About this file
This addendum to Bid Invitation 3152-27 is issued by the New Hampshire Department of Administrative Services, Division of Procurement and Support Services, addressing bidder inquiries regarding firm electricity supply services. The addendum, dated September 23, 2026, clarifies three substantive questions submitted by prospective bidders prior to the bid closing on September 29, 2026 at 12:00 PM Eastern Time. The State will procure approximately 93,183 MWh annually across four Local Distribution Company service territories, with contract terms of 12, 24, or 36 months commencing November 1, 2026. The procurement operates in two phases, with Phase 1 (Qualification Statement Submissions) closed on September 16, 2026, and Phase 2 (Pricing Submissions) closing September 29, 2026 at 12:00 PM, when pricing will be locked in at 3:00 PM. The contract may be extended up to two additional one-year terms, not to exceed five years total.
The addendum clarifies that ISO-NE's Capacity Auction Reforms project, effective June 1, 2028, will be treated as a pass-through cost for contracts extending beyond June 30, 2028, allowing suppliers to bilaterally pass through capacity cost changes to the State for both increases and decreases. Additionally, the State confirmed that Certificates of Insurance should list the vendor's organization and address, not the State of New Hampshire as a named insured. The State also clarified that Confidentiality and Nondisclosure Agreements and Release of Criminal Record Authorization forms are not required, as the resulting contracts will not involve on-site work at State facilities. Pricing must remain firm for the entire contract term and include energy, capacity, ancillary services, ISO costs, transmission losses, and renewable portfolio standards compliance as fixed costs. All changes noted in this addendum supersede previously submitted documents and must be submitted with the bid.

Date of Change: September 23, 2026
ADDENDUM # 01 TO BID INVITATION 3152-27
DATE AND TIME OF BID CLOSING: 9/29/2026 12:00 PM
FOR: Firm Electricity Supply Services
Question 1: ISO-NE's Capacity Auction Reforms (CAR) project proposes replacing the current 3-year capacity auction structure with a prompt 1-year or seasonal structure beginning 6/1/2028. Can the State of NH confirm that bidders may treat this as a Change in Law, allowing suppliers to bilaterally pass through any resulting capacity cost changes after 6/1/2028?
State Response: Any awarded contracts whose term ends prior to 6/30/2028 would not be affected by this provision. For any contracts whose term extends past the 6/30/2028 date, the bidders shall notify the State as to whether or not they will treat the ISO-NE Auction Reform Project as a pass-through cost. If so, this would apply to both increases and decreases in capacity costs.
Question 2: Please advise if Certificate of Insurance (17.2.6.1.5) should list the State of New Hampshire as a named insured?
State Response: No, the State of New Hampshire should not be named as insured. The insured block on the Certificate of Insurance should list the vendor’s organization and address.
Question 3: Please provide the forms you would like to use for “Confidentiality and Nondisclosure Agreement” and “Release of Criminal Record Authorization” so we can sign and return these to you promptly.
State Response: This provision applies to on-site work at State facilities. Any resulting contracts from this bid will not have vendors work on-site at any State facility.
