PERFORMANCE WORK STATEMENT (PWS)

For Sample Task Order Regional QAR Services MATOC

XYZ REPLACE FIELD OFFICE, REPAIR DOCK, AND DREDGING

Task Order WYYYYXXFXXXX Regional QAR Services MATOC WYYYYXXDXXXX January 19, 2023

1.0 General.

This is a non-personal services task order against the Regional Quality Assurance Representative (QAR) Services Multiple Award Task Order Contract (MATOC). This task order is intended to be used for selection of the MATOC awardees.

The scope and features of this task order are fictional and intended only for source selection purposes; each offeror is to prepare and submit a price proposal (Volume II) that reflects that offeror’s pricing for the PWS herein. This Sample Task Order does not include a copy of the contract documents against which the QAR Services are to be provided; future task orders will typically include reference to, or attachment thereof, contract plans and specifications against which QAR services will be provided. This Sample Task Order has included enough information to adequately price the intended fictional services.

This task order is also intended to provide an example format for purposes of future task order templating and development. Future task orders may reflect the content, structure, or format of this seed task order; however, it is the intent that task orders be developed in a manner that each consecutive task order accounts for lessons learned within the authoring of the previous task orders.

The Government shall not supervise, direct, or have any direct control over the Contractor’s personnel.

For purposes of clarification, the term “construction contractor” shall mean the entity performing the construction contract. The term “contractor” refers to the entity responsible for this contract, WYYYYXXFXXXX.

1.1 Project Description and Background.

The work requiring quality assurance services has been contracted with a construction contractor under contract number W9127N20DXXXX.. QAR services are required to verify the quality of the work performed by the construction contractor performing this construction contract which is entitled XYZ REPLACE FIELD OFFICE, REPAIR DOCK, AND DREDGING. The work requiring QAR services includes:

(1) Replacement of an existing field office (constructed in 1963 at 11.75 Mean Lower Low Water) with a new, modular building field office of comparable size (approximately 1,500 square feet) on an elevated foundation to raise the office approximately 4 feet above the 100 year flood plain. The elevated foundation will be achieved using pilings and must comply with Zone V guidance. Site work and limited site improvements, including replacement of the five stall asphalt parking lot and concrete walkways. Local noise and construction ordinances limit construction operations to 10 hours per day between the hours of 7 am and 5 pm, 6 days per week (Sunday no work is permitted).

(2) Repair of the existing dock structure that is immediately adjacent to, and serves, the field office noted above. Repair consists of removal, disposal, and replacement of three dolphin structures (each the same 3-piles ‘tripod’ of 24” diameter steel) and removal, disposal, and replacement of the floating dock attached to the existing gangway. The floating dock is eighty feet in length, comprised of four (4) – 20 foot by 8 foot sections. Similar to above, construction operations are limited to 10 hours per day between the hours of 7 am and 5 pm, 6 days per week (Sunday is no work is permitted).

(3) Dredging of the channel immediately adjacent to the dock that serves the field office. Dredging of the channel will be performed by the third party contractor utilizing a mechanical dredging plant to remove material designated via pay prisms within the third party contract. The mechanical dredging plant is anticipated to consist of a floating plant that consists of a barge, tug(s), and barge with clamshell dredge type plant, at a minimum. Depth of dredging varies and will be designated within the pay prisms. Material to be removed is approximately 75,000 cubic yards. Material will be removed and placed at a designated ocean placement location. Dredge operations are limited to 8 hours per day, 7 days per week primarily to provide for recreational and ecological periods during the work.

1.2 Place of Performance.

The above project will take place at a work site no more than a 30 minute (approximately 20 miles) drive from Coos Bay, Oregon. Coos Bay, Oregon is located on the southern west coast of the State of Oregon, refer to Figure F1 Overview of Project Location. Figure F2 Area of XYZ QAR Services provides a general overview of the site where the QAR services are to take place monitoring the construction contractor. Coos Bay, Oregon has common commercial services available and is expected to be the place where QAR services will utilize commercially available lodging and per diem rates.

1.3 Period of Performance and Specific QAR Services.

The Period of Performance (POP) will be July 10, 2023, to October 27, 2023 with specific services required as per below (and reflective of the construction contractors schedule). Note that the anticipated contractor workdays are limited by the hours and days noted under paragraph 1.1 above.

(1) QAR services for replacement of the field office will be required for a period of eight weeks, from July 10, 2023, through end of day on September 1, 2023. The construction contractor is working within the hours permitted by local ordinances as noted in the above paragraphs. QAR services are to be provided by a QAR II individual as specified in the MATOC PWS for the period of July 10, 2023, through end of day on September 1, 2023. QAR services are to be additionally supplemented, by a separate, Electrical/Mechanical QAR II individual to validate HVAC and electrical work for a period from August 14, 2023, through end of day on August 18, 2023. QAR services are to be additionally supplemented by a separate, Commissioning QAR Specialist individual for a period of August 28, 2023, through end of day on September 1, 2023, for purposes of building commissioning activities.

(2) QAR services for the repair of the existing dock structure will be required for a period of three weeks, from September 11, 2023, through end of day on September 29, 2023. The construction contractor is working within the hours permitted by local ordinances as noted in the above paragraphs. QAR services are to be provided by a QAR III and will be an individual separate from those noted in the above subparagraph 1.3(1).

(3) QAR services for dredging of the channel will be required for a period of three weeks, from October 2, 2023, through end of day on October 20, 2023. The construction contractor is working within the hours permitted by local ordinances as noted in the above paragraphs. QAR services are to be provided by a Dredge QAR II and will be an individual separate from those noted in the above subparagraphs 1.3(1) and 1.3(2). The construction contractor will work on October 9, 2023, and the QAR services are to be provided on this Federal holiday. Occasional breaks in work of up to 3 calendar days or more in length may occur/be required as determined by the dredging contractor’s schedule. QAR services work may not be necessary when opposing weather elements or mechanical breakdowns cause dredging work to be suspended. These instances will be handled on a case-by-case basis by the COR and Contracting Officer.

1.4 Work Hours.

QAR services provided under this task order are not to exceed 48 hours in a seven day work week. Each workday will be a maximum of 8 hours, which does not include lunch period. The work week will not be more than Monday – Saturday, with a maximum of 8 hours each day. The construction contractor may be working hours longer than that provided by the QAR services. All hours in excess of 40 hours per week are considered overtime. All overtime, outside of that described herein, shall be coordinated in advance with the Contracting Officer Representative (COR). In the event of extended or unanticipated (e.g., weather related) work schedules by the construction contractor, the COR may alter the work schedule to include shift work and/or weekend work.

1.5 Additional Considerations.

Fatigue management must be considered when scheduling personnel (reference the USACE Safety Manual, EM 385-1-1).

1.6 On-site Transportation.

One vehicle per QAR is anticipated under this task order given the proximity of the work site to available, community services such as lodging and food. Daily vehicle miles are not to exceed 90 miles per workday.

2.0 General Quality Assurance Services Requirements

2.1 Government Personnel & Points of Contact.

Contracting Officer (KO). None, as this is a sample task order utilized for source selection.

Contracting Officer’s Representative (COR). None, as this is a sample task order utilized for source selection.

Task Order Point of Contact (POC). None, as this is a sample task order utilized for source selection.

2.2 Post Award Conference.

Approximately one week following task order award, the Government will convene a conference to provide a forum for mutual understanding and discussion of the QAR services to be provided under this task order.

2.3 Special Contractor Furnished Items and Services.

The contractor is not required to provide special or additional items and services under this task order, beyond those required by the contractor in the base MATOC.

2.4 Government Furnished Items.

The construction contractor is required to provide an office within one of their job-site trailers. The office will have a door with a lock and be at least 100 square feet in size. The office will be provided with a desk, chair, a filing cabinet, printer, fax, and office supplies. All other items are to be provided by the contractor in performance of the QAR services as per the base contract.

3.0 Contractor Personnel.

3.1 Special or Additional Contractor Training.

For Dredge QARs requested under this task order, each individual will be required to attend a Dredge Orientation Class, no longer than 4 hours, with Government personnel, providing specific discussion and training on how Portland District provides oversight of construction contractors providing dredging services. This session is not intended to augment an individual QAR’s experience or education as a qualified dredging QAR. This session is instead to provide a forum for discussion and establish the common manner in which Portland District seeks to best practice dredging contract QA. This class will be provided on a video conference call one time, approximately one week prior to the expressed onsite date for Dredge QAR II to begin services. Separate payment for attendance to this session will not be made; costs are to be included in each of the Dredge QARs anticipated under this task order.

3.2 Contractor QAR Positions

As stated above under paragraph 1.3 Period of Performance and Specific QAR Services, QAR services are to be provided by the following qualified individuals in the amount and timeframe noted previously:

Dredge QAR II

The contractor is to provide QAR services with individuals qualified in the above roles, for the duration of the work periods described. It is the contractor’s responsibility to follow all applicable state and federal labor laws in providing the required QAR services with qualified individuals.

3.2.1 Submission of Qualifications of QAR

As soon as possible, but not less than 30 calendar days prior to the start of services for each role listed above, provide a resume and documentation providing evidence that an individual is qualified to fulfill the role they have been designated for. The Government reserves the right to reject the individuals submitted under this task order if their qualifications do not demonstrate the minimum required skillset for the role as defined in the base MATOC.

3.3 Specific Task Order Tasks

The contractor shall perform the following in addition to those duties and tasks noted in the base MATOC.

3.3.1 Plans and Specifications

(1) The Contractor shall be thoroughly familiar with all the provisions of the construction contract documents, including submittals, changes to the plans and specifications, and all revisions and amendments.

(2) The Contractor shall attend a Post Award conference in which the administrative policies of the COR/Resident/Project Engineer will be discussed.

3.3.2 Submittals

(1) Monitor the construction contractor’s quality control system to assure that submittals are timely, appropriately reviewed, certified, comply with the terms and conditions of the prime contract.

(2) Review the construction contractor's submittals for completeness and correctness. The contractor shall review and monitor all submittals in connection with project contract requirements.

3.3.3 Implementation, Verification, and Inspection

During construction, the following activities shall be performed:

(1) Verify adequacy and calibration of test equipment, application of specified test standards and computation of test results.

(2) Spot check CQC approved submittals.

(3) Review construction contractor's daily quality control reports (QCR) to assure that they adequately document his/her quality control operations. Compare to QA Reports and report discrepancies to COR.

(4) Participate in the three-phase control process as necessary to verify that the construction contractor is adequately conducting the required control processes. Attendance at a majority of the preparatory and initial-phase meetings including mechanical, electrical and critical features (i.e., roofing and waterproofing) is required. Verify that the construction contractor prepares minutes of each preparatory and initial meeting and includes highlights of each control phase on the daily CQC report.

(5) Monitor the construction contractor's procedures for tracking construction deficiencies to verify acceptable corrective action and that an audit trail is maintained.

(6) Perform inspections and investigations, collecting data, and completing reports to document findings.

(7) Complete site visits to projects assigned.

(8) Complete daily reports for each date per site, maintaining a daily diary for each day work is performed. The contents of the form shall be brief, with accurate statements of testing, results and pertinent conditions encountered during the inspection. Editorial comments are not to be incorporated in forms or on any written correspondence applicable to the projects assigned. A copy of the form or written correspondence shall be available to the COR within one working day of its date.

(9) Maintain deficiency list and discuss with the Contracting Officer Representative all deficiencies noted during site visits.

3.3.4 Monitoring the CQC Program

(1) The Contractor shall closely monitor the CQC program to verify that the 3-phase control system is being correctly performed and that the contractor is effectively controlling all operations.

(2) Check plans and specifications against requirements.

(3) Compare elevations, grades and details shown on plans as existing, with those at the actual site.

(4) Report all errors, omissions, discrepancies, and deficiencies to the COR.

(5) Keep a posted and marked-up set of plans and specifications convenient for ready reference.

(6) Verify that the construction contractor has this same information.

(7) Anticipate construction contractor’s operations by reviewing the plans and specifications for each operation before it begins.

(8) Discuss construction contract requirements in each Preparatory Phase Meeting with the COR and construction contractor before each operation begins.

(9) Highlight and/or make notes of those provisions which need special attention, such as: (a) Unusual requirements, (b) Those which previous construction contractors have overlooked, (c) Repetitive deficiencies.

(10) Use the checklists provided by the COR to help find significant items in the construction contract plans and specifications.

3.3.5 Shop Drawings

(1) Verify submittal register for includes all shop drawings required including layouts of equipment, equipment rooms, etc.

(2) Compare the shop drawings to the construction contract requirements and report apparent differences to the COR.

(3) Verify material being installed against the approved shop drawing.

3.3.6 Safety

(1) The Contractor’s personnel shall be familiar with the provisions of EM 385-1-1, Safety and Health Requirements Manual, and the applicable Occupational Safety and Health Act (OSHA) requirements that are included in EM 385-1-1.

(2) Provide a minimum of one safety comment on each daily QAR.

3.3.7 Environmental Monitoring

(1) Receive, process, review and monitor all submittals in connection with environmental activities such as Environmental Protection Plan, Surface and Groundwater Control, Monitoring Certificates, etc.

(2) Ensure construction contractor environmental permits and authorizations are current.

(3) Monitor the construction contractor’s quality control system to assure proper execution of environmental controls at the job site such as Turbidity, Land, Water, Air, Traffic Control, Noise, Endangered Species Monitoring etc.

(4) Ensure proper submission and compare daily QC environmental reports/Summary Sheets with QA reports.

3.3.8 Geotechnical

(1) Receive, process, review and monitor all submittals in connection with geotechnical activities such as Drilling Program Plan, Instrumentation Installation Work Plan, Instrumentation Warranty, Operation and Maintenance Plan, Geotextile Layout Plan, etc.

(2) Monitor the construction contractor’s quality control system to assure proper execution of geotechnical activities at the job site such as Instrumentation installation (e.g., Piezomenters, settlement sensors, survey monuments, etc.), geotextile, drilling and grouting, wells, RipRap, etc.

(3) Review QC drilling logs and reports. Report discrepancies to the COR.

4.0 Costs and Other Contractor Responsibilities

4.1 Contract Line Item Numbers (CLINs) and Task Order Costs

This task order will be awarded on a total price basis, inclusive of travel. Figure F3 provide the CLINs that are to be used for providing total price. Do not add CLINs. If it is unclear where costs are to be listed, clarify during the solicitation period with the Contracting Officer.

4.2 Travel

Travel costs are to be provided via the appropriate CLIN(s) at time of task order proposal submission. Travel will not be reimbursed under this task order. Instead, travel will be paid based on the upfront total travel costs indicated in the proposal. Reference Figure F3 for CLINs associated to travel. All travel costs must be in accordance FAR 31.205-46 Travel Costs. For purposes of this Sample Task Order, and to ensure contractor understanding of travel regulations, it is recommended that the proposal include supporting details (e.g., flights costs, per diem costs, lodging costs) documenting the calculation of costs attributed to travel.

4.3 Payments and Invoicing

Periodic or interim payments are allowed under this task order following completion of services on no more than a monthly basis. Prior to submission of invoices, discuss and reach mutual agreement on the services to be invoiced with the COR and POC.

4.3.1 Invoice Submission

(Provided for example purposes only under this Sample Task Order.)

4.4 Reporting

4.4.1 Invoice Reporting.

On submission of their invoice, the contractor shall submit to the COR, one spreadsheet that details all previous invoices under this task order. Information shall include but not be limited to: names of all contract personnel, initial units contracted by CLIN, units expended to date by CLIN, remaining units by CLIN, percent complete by CLIN, dollars remaining, percentage of dollars remaining, and the location/locations where the services were provided. A format and included information shall be discussed at the post-award conference. The Government reserves the right to request additional information at any time.

5.0 Safety and Security

5.2 Security

The following screenings, trainings, and actions are anticipated as noted in the base MATOC. Submit the following for each individual providing QAR services under this task order (or previous document submission if provided under the base MATOC).
