About this file
Addendum #1 for Bid 25-273 is issued by the City of Naperville, Illinois, addressing a medium-heavy duty truck and off-road equipment repairs solicitation. The City is seeking qualified service vendors to provide labor, equipment, supplies, and materials for repairs to its fleet, which consists of approximately 110 medium and heavy-duty trucks and 35 pieces of off-road equipment/vehicles. The addendum provides clarifications to potential bidders regarding bonding requirements, bid responsiveness, and the negotiation process for terms and conditions.
Key clarifications in the addendum include that no bid bond is required at bid opening, and bidders can submit exceptions to general terms and conditions for City review. If exceptions are submitted, the City will evaluate them and determine if they are negotiable or could render the bid non-responsive. The City maintains that certain requirements related to prevailing wage, workplace regulations, tax compliance, equal opportunity, and legal compliance are likely non-negotiable. After bid opening, the City will post a bid tabulation on DemandStar and review submitted bids before proceeding with contract award. Bidders are required to acknowledge this addendum in their offer to contract.

CITY OF NAPERVILLE
NAPERVILLE, ILLINOIS
BID 25-273
Medium-Heavy Duty Truck and Off-Road Equipment Repairs
ADDENDUM #1
The attention of bidders is called to the following changes, clarifications and/or additions/deletions to the original contract specifications and drawings and they shall be taken into account in preparing proposals and shall be part of the Contract Documents:
CLARIFICATION
1. QUESTION: Is a bond required for this bid?
ANSWER: The only requirements are listed on the front page of the solicitation; a bid bond is not required at bid opening. Please see page 1 of the solicitation.
2. QUESTION: If a bidder submits exceptions to the terms and conditions contained within this bid package, will the bidder’s proposal be deemed non-responsive?
ANSWER: If the lowest responsive and responsible bidder submits exceptions to the City’s general terms and conditions, the City will review the exceptions and determine, at its discretion, if the exceptions are negotiable. If the requested exceptions are not in the best interest of the City, the bidder may be deemed non-responsive.
3. QUESTION: Which terms and conditions within this bid package are considered non-negotiable and/or required by law?
ANSWER: The question is broad and does not specify particular terms or conditions for review. Certain requirements, such as those pertaining to prevailing wage, drug-free workplace, tax compliance, equal opportunity, ADA, insurance, and compliance with applicable federal, state, and local laws, are likely mandated and cannot be altered.
4. QUESTION: If a potential bidder is unable to accept all of your terms and conditions, what is the process to negotiate terms? Is there a proactive process available, or must negotiations be initiated upon award?
ANSWER: If the lowest responsive and responsible bidder is unable to accept all of the City’s general terms and conditions, the bidder shall submit their redlined exceptions along with their offer to contract. After bid opening, the City will review the exceptions and negotiate before proceeding to award. If the requested exceptions are not in the best interest of the City, the bidder may be deemed non-responsive.
5. QUESTION: What is the process for bidders to obtain bidding results after the bid has closed? Will a detailed bid tabulation be provided once contract is awarded?
ANSWER: After the bid has been opened and the City has reviewed all bids, a bid tabulation will be posted on DemandStar before proceeding to award.
Bidders shall acknowledge this Addendum #1 in the Offer to Contract.
