About this file

This document is a U.S. Army Contracting Command-Aberdeen Proving Ground (ACC-APG) Industry Update presentation from 4 September 2025, providing comprehensive information about upcoming contract opportunities across multiple divisions. The presentation covers new opportunities across Divisions A, B, C, D, and the Installation & Technology Division, with estimated contract values ranging from $3M to $600M. Key opportunities include the Deployable Communications Capabilities System (DCCS), Next Generation Mounted Assured Positioning Navigation and Timing (A-PNT) system, C5ISR Cyber Security Division Support Services (CYBERTRON), and various support services contracts.

The presentation also highlights the Army Open Solicitation (W9128Z-25-S-A002), which offers two solution discovery methods: Call for Solutions and Active Capability Gap. It provides insights into the Army's approach to intellectual property rights through phased IP conveyance, aiming to balance contractors' proprietary concerns with military readiness needs. The document emphasizes strategic public-private partnerships, leveraging industry expertise, and gradually developing government capacity to manage critical technologies. Specific contract opportunities span areas like communications, positioning/navigation, electronic warfare, intelligence systems, and installation support services, with anticipated award dates ranging from Q2 to Q4 of Fiscal Year 2026.

Phased Intellectual Property Conveyance:

Harmonizing Innovation and Readiness

Michael Gomes Director, Contracting Operations

ACC-APG

Total Lifecycle Considerations for Contracting

Licenses

• Separately priced CLINs, evaluation factor, long-term contract, pooling, surge, range pricing based on usage/vendor price points

Public-Private Partnership (P3)

• Arrangement between SEC or TYAD and industry or PEOs to perform support

Phased IP Conveyance

• After set period of time (phases) or a specified investment threshold, specified parts/software transfer to Government with greater rights

Data Escrow Account

• An account, controlled by a third party, for holding data (i.e. source code, tech drawings) for disbursement under special conditions like going out of business

Warranties

• Written guarantee, issued to the government, promising to fix software within a specified period of time 1, 5, 10 years

Purchase Data Rights

• Data rights strategy where documentation and rights are obtained sufficient to support competition or organic sustainment(limited is an option)

Contractor Proposed Organic Sustainment Implementation Plan

• Contractor proposed plan and associated data rights to be able to perform sustainment s organically that is evaluated with award

Technical Data Package (TDP)

• A description of an item adequate for supporting an acquisition, production, engineering, and logistics support (e.g.

Engineering Data for Provisioning, Training, and Technical Manuals)

Long Term Contracts

• Contract duration of 10 years providing for competitive pricing up to 15 years

Evaluation Factor

• Leverage competition to drive down sustainment costs by evaluating proposed sustainment elements

The Phased IP Conveyance Approach

Phased IP conveyance offers an agile, pragmatic solution to data rights allocation by aligning them with the government's level of investment. In this approach:

Initial Rights

Government begins with limited or restricted rights

Investment Milestones

Precise funding thresholds are established (e.g., $100M investment)

Progressive Rights

Rights expand to government purpose rights as investment increases

Full Conveyance

Expanded rights achieved at predetermined investment level

The IP Rights Dilemma in Defense Acquisition

Government Challenge

The Department of Defense struggles to procure advanced technologies while ensuring long-term economic viability of acquisitions.

Contractor Concerns

Traditional IP license negotiations fail to balance contractors' proprietary data concerns with military readiness needs.

Resulting Problems

This imbalance drives up costs, restricts competition, and creates dependencies long after technology value has peaked.

A pragmatic approach for specially negotiated license rights (SNLR) is urgently needed to respect IP rights, steward taxpayer dollars, and enable high military readiness.

Strategic Public-Private Partnerships

Through phased IP conveyance and strategic public-private partnership (P3) agreements, the government can:

• Leverage knowledge and expertise of private industry

• Gradually develop capacity to manage, maintain, and evolve key critical technologies

• Meet sustainment and readiness objectives

• Transition from dependency on sole-source providers to innovation and co-resilience

This approach aligns the interests of both parties while ensuring the government can maintain operational readiness at fair and reasonable prices.

Cultivating a Sustainable Innovation Ecosystem

Innovation

Industry develops cutting-edge technologies

Investment

Government provides funding and acquires progressive rights

Collaboration

Knowledge transfer and capability development

Sustainability

Long-term viability and readiness achieved

By nurturing this collaborative ecosystem through SNLRs such as phased IP conveyance, the government ensures the longevity of vital national security assets and cultivates a sustainable economy of innovation, progress, and capability development that benefits all stakeholders.
