About this file

This is an ACDBE-N (Airport Concession Disadvantaged Business Enterprise - Neutral) Pre-Award Concession Revenue Contract Solicitation Clause document issued by the City of Phoenix Aviation Department and administered by the City of Phoenix Equal Opportunity Department. The clause establishes the regulatory framework and requirements for retail concession operations at Phoenix Sky Harbor International Airport, specifically addressing two retail concession packages in Terminal 3 North 2 Concourse: Package 1 is a News, Gift, and Convenience Store comprising 3,202 square feet in space N2-R1, and Package 2 is a Specialty Retail Boutique-Style Store comprising 1,198 square feet in space N2-R2. Successful respondents will enter into Concession Lease Agreements with the City and are responsible for developing, operating, and managing their assigned retail spaces. The solicitation requires respondents to submit sealed responses through the City's Procurement Portal, with detailed specifications and draft lease terms provided as attachments. The contract is subject to federal USDOT regulations under 49 CFR Parts 23 and 26, and the term extends until the end of the lease period or upon termination per agreement provisions.

All respondents, regardless of size, must comply with small business outreach requirements and submit three pre-award forms at time of submittal: Form EO1-200 (Statement of Outreach Commitment), Form EO2-200 (Participants List and Small Business Outreach Efforts), and Form EO3-200 (Small Business Utilization Commitment). While no mandatory ACDBE or small business participation goals are established for this lease, the City strongly encourages small business utilization and requires documented outreach efforts, including identification of subcontracting opportunities, active solicitation of small business proposals, evaluation of proposals, and communication of selection decisions. Post-award, successful respondents must execute contracts with identified small businesses, maintain a Small Business Participation Plan updated annually on the lease anniversary, and report monthly revenue and small business payment data through the City's Certification and Compliance System at phoenix.gob2g.com. Respondents must maintain records for a minimum of three years and comply with all nondiscrimination and civil rights assurances per Title VI of the Civil Rights Act of 1964 and federal transportation regulations. Failure to submit required small business outreach documentation or meet outreach requirements may result in a non-responsive determination and disqualification from further consideration.
