About this file

This Invitation to Negotiate (ITN) document issued by Gainesville Regional Utilities (GRU), a municipal utility owned by the City of Gainesville, Florida, and governed by the Gainesville Regional Utilities Authority (GRUA), solicits proposals from qualified entities to acquire, own, operate, and maintain the Cross Creek Mobile Home Park water and wastewater utility systems located in southeastern Alachua County, Florida. The Cross Creek Systems currently serve approximately 50 customer connections and include potable water wells, treatment, storage and distribution facilities; wastewater collection and treatment facilities; lift stations; drainfield and disposal facilities; easements; and related real property interests. GRU has made significant capital improvements to the water system since assuming ownership in the 1970s, including replacement of the distribution system, wells, and pumping equipment, while constructing the wastewater collection system in 1989 with substantial upgrades completed in 2008. The water system is fully operational; however, the wastewater system's drainfield is currently non-functional, with GRU temporarily transporting wastewater via tanker trucks to its Gainesville system on a weekly basis. The ITN was released on September 3, 2026, with a non-mandatory pre-proposal meeting scheduled for September 21, 2026, at 9:30 a.m. at Cross Creek Mobile Home Park. Questions must be submitted by October 16, 2026, at 5:00 p.m., and proposals are due by November 3, 2026, at 2:00 p.m. via the GRU e-Procurement Portal. Respondents must submit proposals of a maximum of 34 pages addressing basic response information, utility operations experience and capability, financial capacity, transition plans, economic considerations, and references.

GRU seeks to transfer the systems to a qualified operator with experience, resources, and operational capabilities to cost-effectively manage remote utility systems while maintaining reliable service and regulatory compliance. Respondents may propose any transaction structure reasonably designed to achieve the ITN objectives, including alternative arrangements such as phased ownership transfers or management agreements leading to ownership. Evaluation criteria are weighted as follows: Economic Consideration (35 points), Utility Operations Experience & Capability (25 points), Financial Capacity (20 points), and Transition Plan (20 points), for a total possible score of 100 points. Respondents must demonstrate ability to conduct utility system business in Florida with demonstrated experience owning and operating comparable systems, along with financial capacity and resources to acquire and maintain the Cross Creek Systems. The successful Respondent will be responsible for obtaining all required approvals from the Florida Department of Environmental Protection (FDEP), Florida Public Service Commission (PSC), and other applicable governmental entities. GRU reserves the right to negotiate with one or more responsive and responsible respondents, request best and final offers, conduct interviews and presentations, or reject all proposals. No contract shall exist until approved by GRUA and fully executed by all required parties.

1. BACKGROUND

1.1. Background

The Cross Creek Water and Wastewater Utility Systems (Cross Creek Systems) serve approximately 50 customer connections in the Cross Creek Mobile Home Park located in southeastern Alachua County.

The systems include, without limitation:

(a) potable water wells, treatment, storage, and distribution facilities;

(b) wastewater collection and treatment facilities;

(c) lift station and conveyance facilities;

(d) drainfield and disposal facilities;

(e) easements, rights-of-way, real property interests owned by Gainesville Regional Utilities (GRU) and utilized in connection with utility operations;

(F) customer service records, operational records, and utility asset information; and

(G) such additional assets as may be identified during the negotiation process.

The water/wastewater system was originally privately owned and operated until the 1970s, when GRU's predecessor in interest assumed ownership and operational responsibility at the request of local authorities. Since that time, GRU has made significant capital improvements to the water system, including the replacement of the water distribution system, wells, and pumping equipment, as described in the appendices.

GRU constructed the wastewater collection and treatment system in 1989 and completed substantial upgrades in 2008. GRU currently owns, operates, and maintains both the water and wastewater systems and provides utility service to customers at the same residential rates charged to other GRU residential customers.

Both utility systems are currently operated in compliance with applicable environmental and public health regulations. The water system is fully operational and continues to provide service to Cross Creek customers.

The wastewater system’s drainfield is currently non-functional. As a temporary operational measure, GRU transports wastewater from the Cross Creek wastewater system to GRU’s Gainesville wastewater system on a weekly basis using tanker trucks.

GRU has determined that, due to the nature and geographic location of the Cross Creek Systems, GRU is not well positioned to cost-effectively operate and maintain remote utility systems located outside of its primary service area.

Accordingly, GRU seeks to transfer ownership and operational responsibility of the Cross Creek Systems to a qualified utility operator with the experience, resources, and operational capabilities necessary to effectively manage similar utility systems while continuing to provide reliable service, maintain regulatory compliance, and protect the interests of customers served by the systems.

The information provided in this solicitation is for informational purposes only and is not intended to constitute a warranty or representation by GRU regarding the condition, capacity, performance, adequacy or suitability of the utility systems or associated assets.
