About this file
This is Addendum 3 to a solicitation issued by the West Virginia Department of Environmental Protection (DEP) for a federal multi-well plugging contract covering operations in Wirt and Ritchie Counties. The addendum addresses vendor questions and responses regarding project requirements and does not modify the bid opening date, specifications, or other core solicitation terms. Key clarifications include requirements for tree removal disposal, Davis-Bacon Act wage determinations to be published by December 30, 2025, and insurance requirements specifying that contractors must carry Contractor's Public Liability Insurance and Comprehensive Vehicle Liability Insurance in amounts not less than $2,000,000 for bodily injury and property damage for each occurrence and $2,000,000 aggregate. The solicitation number is ARFQ DEP2600000056, and vendors must acknowledge receipt of all addenda with their bids to avoid disqualification.
The project is funded through the Infrastructure Investment and Jobs Act (IIJA) and therefore mandates compliance with the Build America, Buy America Act (BABA), requiring that all iron, steel, manufactured products, and construction materials used become permanent parts of the well structure be produced in the United States. Materials such as well casing must meet BABA requirements, though cement is exempt. Contractors may be required to submit a road bond of $50,000 to the Department of Highways as part of the permitting process for right-of-way entry. All tree removal from parcel 43-05-0046-0014-0001 must be disposed of off-site unless alternative arrangements are made directly with the landowner. Current wage rates for Ritchie and Wirt Counties are available on sam.gov pending publication of formal Davis-Bacon Act wage determinations.

FEDERAL MULTI-WELL PLUGGING CONTRACT - WIRT & RITCHIE
Q1: If trees are removed to build a well site or an access road for plugging the wells with API numbers 47-085-10546 and 47-085-10570, what should be done with the limbs, logs, and stumps?
A1: All parts of any trees that are removed from this parcel, 43-05-0046-0014- 0001, must be disposed of off site, unless other arrangements are made with the landowner.
Q2: This solicitation includes a reference that Buy American applies “where applicable”. Can the State clarify whether the Build America, Buy America Act is applicable to this submittal?
A2: The State clarifies that the Build America, Buy America Act (BABA) is applicable to this solicitation. This project is funded via the Infrastructure Investment and Jobs Act (IIJA), which mandates that all iron, steel, manufactured products, and construction materials used in the project be produced in the United States.
Bidders must ensure their supply chains and sub-contractors comply with these requirements and be prepared to submit relevant certifications upon request. In this contract, BABA would most likely apply to any materials which will become a permanent part of the well structure. For example, if a string of casing would need to be installed in the well, it would have to meet BABA requirements (i.e., made in the USA). Note that cement itself is exempt from BABA.
Q3: The instructions T&Cs reference professional liability insurance premiums in Section 35. Vendor Relationship. Will the Contractor be required to carry professional liability insurance for this award? If so, can the State please identify the limits of liability required?
A3: The Contractor must possess Contractor’s Public Liability Insurance and Comprehensive Vehicle Liability Insurance in the amounts not less than $2,000,000.00 for bodily injury and property damage for each occurrence and $2,000,000.00 aggregate.
Q4: Can the State please provide a copy of the Davis-Bacon Act Wage Determination that applies to this solicitation?
A4: Wage determinations will be published 12/30/2025 to meet the 10-day solicitation closure requirement that is associated with DBA-eligible contracts. In the meantime, contractors can look at sam.gov to find current wage rates for Ritchie and Wirt Counties.

Q5: Technical Specifications, 3.1.2.2 Right of Way Entry Permit includes a note that states, “As part of the permitting process, the Contractor may be required to submit a bond in the amount of fifty thousand dollars ($50,000).” Can the State identify if this will be a Road Bond, and if it will be applicable to the Contract at or after award?
A5: The road bond is required as part of the DOH permitting process. It will need to be provided to DOH at the time their applicable permit applications are submitted.
