About this file

This document is a listing of contract clauses and solicitation provisions for a federal construction contract issued by the Department of Health and Human Services (HHS). The contract incorporates both Federal Acquisition Regulation (FAR) clauses and HHS-specific clauses, with effective dates primarily from November 2025.

The contract includes comprehensive labor standards requirements covering construction wage rates, apprentices and trainees, Copeland Act compliance, payroll documentation, and convict labor prohibitions. Additional clauses address employee protections including whistleblower rights, equal opportunity for workers with disabilities, paid sick leave under Executive Order 13706, and combating trafficking in persons. The contract requires electronic submission of payment requests through the Department of Treasury Invoice Processing Platform (IPP) or successor system, with provisions for written authorization of alternate procedures. Evaluation will use a lowest price technically acceptable approach with a best value tradeoff methodology, where non-price factors combined are significantly more important than price. The solicitation includes a small business set-aside requirement, Buy American provisions for construction materials, site visit requirements, and sustainability and environmental compliance clauses. The contract also incorporates HHS-specific provisions addressing anti-lobbying, equal employment opportunity investigations, safety and health, Indian preference programs, publications and publicity requirements, salary rate limitations, and electronic information and technology accessibility standards.

D.3 FAR 52.212-2, Evaluation-Commercial Products and Commercial Services.

(NOV 2025)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

Lowest Price Technically Acceptable

Price will be evaluated for reasonableness and overall value to the Government.

The Government intends to evaluate proposals using the best value tradeoff approach. Evaluation factors other than price when combined are significantly more important than price.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
