C.7 Section 508 and Accessibility Requirements

Part A – Provision

Reference HHSAR 352.239-73[8] Electronic Information and [Communication] Technology Accessibility Notice.

[(Deviation)]

[(a) Any offeror responding to this solicitation must comply with established HHS Information and Communication Technology (ICT) accessibility standards. Information about Section 508 is available at https://www.hhs.gov/web/section-508/index.html.

(b) The Section 508 accessibility standards applicable to this solicitation are stated in the clause at 352.239-79 Information and Communication Technology Accessibility. In order to facilitate the Government’s determination whether proposed ICT supplies, products, platforms, information, and documentation meet applicable Section 508 accessibility standards, offerors must submit an appropriate HHS Section 508 Accessibility Conformance Checklist (see https://www.hhs.gov/web/section-508/accessibility-checklists/index.html) or an Accessibility Conformance Report (ACR) (based on the Voluntary Product Accessibility Template (VPAT) see https://www.itic.org/policy/accessibility/vpat), in accordance with the completion instructions. The purpose of the checklists and conformance reports are to assist HHS acquisition and program officials in determining whether proposed ICT supplies, products, platforms, information, and documentation conform to applicable Section 508 accessibility standards. Checklists and ACRs evaluate—in detail—whether the ICT conforms to specific Section 508 accessibility standards and identifies remediation efforts needed to address conformance issues.

(c) If an offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that supplies, products, platforms, information, documentation, or services support delivered do not conform to the described accessibility standards, remediation of the supplies, products, platforms, information, documentation, or services support to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.

(d) In order to facilitate the Government's determination whether proposed ICT supplies meet applicable Section 508 accessibility standards, offerors must submit an Accessibility Conformance Report, in accordance with its completion instructions and tailored to the requirements in the solicitation. The purpose of the Report is to assist HHS acquisition and program officials in determining whether proposed ICT supplies conform to applicable Section 508 accessibility standards. The template allows offerors or developers to selfevaluate their supplies and document, in detail, whether they conform to a specific Section 508 accessibility standard, and any underway remediation efforts addressing conformance issues.

Instructions for preparing the Template are available at https://www.section508.gov/.

(e) Additionally, offerors must provide enough information to assist the Government in determining that the ICT services conform to Section 508 accessibility standards, including any underway remediation efforts addressing conformance issues.

(f) Respondents to this solicitation must identify any inability to conform to Section 508 requirements. If an offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that supplies or services delivered do not conform to the described accessibility standards, remediation of the supplies or services to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.

(g) Items delivered as electronic content must be accessible to HHS acceptance criteria.

Checklist for various formats are available at http://508.hhs.gov/. Materials, other than items incidental to contract management, that are final items for delivery should be accompanied by the appropriate checklist, except upon approval of the Contracting Officer or Contracting Officer’s Representative.

HHSAR 352.239-78 Information and Communication Technology Accessibility Notice. (FEB 2024) (Deviation)

All solicitations

(a) Any offeror responding to this solicitation must comply with established HHS Information and Communication Technology (ICT) accessibility standards.

The template allows offerors or developers to self-evaluate their supplies and document, in detail, whether they conform to a specific Section 508 accessibility standard, and any underway remediation efforts addressing conformance issues. Instructions for preparing the HHS Section 508 Evaluation Template are available at https://Section508.gov/.

(e) In order to facilitate the Government's determination whether proposed ICT services meet applicable Section 508 accessibility standards, offerors must provide enough information to assist the Government in determining that the ICT services conform to Section 508 accessibility standards, including any underway remediation efforts addressing conformance issues.

CDCL.03 – Disclosure of Artificial Intelligence Use in Contract Performance (May 2026)

Offerors must affirmatively identify in their proposal whether or not Artificial Intelligence (AI), including Generative AI, is planned, expected, or may be used in the performance of this contract. If planned or potential AI use is identified, offerors must submit an AI Compliance and Risk Management Plan in accordance with CDCH.10 using the template provided.

L.1 General

This is a request for quotations under the simplified procedures for commercial products in RFO FAR Part 12. A quotation is not an offer and cannot be accepted by the Government to form a binding contract. The Government may issue a purchase order in response to a quotation; a binding contract is formed upon the supplier’s acceptance of the purchase order as provided by RFO

FAR 12.201-1.

L.2 Quotation Submission

Submit quotations electronically to ah78@cdc.gov no later than 22 September 2026 at 9:00 AM Eastern Time (ET). Quotations should be concise and contain sufficient information for the Government to determine technical acceptability, evaluate the quotation in accordance with Section M, and determine price reasonableness.

Products from any manufacturer may be proposed. The proposed product and configuration must demonstrate compliance with all minimum requirements in Attachment 1, Statement of Requirements.

At a minimum, the quotation shall include:

(a) Quoter Information. Legal business name, Unique Entity Identifier (UEI), CAGE code, business address, and point of contact, including telephone number and email address.

(b) Proposed Product and Configuration. Manufacturer, make/model, applicable part numbers, and complete configuration of the proposed system.

(c) Technical Compliance Matrix. A completed Attachment 2, Technical Compliance Matrix, addressing every minimum requirement in Attachment 1. For each requirement, the quoter shall:

1. Indicate whether the proposed product complies;

2. Describe how the proposed product/configuration satisfies the requirement; and

3. Identify the specific page, section, or other location in supporting manufacturer documentation that substantiates the claimed compliance.

(d) Supporting Technical Documentation. Manufacturer product literature, technical specifications, data sheets, or other documentation sufficient for the Government to verify the technical representations made in Attachment 2. General statements of compliance without sufficient supporting information may not establish technical acceptability.

(e) Expansion and Add-On Capabilities. Identification of any requirement satisfied through an optional, future, or manufacturer-supported expansion or add-on module, including the manufacturer, model/part number, and supporting documentation demonstrating compatibility with the proposed system.

(f) Software Interoperability. Documentation sufficient to demonstrate compatibility and interoperability with the Government's existing Siemens Simcenter Testlab software environment, as required by Attachment 1. This interoperability requirement does not restrict the proposed data acquisition system to a particular manufacturer.

(g) Price. Firm-fixed pricing by CLIN and total quoted price, inclusive of freight and delivery to the destination identified in the

RFQ.

(h) Delivery. Proposed delivery lead time and confirmation that the complete system can be delivered within six months after award.

(i) Warranty and Technical Support. Manufacturer's standard commercial warranty and applicable technical-support terms.

(j) Manufacturer/Reseller Status. Identification of whether the quoter is the manufacturer or an authorized reseller/distributor of the proposed system. The Government may request evidence of authorization.

(k) Software and License Terms. All commercial software licenses, end-user license agreements, or other commercial terms applicable to Government use of the proposed system.

(l) Quotation Validity. Quotation validity period of at least 30 calendar days from the quotation due date.

(m) Assumptions, Exceptions, and Deviations. Clearly identify any assumptions, exceptions, or deviations from the RFQ requirements. Any exception or deviation affecting a minimum requirement may result in the quotation being determined technically unacceptable.

The Government may determine a quotation technically unacceptable when the information submitted is insufficient to establish compliance with a minimum requirement.

L.3 Questions

Submit questions to the ah78@cdc.gov by 18 September 2026 at 2:00 PM Eastern Time (ET). Responses that affect the solicitation will be provided by amendment or other written notice from the Contracting Officer.

L.4 Communications

Only the Contracting Officer is authorized to amend the solicitation, change the Government’s requirements, or bind the Government. Technical discussions with program personnel do not change the solicitation unless confirmed in writing by the Contracting Officer.

Section M - Evaluation Factors for Award

The Government intends to make a single award to the responsible quoter whose quotation represents the best value to the Government using a streamlined comparative evaluation appropriate for a commercial product acquisition. The Government is not using FAR Part 15 source-selection procedures.

CDCM.04 Evaluation of Artificial Intelligence Compliance and Risk Management Plan (May 2026) The Artificial Intelligence (AI) Compliance and Risk Management Plan submitted as a part of the offeror’s proposal will be evaluated for quality and completeness. The AI Compliance and Risk Management Plan will be rated on a “Pass/Fail” basis considering the clearness, appropriateness, and inclusiveness of the elements described under CDCH.10.

All proposals that contain planned or potential AI use and do not contain an acceptable AI Compliance and Risk Management Plan will be considered non-responsive and ineligible for award.

The AI Compliance and Risk Management Plan may require later revision during contract performance as described in CDCH.10.

M.1 Basis For Award

The Government intends to make a single award to the responsible quoter submitting the lowest-priced technically acceptable quotation that conforms to the requirements of this RFQ and whose price is determined fair and reasonable.

The Government is not using FAR Part 15 source-selection procedures.

M.2 Technical Acceptability

Technical capability will be evaluated on an Acceptable/Unacceptable basis.

To be determined technically acceptable, the proposed product and configuration must demonstrate compliance with all minimum requirements identified in Attachment 1, Statement of Requirements.

The Government will evaluate technical acceptability using the completed Attachment 2, Technical Compliance Matrix, supporting manufacturer technical documentation, and other information submitted with the quotation.

Products from any manufacturer may be proposed. The Government will apply the same minimum requirements and evaluation standards to all proposed products.

A quotation that fails to demonstrate compliance with any minimum requirement may be determined technically unacceptable and removed from further consideration.

Capabilities exceeding the Government's minimum requirements will not receive additional evaluation credit.

M.3 Delivery and Warranty/Technical Support

The quoter must demonstrate the ability to deliver the complete system within six months after award and provide the manufacturer's standard commercial warranty and manufacturer-authorized technical support as required by the RFQ.

These requirements will be evaluated on an Acceptable/Unacceptable basis. Earlier delivery or warranty/support exceeding the stated requirements will not receive additional evaluation credit.

M.4 Price

Among quotations determined technically acceptable and otherwise eligible for award, the Government will evaluate the total quoted price, inclusive of transportation to the delivery destination.

Award will be made to the responsible quoter submitting the lowest-priced technically acceptable quotation, provided the Contracting Officer determines the price to be fair and reasonable.

M.5 Award Without Further Exchanges

Quoters should submit their best technical and price quotation initially. The Government may make award without requesting revised quotations, but reserves the right to communicate with quoters when doing so is in the Government’s interest.
