PERFORMANCE WORK STATEMENT (PWS)

Naval Special Warfare Group FOUR

SWCC Pillar Courses of Instruction (COI)

1. BACKGROUND

1.1. Naval Special Warfare (NSW) requires contractor support to deliver United States Coast Guard

(USCG) approved training courses. These courses of instruction (COIs) enable personnel to obtain higher level education and training and become professional mariners. The contractor shall include comprehensive classroom maritime COIs to ensure NSW personnel are well-prepared for advanced navigational responsibilities. Additionally, the contractor will provide training in accordance with the Standards of Training, Certification, and Watchkeeping (STCW) requirements to ensure all personnel meet maritime standards for basic safety and proficiency.

These courses are vital to NSW maintaining dominance in maritime special operations worldwide.

1.1.1. USCG approved training courses are essential to NSW craft operations, as it demonstrates that the individual has attended advanced level maritime training courses with standards set by maritime authorities. These advanced education and training courses provide the required knowledge skills to operate NSW craft safely, efficiently, and professionally while understanding and adhering to both national and international maritime navigational regulations. These maritime navigation education and training courses reassure combatant commanders that the NSW craft are operated by qualified NSW Special Boat Operators, which can reduce mission risk and increase mission success. Additionally, many regions mandate this education and training for vessel operations, ensuring compliance with maritime laws and enhancing overall safety on the water.

2. OBJECTIVES

2.1. The contractor will ensure seats in comprehensive courses of instruction at contractor locations covering Para. 4 in this PWS. Contracted tuition/attendance in professional maritime training courses will provide compliant USCG Standards of Training, and Maritime Watchkeeping (STCW) requirements.

3. SCOPE

3.1. The contractor shall ensure identified number of NSW SWCC personnel attendance in professional maritime education and training courses as required in para 4. of this PWS.

3.1.1. Course pricing under this contract shall include all expenses for attending courses. The

Government will not provide building locations to conduct training.

3.1.2. The intent of the contract is for Government personnel to join prior established commercial courses of instruction. Dedicated instructors and dedicated course dates to support requirements is not a mandatory element of this contract.

3.2. Other customized courses of instruction, related to similar type of training expressed in this document, may be negotiated at the task order level and may be incorporated into any resulting basic contract.

3.2.1. The Government reserves the right to incorporate on-line courses into any resulting contract through bilateral modification. Addition of on-line course may require various security reviews and considerations. Contractor shall comply with any request in support of above-mentioned reviews/considerations.

4. REQUIREMENTS

4.1. General Requirements.

4.1.1. The contractor shall provide attendance/seats in USCG approved schools with comprehensive courses of instruction as detailed in para. 4.2.

4.1.2. Seats in specific courses will be determined by operational requirements and coordinated at the Task Order level.

4.2. Required Course List:

4.2.1. 100T MASTERS: The Contractor shall provide attendance/seats in a 10-day classroom

USCG 100T Masters certified and credentialed course of instruction that meets the intent of

46 CFR 11.301.

4.2.2. RADAR Observer Unlimited. The contractor shall provide attendance/seats in a 5-day classroom USCG RADAR certified and credentialed course of instruction. Course objective is to enable effective and safe use of radar systems for maritime navigation.

Instruct mariners on detection of maritime obstacles, monitoring marine weather, and navigation in low visibility or obstructed visibility, enhancing situational awareness and reducing collision risks.

4.2.3. Celestial as Backup to Loss of GPS. The contractor shall provide attendance/seats in a 5-day classroom USCG celestial navigation certified and credentialed course of instruction.

Course objective is to enable means of learning and executing a position fix at sea when a vessel has lost its GPS navigation and teach celestial navigation theory and practices for safe navigation of a vessel in offshore waters. To equip NSW mariners with the skills needed to determine their position using celestial bodies like the sun, moon, and stars. This navigation method is crucial when electronic systems like Global Positioning System (GPS) fail, enabling mariners to navigate safely over long distances.

4.2.4. USCG Standards of Training, Certification, and Watchkeeping (STCW) for seafarers. The contractor shall provide attendance/seats in a 5-day classroom USCG STCW certified and credentialed course of instruction. Course objective is to ensure compliance with global standards, covers essential safety skills, and is often a legal requirement. It covers crucial training in areas such as firefighting, first aid, survival techniques, and more, preparing mariners for various emergencies.

4.2.5. Other customized/related courses to be negotiated at the task order level.

4.2.6. Minimum attendees per course will be two (2) and maximum attendees per course will be twenty-four (24). Deviation from minimum and maximum attendees shall be negotiated at the task order level.

4.3. Materials

4.3.1. No government furnished property, equipment, or information shall be provided for training.

4.3.2. The contractor shall provide all student handouts, navigation tools, graduation certificates, homework assignments, and workbooks at no additional cost to the Government.

4.3.3. After Action Report: The contractor shall provide a monthly After-Action Report with student information about every COI event and/or task order Report shall include a detailed summary of the COI training provided, course dates/times, student attendees, result of training, and administrative efforts in accordance with 4.2 of this PWS.

4.3.4. Contract Discrepancy Report (CDR). In the event of unsatisfactory Contractor performance, the COR will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service. The Contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the Contractor's corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.

4.4. Progress Meetings

4.4.1. Post-Award Conference. The meeting shall provide the opportunity to discuss course management issues. The Contractor shall be prepared to discuss any contract items requiring clarification and gather information as necessary to support deliverables.

4.4.2. Periodic Progress Meeting(s). The KO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor’s performance. Contractor shall deliver a summary of any requested meetings for three (3) business days after any Periodic Progress Meeting is held.

4.4.3. Meetings shall be at no additional cost to the Government.

4.5. Task Order Issuance

4.5.1. Task orders shall be issued for COIs unilaterally with courses starting fifteen days (or greater) after issuance date of task order.

4.5.2. The Government reserves the right to issue a task order for quarterly, semi-annual or annual COI requirements. If such an order is issued for various numbers of students and COIs, the contractor shall coordinate with the appointed Contracting Officer Representative (COR), or other authorized representative identified by the Contracting Officer in writing, to schedule training dates and time. The Government shall provide the contractor with a fifteen-day advance notice prior to required COIs.

4.5.3. Any timeframes discussed in the above paragraphs may be modified through mutual agreement between the Contracting Officer and the Contractor.

5. DELIVERABLES

5.1. Contractor shall provide deliverables as specified in the IDIQ contract and the PWS. The

Government will be provided with access to current and historical deliverables as well as performance metric data.

6. CONTRACTOR MANPOWER REPORTING

6.1. The Contractor shall report all contractor employee labor hours (including subcontractor labor hours) required for performance of services provided under this contract for Naval Special Warfare Command via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: https://sam.gov/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs from October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year.

7. SECURITY

7.1. Contractor shall establish appropriate administrative, technical, and physical safeguards to protect all nonpublic Government data to ensure the confidentiality, integrity, and availability of Government data.

7.2. Disclosure of Information.

7.2.1. Information made available to the contractor by the government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer. The contractor agrees to assume responsibility for protecting the confidentiality of government records, which are not public information. Each employee of the contractor to whom information may be made available or disclosed shall be notified in writing by the contractor that such information may be disclosed only for a purpose and to the extent authorized herein.

8. SAFETY

8.1. Contractor Responsibility.

8.1.1. Nothing in PWS, nor any Government action or failure to act in performance of the contract shall relieve the contractor of its responsibility for the safety of the contractor's personnel and property, the Government's personnel and property. Furthermore, nothing in this PSW shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

9. QUALITY CONTROL

9.1. The Contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. QCP shall, at a minimum, provide a method for performing inspections; identifying, correcting and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.

10. QUALITY ASSURANCE

10.1. The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will assign a COR who will be responsible for monitoring performance in accordance with the requirements of PWS. The COR is authorized to perform the following functions:

10.1.1. Assure performance of contract requirements.

10.1.2. Perform inspections necessary.

10.1.3. Maintain written and oral communications with the Contractor.

10.1.4. Monitor Contractor's performance.

10.1.5. The COR is not authorized to change any of the terms and conditions of the resulting order.

10.1.6. Contract Discrepancy Report (CDR). 11. PLACE OF PERFORMANCE

11.1. Performance shall occur at contractor training location within a 50-mile radius of following locations:

11.1.1. Virginia Beach, VA

11.1.2. San Diego, CA

11.1.3. Stennis Space Center, MS

11.1.4. Other locations to be negotiated at order level.

12. PERIOD OF PERFORMANCE

12.1. Five-year period of performance with a total of five individual ordering periods.

12.1.1. Contract terms may be extended for an additional six months in accordance with Federal

Acquisition Regulation (FAR) 52.217-8.
