About this file
This document is a Justification & Approval for Other Than Full and Open Competition for a simplified acquisition at Crater Lake National Park. The procurement involves repairing a 2021 Caterpillar 150 AWD road grader with a bad bearing around the transmission flywheel housing, which currently cannot be driven or used. The total repair cost is $44,252.32, quoted by the Caterpillar dealership in Klamath Falls, OR, with a 45-day completion timeline.
The justification is based on urgent and compelling circumstances, specifically the critical need for snow removal equipment. The grader is essential for maintaining park roads during winter, when approximately 500 inches of snow can accumulate. Without this equipment, there are potential public safety risks such as motorist spinouts, impassable roads, and uneven road wear. The repair will be conducted exclusively by Caterpillar due to their proprietary parts and software, and no alternative market research was performed. The document is signed by Zane Johnson, Chief of Facilities Management, and Phaedra Fuller, Contracting Officer, with a procurement request number of 0044027266.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT
(See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Crater Lake National Park has a requirement to repair a 2021 Caterpillar 150 AWD road grader that has a bad bearing around the transmission flywheel housing. The equipment cannot be driven or used at this time. The grader was hauled to the local Caterpillar dealership in Klamath
Falls, OR for the initial inspection and determination of how to repair it and there it currently remains. CRLA’s Facilities Roads branch tried to get by without this piece of equipment however, the daily use of this equipment is required for the crew to successfully complete their work.
To access and replace the bad bearing located by the transmission flywheel, Caterpillar will need to remove the engine, transmission and both rear drive axles. Once the new bearing is installed, the dealership will use its proprietary computer software for this equipment to re-install the components to factory specifications and ensure the unit is performing at its intended levels.
The Government’s cost for replacing the bad bearing is $44,252.32, as quoted by Caterpillar as a firm-fixed total price that includes parts and labor.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
__X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain:
The operation of this grader is critical to the equipment fleet needed for snow removal in order to keep the park open during winter months. In the winter season the park receives approximately
500 inches of snow. Without a fully operational rotation of equipment, there is a danger of snow accumulating on the roadway, possibly leading to public safety risks such as motorists spinouts on snow or ice or impassible roads. Inconsistent snow plowing can also lead to uneven wear and potholes on the 36 miles of road leading into the park. The grader is currently at the closest

Caterpillar dealership in Klamath Falls, OR where an inspection and diagnosis was made. The quote includes a timeline of completing the repairs in a 45-day period.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Since this equipment may only be serviced by its manufacturer, Caterpillar, who uses proprietary parts and software, extensive market research was not conducted. Caterpillar has their own parts, service, trained and certified mechanics able to make the necessary repair so no other repair shop was consulted. The dealership in Klamath Falls has been determined to be the closest in proximity to CRLA.
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
