About this file

This document is a Justification & Approval for Other Than Full and Open Competition for a Simplified Acquisition over the Micropurchase Threshold up to the Simplified Acquisition Threshold. The National Park Service has a requirement for up to 130 tons of colored gold StaLok Paving Material to be delivered to the North Rim Lodge at Grand Canyon National Park, AZ. StaLok Paving Material is the only product that meets the logistical and aesthetic requirements for applying an improved tread material onto the Bright Angel Point Trail. Stabilizer Solutions is the sole source provider of this proprietary product and technical support in the local region. The anticipated cost for this requirement is below $50,000. The National Park Service intends to issue a sole source award for the purchase and delivery of the StaLok paving materials under the authority of FAR 13.106-1(b).

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD UP TO SAT (See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Park Service (NPS) has a requirement for up to 130 tons of colored gold StaLok® Paving

Material delivered to the North Rim Lodge at Grand Canyon, AZ. StaLok® Paving Material was found to be the only option that meets the logistically limited options of applying an improved tread material onto the Bright Angel Point trail. The StaLok® Paving Material, being largely comprised of natural aggregate and soil that can be manufactured to blend with its surroundings, matches the rustic aesthetic that is an important component of Grand Canyon’s management plan of the North Rim.

StaLok® Paving Material, with its proprietary hydrophobic polymer blend, is capable of giving soil particles increased strength, but still allowing them to act like soil particles and maintain flexibility. This takes advantage of natural load bearing and shear strength from the soil structure. Flexibility prevents the material from becoming too rigid like other pavements. The result is increased traffic resistance, water resistance, and flexibility in installation, expansion and repairs.

The material to be procured is petroleum free and meets NPS initiatives to eliminate petroleum products on our trails. The product also compacts firmly and meets the needs to providing access to the initial portions of the Bright Angel Point Trail to people who use wheelchairs for mobility.

This paving material also reduces maintenance due to its strong yet flexible hydrophobic nature. When water is repelled by the trail surface puddles and mud are reduced, therefore ruts are reduced, and the trail surface stays smooth and intact. As the freeze thaw cycle occurs the trail surface moves with the expansion of the ground beneath, greatly increasing the amount of time before cracks form.

The anticipated cost for this requirement is below $50,000.00 based on the IGE for the projected tonnage and delivery.

2. Sole Source Justification rationale (Check one and explain below):

Only one responsible source.

Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Other

Explain: 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

Stabilizer Solutions is the only vendor in the local region (located in Phoenix, AZ) providing this proprietary product and technical support.

3. Market Research. No other vendors can provide this material in the local region.

Nevertheless, research was committed to looking into other possible products. Other products considered were Hot

Mix Asphalt (HMA), Cold Patch Asphalt, and Concrete. Most other options were found as not viable largely due to the isolation of the North Rim of Grand Canyon, the primitive, and very limited access of the Bright Angel Point hiking trail (location where product must be applied), coupled with the inability to operate heavy equipment to apply the other products such as HMA and concrete. Further reasons other products were not viable include the inability to apply some products as a full-scale tread improvement solution for a hiking trail. It was also recognized that no other product was found that could serve as an improved trail tread for a hiking trail yet still maintain the rustic aesthetic that the North Rim of Grand Canyon is managed for.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
