About this file
This document is a draft Request for Proposal (RFP) for Legal Services for Unaccompanied Alien Children (UAC). The government will evaluate proposals based on three primary factors: Quality (most important), Past Performance (second most important), and Cost (least important). Quality factors include a trauma-informed service delivery model, pro bono integration plan, scalability, management and staffing, and data collection capabilities. Offerors must demonstrate a comprehensive approach to providing legal services, including remote service delivery, multilingual access, universal representation, and a strategy to meet or exceed the 20% pro bono representation requirement.
Past performance evaluation will focus on the offeror's experience delivering legal services to vulnerable populations, particularly children and immigrants. Specific areas of assessment include prior contract experience, successful legal outcomes, pro bono network effectiveness, compliance with regulations, and responsiveness to oversight. Cost will be evaluated for reasonableness, efficient use of federal funds, and incorporation of non-federal resources. The document is explicitly marked as a draft, with clear warnings that proposals will not be accepted in response to this version and that the contents are subject to change in a subsequent solicitation release.

Draft Evaluation Factors: Legal Services for Unaccompanied Alien Children (UAC)
In making a best value determination, the Government will consider Quality, Past Performance, and Price. Below are the anticipated evaluation factors. However, it is cautioned that these factors along with their relative importance not final and are subject to change prior to the release of a final solicitation. The release of these factors with the draft Performance Work Statement (PWS) is to promote advanced awareness and understanding of the factors the Government may value in a final solicitation.
Please note: Proposals will not be accepted or evaluated in response to the draft notice, and the contents of this document are subject to change in the subsequent release of a solicitation..
1. Quality Factors
(Most Important Factor) The Government anticipates evaluating the Offeror’s overall approach to delivering high-quality legal services to UAC in accordance with the PWS. This includes:
a. Service Delivery Model
A trauma-informed, culturally competent, and developmentally appropriate approach to providing legal orientations, consultations, and direct representation.
Use of remote service delivery, multilingual access, and innovative tools to reach children in care and post-release.
Commitment to universal representation and continuity of services across transfers and post-release.
b. Pro Bono Integration
A clear and feasible plan to meet or exceed the 20% pro bono representation requirement.
Strategies for recruiting, training, mentoring, and supervising pro-bono attorneys.
Mechanisms for tracking pro bono engagement and ensuring quality of service.
Demonstrated ability to leverage pro bono resources to expand capacity and reduce reliance on federal funds.
c. Scalability and Transition-In Readiness
Demonstrated ability to scale services in response to fluctuating UAC referrals, including surge events and new facility activations.
A transition-in plan that ensures full operational readiness, within the specified timeframe, of award.

d. Management and Staffing
A sound organizational structure and staffing plan to recruit, retain, and manage qualified attorneys, DOJ-accredited representatives, and support staff.
Internal controls, supervision, and quality assurance mechanisms.
e. Data Collection and Reporting
A secure and scalable infrastructure for collecting and reporting service-level data, including pro bono metrics, case outcomes, and post-release tracking.
Use of data to support program oversight, performance monitoring, and continuous improvement.
Compliance with PWS Section 5.4 and ORR reporting requirements.
2. Past Performance
(Second Most Important Factor) The Government anticipates assessing the relevance and quality of the Offeror’s past performance in delivering legal services to vulnerable populations, particularly children and immigrants. Evaluation will consider:
Experience with similar federal, state, or nonprofit contracts.
Demonstrated success in achieving favorable legal outcomes.
Effective use of pro bono networks in prior engagements.
History of compliance with contract requirements, ethical standards, and federal regulations.
Responsiveness to oversight and corrective actions, if applicable.
3. Cost
(Less Important than Quality and Past Performance) While cost will be considered, it is not anticipated to be the primary basis for award. The Government will evaluate:
Reasonableness in relation to the proposed approach.
Efficient use of federal funds.
Use of non-federal resources (e.g., in-kind contributions, pro-bono, or volunteer support).
