalency dollars and that all disbursements for equivalency loans must be entered into the

SEFA. The SEFA should reflect equivalency dollars rather than actual cash draws from the Treasury to the state. Additionally, the SEFA will differ from the SF-425 form.

Q3: RFQ section #7 Payment indicated only one single payment will be made. Will you not allow progress billings and payments throughout the course of the audit each year?

A3: Yes, historically we have allowed progress billings for work completed.

Q4: Both RFQ section 4.1.1.1 Scope of Work and 4.1.1.3 Reports to be issued refer to a

“report on the internal controls and compliance with Title VI of the Clean Water Act”.

Can you please expand on this requirement? I cannot locate any such requirements in the Clean Water Act.

A4: CWSRF Regulations (40 CFR Part 35.31) (PDF) (13 pp, 184 K, About PDF) In

1990, EPA issued regulations to supplement Title VI of the CWA by codifying all major requirements applicable to the CWSRF program.
