About this file

This addendum, issued by the Michigan Department of Natural Resources through the Department of Transportation Management Bureau (DTMB), revises bid documents for the Breakwall Repair project at the DeTour State Harbor Boating Access Site. The mandatory construction pre-bid meeting was held on December 2, 2019, with bids due on Wednesday, December 18, 2019, at 2:00 p.m. local time. The project requires substantial completion of all work by June 15, 2020, with final completion required by July 1, 2020. The addendum addresses clarifications resulting from written questions submitted by the Professional Services Corporation and inquiries raised during the pre-bid meeting, including specifications for armor stone, gravel pathways, and warranty coverage.

Key modifications include liquidated damages of $500 per calendar day for work not substantially completed by June 15, 2020, and $250 per calendar day for work not fully completed by July 1, 2020. The armor stone layer must consist of MDOT Heavy RipRap with stones ranging between 600 and 800 pounds, tightly knit with a minimum cover stone thickness of 1.7 feet. The gravel pathway shall be composed of compacted 26A stone as described in the 2012 MDOT Standard Specifications for Construction Manual. A one-year warranty covering defects due to faulty materials or labor applies to the stone pathway, excluding damage from exposure conditions exceeding normal use. Bidders must acknowledge receipt of this addendum on the Bid Summary form submitted with their bid.

DATE: Friday, December 13, 2019

BID DATE: Wednesday, December 18, 2019 at 2:00 p.m. Local Time

TO: All Bidders

ADDENDUM ITEM WRITE UP:

- Item 1 – Desired Construction Schedule o The following replaces the language within Section 00010 - 23 on page 00-6 of the project manual

Work of all trades as specified in the Contract Documents must be substantially completed by June 15, 2020. Substantial project completion shall consist of all identified work except for minor replacement, correction, or adjustment items which do not interfere with the complete operation and utilization of all parts of the Contract Work as well as final site and soil restoration. This Contract Time is of the essence and liquidated damages for each Calendar Day that expires after this Substantial Completion of the entire Work must be in the amount of $500. Liquidated damages are not a penalty, are cumulative and represent a reasonable estimate of the Owner’s extra costs and damages, which are difficult to estimate with accuracy in advance. Final completion of all project work is to be complete prior to July 1, 2020. The time at which the project is considered for final completion will be reviewed and approved by the Owner. This Contract Time is of the essence and liquidated damages for each Calendar Day that expires after Final Completion of the entire Work must be in the amount of $250

- Item 2 – Response to Questions o Q1 – 1 year warranty on stone pathway isn’t considered reasonable due to the level of exposure. Will the stone walkway be excluded from the warranty described within the project bid documents.

Response – No. The warranty covers defects due to faulty materials or labor, and excludes other causes of defect or damage as defined (Section 00700 Article 5.1). Accordingly, prior to making a warranty claim, the level of exposure will be evaluated based on actual site conditions and whether those conditions revealed faulty workmanship/materials or whether those conditions exceeded normal use and caused impact to properly installed work.
