About this file

I apologize, but the provided file appears to be an Addendum 1 to a Request for Proposal (RFP), but no specific details of the addendum are visible in the text. The only substantive information available is from the related state and local contract opportunity description, which indicates this is a Request for Proposal by North Carolina's Division of Services for the Deaf and Hard of Hearing (DSDHH) for intrastate Telecommunications Relay Services (TRS).

The contract opportunity seeks to establish a single vendor contract for providing high-quality TRS services across North Carolina, operating 24/7/365. The RFP is open to vendors who can offer comprehensive telecommunications access services for individuals with disabilities. While the specific details of Addendum 1 are not provided, the overall contract aims to ensure continuous, quality telecommunications relay services for deaf and hard of hearing residents of North Carolina.

States that an E-Procurement fee may apply as per the paragraph entitled ELECTRONIC PROCUREMENT of the North Carolina General Terms and Conditions. This section states that a transaction fee of 1.75% will be applied to any “Goods” purchased through the E-Procurement Service. Will the State please confirm that as the contract resulting from this RFP is for services, not goods, that this fee therefore does not apply?

This does not apply to this RFP and service.

4
RFP page 9, section 2.9.q
Defines an Interstate call as a call that crosses a LATA boundary. An InterLATA call can be either Interstate or Intrastate as most states have several LATAs. Will the State please amend this section of the RFP by changing this definition to “a call between two states”?
The State amends the language defining” InterLata as a call between two states”
5
RFP page 9, section 2.9.r
Defines an Intrastate call as a call that does NOT cross a LATA boundary. Most states have several LATAs, therefore intrastate calls can be either interLATA or intralata. Will the State please amend this section of the RFP by changing this definition to “a call within the same state”?

The State amends the language defining “interLATA as a call within the same state”.

RFP page 14, section 4.6
Grants the State the right to approve Key Personnel replacements. Vendors assume responsibility for the hiring and termination of their employees and make sure that employees are qualified for the position. The contractual provisions require that the Vendor takes 100% of the liability for recruiting, hiring, compensating, providing benefits and all the other customary employer responsibilities. Since the Vendor is contractually required to take that responsibility, the Vendor has to be able to make the decisions regarding employee issues including hirings, transfers and terminations.

For these reasons, will the State please amend this section of the RFP to read as follows:

Should the Vendor’s proposal result in an award, the Vendor shall be required to agree that it will not substitute key personnel assigned to the performance of the Contract without prior written notification by the Contract Lead. Vendor shall ensure that replacement personnel have comparable training, experience, and abilities as the person originally proposed for the position.

This is standard language and will stay as it is.

7
RFP page 16, section 5.2.8
Requires an annual report based on information from the fiscal year (July 1 – June 30). Will the State please amend this requirement to an annual report based on the calendar year?
This is based on the state’s fiscal year and will stay as is.
8
RFP page 18, section 6.5
Liquidated damages. Because relay volumes continue to decline, the vendor must protect itself from liquidated damages exceeding the revenue for the day. Will the State please amend this section to include the following at the end of this section:

Under no circumstances will the liquidated damages exceed the revenue for the day for any one or combination of the above.

This is standard language and will stay as is.

9
RFP page 18, section 6.6
Requires a transition out plan to be submitted one-year prior to the expiration of the contract term. As the initial contract term is for one-year, this timeline does not seem relevant. Will the State please amend this section to align with FCC TRS Rules as listed below?

As required by FCC’s Regulations 47 CFR 64.604(c)(7) TRS vendor shall provide for the transfer of TRS customer profile data from the outgoing TRS vendor to the incoming TRS vendor. Such data must be disclosed in usable form at least 60 days prior to the provider’s last day of service provision.

The language as written will remain as is. The State’s contract award timeline provides at least 60-days prior to the outgoing TRS vendor’s last day of service provision.

NC General Terms and Conditions, page 11, section 21 and Attachment F
Location of Workers both require Vendors to disclose to each caller the location which the call center services are being provided. In the 2020 RFP process the State clarified that this section is specifically for Vendor utilization of Workers outside of the US and does not apply to (vendor or subcontract) workers that are US based.

Will the State please confirm that this is still the case?

Yes – the state confirms that this is still the case.

3. The solicitation is hereby modified as follows:

3.4 Evaluation Criteria

BEST VALUE: "Best Value" procurement methods are authorized by N.C.G.S. §§143-135.9 and 143B-1350(h). The award decision is made based on multiple factors, including: total cost of ownership, meaning the cost of acquiring, operating, maintaining, and supporting a product or service over its projected lifetime; the evaluated technical merit of the Vendor's offer; the Vendor's past performance; and the evaluated probability of performing the specifications stated in the solicitation on time, with high quality, and in a manner that accomplishes the stated business objectives and maintains industry standards compliance. The intent of "Best Value" procurement is to enable Vendors to offer and the Agency to select the most appropriate solution to meet the business objectives defined in the solicitation and to keep all parties focused on the desired outcome of a procurement.

A ranking method of source selection will be utilized in this procurement using evaluation criteria listed in order of importance in the Evaluation Criteria section below to allow the State to award this RFP to the Vendor(s) providing the Best Value and recognizing that Best Value may result in award other than the lowest price or highest technically qualified offer. By using this method, the overall ranking may be adjusted up or down when considered with, or traded-off against, other non-price factors.

EVALUTION METHOD: Narrative and by consensus of the evaluating committee, explaining the strengths and weaknesses of each proposal and why the recommended awardee(s) provide the best value to the State.

All qualified proposals will be evaluated, and award made based on considering the following criteria listed in descending order of importance, to result in an award most advantageous to the State:

1. Vendor Technical Approach (Section 5.2)

1. Cost (Attachment A)
