About this file
This is Addendum #6 to an Invitation for Bid (IFB) issued by the California Department of General Services Procurement Division for CAL FIRE Firefighter Helicopters. The solicitation seeks to replace CAL FIRE's fleet of 12 Firefighter Helicopters over the next 5-10 years through a three-year contract with two one-year extension options. Bids are due March 8, 2016 by 2:00 PM PT. The contract will be mandatory for CAL FIRE but available for use by other state departments and participating local agencies. Delivery requirements state the first helicopter must be delivered within 360 days after receipt of order, with subsequent helicopters having similar timeframes. The contract includes requirements for pre-work conferences, mid-point inspections, and final inspections.
The pricing structure requires bidders to provide per-year pricing over the three-year contract term using the provided pricing worksheet. Two payment options are offered: one-time acceptance payment or progress payments with performance bond. A 5% preference is available for certified small businesses and non-small businesses with 25% small business subcontractor participation. The DVBE participation requirement has been waived, though DVBE incentives still apply. The specific change in this addendum is the correction of year 2 non-mandatory options formulas in Attachment 1 - Cost Worksheets. For local government agency transactions, contractors must remit a 1% incentive fee to the Department of General Services.

3. Upon approved price adjustment, price adjustments will not be accepted for a period of 12 months from the last approved price adjustment effective date.
4. Price adjustment requests must include substantiating documentation including contractor’s identification of a Producer Price Index (PPI) and/or a similar verifiable published index for every item or group of similar items for which a price adjustment is requested.
5. Index identified and adjustment amount must be accepted by the State prior to any price adjustment consideration.
6. Once an index has been agreed upon for a given item the index identified will remain constant for all future price adjustment requests for those line items.
7. Price adjustments may only be requested when the cost of finished products per component based on the index(s) identified has increased no less than five (5) percent.
8. No price increase/decrease shall apply to quantities ordered from the contract prior to the effective date of the price adjustment. No retroactive contract price adjustments will be allowed.

1. Any price adjustment request must be in writing and must be received 30 calendar days prior to the requested adjustment date. If a Contractor fails to request a price adjustment 30 calendar days prior to the requested adjustment date, the price adjustment, if accepted, will be effective within 30 calendar days after the State receives the written request .

3. Price adjustment, if granted, will be made in accordance with the percentage change to the appropriately agreed upon index. The percentage difference between: a) the latest final base index at the time of contract award, and; b) the latest final index issued at the time of the price adjustment request, will determine the maximum allowable adjustment to the current State contract price(s). Only final index data will be used to adjust contract pricing.
Additional price adjustments within the contract term including extensions, if granted, will be made in accordance with the percentage change to the agreed upon index. The percentage difference between: a) the new base index, calculated from the last approved price adjustment effective date, and; b) the latest final index issued at the time of the price adjustment request, will determine the maximum allowable adjustment to the current State contract prices
Upon receipt of such notice, the State reserves the right to:
a. Accept the adjustment as competitive with the general market price at that time; or
b. Negotiate proposed price adjustments. Note: The State will notify the Contractor, in writing, its desire to negotiate. The State will have ten (10) working days to complete negotiations; or
c. Deny adjustment request and continue with current State contract prices; or
d. Cancel the contract’s unpurchased balance without prejudice, effective upon written notice from the State.
Note: If negotiations fail to produce any agreement, the State reserves the right to exercise Options 4a or 4d with an effective date no later than ten (10) working days after unsuccessful negotiation.
C. Price Adjustment Example:
Scenario:
Contract term: 9/1/2008 through 8/31/2011 Allowable adjustment period: 12 months Requested price adjustment period: 9/1/2009 through 8/31/2011 Minimum % change to Index: 3% Current State contract price to be adjusted: $1.68/box Final base Index (May 2008): 175.9 Latest final Index (May 2009): 185.0
Process:
Step Description Calculation
Subtract the final base Index from the latest final Index.
185.0 – 175.9 = 9.1
2 Divide the result by the final base Index: 9.1 / 175.9 = .0517
Multiply the result by 100 to obtain % increase/decrease:
.0517 X 100 = 5.17%
Multiply the current State Contract Price to be adjusted by the % increase/decrease to obtain $ increase/decrease:
$1.68 x .0517 = $.087
Add the $ increase/decrease to current State Contract Price to be adjusted to obtain adjusted price:
$1.68 + $.0868 = $1.7668
Result:
Adjusted price for contract term 9/1/2009 through 8/31/2011 is $1.7668 per box.
21. NON CORE CATALOG PRICING ADJUSTMENTS AND APPENDICES
