About this file
This document is a Justification & Approval for Other Than Full and Open Competition form for an emergency HVAC repair at the White Sands Entrance Station. The National Park Service requires urgent repair of the facility's heating and air conditioning unit due to a refrigerant leak under the concrete slab, which is causing cooling failures and creating potential health and safety risks for employees and visitors. The proposed solution involves moving the outdoor condenser unit to the roof and re-running refrigerant and electrical services, which is deemed the most cost-effective approach.
The document indicates that local HVAC companies may not be able to complete the repair within the necessary timeline, justifying a sole source acquisition. The contracting officer certified the urgent and compelling circumstances on 6/5/2025, approving the use of sole source acquisition procedures for this emergency repair. The repair is critical for maintaining operational functionality at the park's primary visitor entrance point, where temperatures were reported to be in the mid to upper 80's, necessitating immediate action.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD UP TO SAT
(See FAR Part 2 and FAR 13.106-1)
A. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The White Sands Entrance Station serves as the primary facility for Visitor's entering the park to receive safety information and for paying entrance fees. The building is not historic, however, compliance has been completed relating to these repairs to the Heating and Air Conditioning unit as it is adjacent to the Park's Historic District.
The Heating and Air Conditioning unit on the Entrance Station is not operating and thus becomes a life and health issue for employees working in this facility and to those Visitor's who receive safety information at this point of contact. Temperatures are currently between the mid to upper 80's.
B. Sole Source Justification rationale
______Only one responsible source.
__X____ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
a. Circumstances In April 2025, we had a technician come to perform an assessment on the Heating and Air Conditioning unit as it was not cooling the facility. The diagnoses initially was it was low on refrigerant and that was remedied by technician, but this did not last long before the building was not being cooled. The second visit from technicians we learned there is a leak under the concrete slab of the building. The technician generated a proposal for work to be done which involves moving the outdoor condenser unit to the roof and re-running the refrigerant and electrical services. This is the most cost effective way because other methods would involve jackammering
b. Other Capable Sources In researching other local HVAC companies that may be able to provide same services it was found that they may not be able to do so in a timeline adequate for this emergency repair to a critical operational facility in the park. This repair requires both licensed HVAC technicians and licensed electrician.
c. Barriers to Competition
Given this is an emergency repair in the future other local companies will have equal ability to compete for such work when we are not in need of expedited services.
If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
C. Contracting Officer Certification and Approval
Based on the above justification, I hereby certify that the circumstances of this contract action deem only one source reasonably available and approve the use of sole source acquisition procedures for this purchase.
