(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

FAR 52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under

PAGE 15 OF 96 AB-133F-16-RP-0032

the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of $9,950,000.00;

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

FAR 52.216-22 INDEFINITE QUANTITY (OCT 1995)

(c) The Contractor must assert its right to an adjustment under this clause within 30 days from the date of receipt of the written order. However, if the Contracting Officer decides that the facts

justify it, the Contracting Officer may receive and act upon a proposal submitted before final payment of the contract.

(d) If the Contractor’s proposal includes the cost of property made obsolete or excess by the change, the Contracting Officer shall have the right to prescribe the manner of the disposition of the property.

(e) Failure to agree to any adjustment shall be a dispute under the Disputes clause. However, nothing in this clause shall excuse the Contractor from proceeding with the contract as changed.

FISH ECOLOGY SCIENTIFIC SUPPOERT SERVICES

D.1.1 PERFORMANCE WORK STATEMENT/SPECIFICATIONS

The Contractor shall furnish the necessary personnel, material, equipment, and services (except as otherwise specified), to perform the following Performance Work Statement (PWS)/Specifications.

D.1.2 BACKGROUND

A major component of the scientific program of the Fish Ecology (FE) Division, Northwest Fisheries Science Center (NWFSC) is research directed at improving survival of Pacific salmon as they migrate to and from the ocean. The development of the Federal Columbia River Hydropower System and the construction of numerous dams in the Columbia River Basin, along with major agricultural changes in water and land management in the region, have become major obstacles to both juvenile and adult salmon migrations. This has significantly impacted natural fish production and has threatened the existence of many populations. Multiple stocks of Snake and Columbia River salmon and steelhead are currently listed as threatened or endangered under the Endangered Species Act of 1973 (ESA; 16 U.S.C. § 1531 et seq.)

FE Division conducts research at dams, on boats in the Columbia River or in Puget Sound estuaries, and in remote stream locations. Work is also conducted in offices or in workshops where staff work on vessels or operate fabrication machinery. The field work phases of the research projects mainly occur during the spring and summer periods when juvenile and adult salmonids migrate. Some of these studies require large numbers of temporary and intermittent staff, including fishery biologists, technicians, and vessel and equipment operators to carry out their complex design.
