SECTION 01 10 00

MOBILIZATION AND PREPARATORY WORK

PART 1GENERAL
1.01MEASUREMENT AND PAYMENT
A.Mobilization and Preparatory Work:
1.Payment: Lump sum price offered in schedule A.
a.General. Payment for the Mobilization and Preparatory Work line item of the

schedule will be made as reflected herein. To the extent that this line item exceeds 5.0 percent of the total contract pricing, payment will be made as reflected in B.5.

B.Progress payments for mobilization and preparatory work will be made as follows:
1.The Government will reimburse the Contractor for the total amount of premiums

paid for performance and payment bonds as required by the Performance and Payment Bond Requirements clause of this contract and for any insurance required as payable by the Government under this contract.

2. Except as provided in B.1, progress payments for mobilization and preparatory work shall not be considered a separate division of work for the purposes of progress payments and shall be subject to retainage before payment of the total amount for this contract line item.

3. When progress payments totaling 5 percent of the total original contract amount have been made by the Government for all other work accomplished under the contract, the Government shall pay the Contractor 50 percent of the mobilization and preparatory work contract line item amount or 5.5 percent of the total original contract amount, (whichever is lower), exclusive of any payment already made to the Contractor for performance and payment bond premiums and specified insurance under B.1.

4. When progress payments totaling 10 percent of the total original contract amount have been made by the Government for all other work accomplished under the contract and upon approval of the baseline schedule, the balance of the amount for the mobilization and preparatory work contract line item or 11 percent of the total original contract amount, (whichever is lower), shall be paid to the Contractor.

5. If the contract amount for mobilization and preparatory work exceeds the total of the payments allowed under B.3 and B.4 above, the balance shall be paid when the contract work is substantially complete as determined by the Contracting Officer.

C. Termination for default: Should the Contractor be terminated for default as provided by the Default clause of this contract:

1. All facilities, plant, and equipment on the site shall be subject to the Government's right to take possession of and utilize such items for the purpose of completing the work;

2. The Contractor shall provide evidence of encumbrances, liens, or other security interests, to the Contracting Officer; and

3. Any encumbrance, lien, or other security interest on such facilities, plant, or equipment shall be subordinated to the Government's rights under the Default clause of this contract to utilize all facilities, plant, and equipment to complete the work under the contract.

PART 2PRODUCTS
2.01MOBILIZATION AND PREPARATORY WORK OPERATIONS
A.The Contractor shall provide operations including, but not limited to, those necessary for:
1.Movement of personnel, equipment, supplies, and incidentals to the project site;
2.The establishment of offices, buildings, plants and other facilities, at the site,

(excludes temporary buildings - e.g. storage sheds, shops, offices) and utilities listed in the Temporary Utilities section of this contract;

3.Payment of premiums for project bonds and insurance and;
4.Other work and operations to be performed or incidental costs incurred for the

initiation of meaningful work at the site where the contract does not otherwise provide for payment.

5.Approved RSN 01 32 10-1, Baseline Schedule.
B.Facilities and equipment covered by mobilization work:
1.Facilities, plant, and equipment which are established at, or brought to, the site shall

be deemed to be subject to the provisions of this paragraph unless the Contracting Officer specifically provides other written authorization for a particular item or items.

2. The Contractor shall be solely responsible for the adequacy, efficiency, use, protection, maintenance, repair, and preservation of facilities, plant, and equipment on site.

3. Facilities, plant, and equipment covered by this paragraph shall not be dismantled or removed from the site prior to completion of the work under the contract without written authorization of the Contracting Officer.

SECTION 01 11 00

SUMMARY OF WORK

PART 1GENERAL
1.1LOCATION
A.Work is located at Pasture Canyon Dam approximately 1.5 miles NE of Tuba City, in

Coconino County, Arizona.

1.2PRINCIPAL COMPONENTS OF WORK
A.Excavation of existing spillway, outlet works, and downstream slope of embankment.
B.Construction of concrete overtopping protection at current spillway location.
C.Removal and disposal of existing outlet works structures.
D.Removal and disposal of existing siphon.
E.Foundation improvement beneath new outlet works structures.
F.Construction of new outlet works structures.
G.Furnishment and installation of Zone 2 fine filter material, Zone 3 coarse filter material

along downstream slope of embankment. Cover filter with Zone 1 embankment.

H. Furnishment and installation of toe drain pipe surrounded by Zone 2 fine filter and Zone 3 coarse filter at downstream toe of embankment, and Zone 2 fine filter material in trench below new toe drain. Cover toe drain with Zone 1 embankment.

I. Replacement of low-voltage electrical distribution equipment associated with the outlet works slide gate hydraulic power unit and gate controls, (HPU), including combination starters, conduit system, grounding system, conductors and cables, and associated electrical equipment.

J.Excavation of reservoir sediment may be awarded.
1.3SPECIFICATIONS REQUIREMENTS
A.Requirements in Division 1, General Requirements, apply to Divisions 2 through 53.
B.Imperative statements in these specifications are Contractor requirements, unless

otherwise stated.

1.4DEFINITIONS
A.When the specifications use a word or term defined in the Federal Acquisition

USE OF SITE

PART 1GENERAL

1.3SUBMITTALS
A.Submit the following in accordance with Section 01 33 00 - Submittals.
B.RSN 01 14 10-1, Land Use and Landscape Rehabilitation Plan:
1.For each Contractor use site on Tribal land.
a.Show use location and extent of impact. Uses include but are not limited

to the following:

1) Buildings and service areas including offices, shops, warehouses, storage areas, fuel and oil storage areas, and fabrication yards.

2)Parking areas, temporary roads, and haul routes.
3)Utilities including air, power, and water lines, fire hydrants, and

compressor station.

4)First-aid and medical facilities.
5)Temporary fences.
b.Describe methods to preserve, protect, and repair if damaged, vegetation,

(such as trees, shrubs, and grass), and other landscape features on or adjacent to the jobsite, which are not to be removed and which do not

Use of Site 01 1410 - 1 interfere with the work required under this contract. Include methods to mark work area limits, protect disturbed areas, and prevent erosion.

c. Describe methods to protect, and repair if damaged, existing improvements and utilities at or near the jobsite.

d. Describe methods for removing temporary structures and facilities, cleanup, and rehabilitating site after completion of construction activities.

e. Describe methods for preventing spread of invasive species in the project area during construction.

1) Herbicides, application techniques, and applicator will be approved by the Hopi Environmental Protection Office.

2. Submit revised drawings of changes in use of Government land made during design and erection stages or after use of Government land is in operation.

1.4PROJECT CONDITIONS
A.Tribal land, as shown on drawings, may be used for required construction facilities.
B.When private land is used for construction facilities, or other construction purposes, make

necessary arrangements associated with use of private land.

C. Location, construction, operation, maintenance, and removal of construction facilities on Tribal land will be subject to approval of the COR.

D. Do not interfere with work of other contractors or the Tribe in vicinity, or with reservations made by the Tribe for use of such land.

E. Housing for construction personnel will not be permitted on Government land, except housing for guards or watchmen as may be approved by the COR.

PART 2PRODUCTS
2.01COR FIELD OFFICE
A.Provide temporary field office:
1.Weather tight with lighting, electrical outlets, heating and cooling equipment.
2.No less than 120 square feet of clear floor space.
a.Include locking closet or storage.
3.Heating and Cooling:
a.Minimum temperature: 65 degrees Fahrenheit.
b.Maximum temperature: 75 degrees Fahrenheit.

4. Power: Provide electrical power for lighting, computer operation, fax machine, refrigerator, water cooler, and at least 3 additional duplex outlets.

5.Furnishings:
a.One plan table sized for full size drawings.
b.One, two-drawer filing cabinet.
c.No less than 6 chairs.
6.Approval required by COR prior to ordering.
PART 3EXECUTION
3.1CLEANING
A.Construction Equipment:
1.Before bringing on site, clean construction equipment to remove dirt, vegetation,

and other organic material to prevent introduction of noxious weeds, and invasive plant and animal species.

2. Contractor cleaning procedures shall result in equipment being cleaned as well or better than the procedures described in Cleaning Manual.

3. COR will inspect construction equipment following procedures described in USBR Cleaning Manual before allowing the equipment onsite.

4. Contractor to obtain approval from COR on removal and prevention plans for possible invasive species within the project area.

3.2RESTORATION
A.Restore Contractor use areas to pre-construction condition.
B.Restore temporary construction roads to original contours and make impassable to

vehicular traffic when no longer required.

C. After completion of work, regrade and scarify Tribal land used for construction purposes and not required for completed installation so that surfaces blend with natural terrain and are in a condition that will facilitate revegetation, provide proper drainage, and prevent erosion.

SECTION 01 29 00

THE HOPI TRIBE BUSINESS LICENSE APPLICATION

CONSTRUCTION PROJECTS

PART 1GENERAL
1.1MEASUREMENT AND PAYMENT
A.Cost:
1.Include in prices offered in price schedule A for other items of work.
1.2SUBMITTALS
A.Submit the following in accordance with Section 01 33 00 - Submittals.
B.RSN 01 29 00-1, Copy of Prime Contractors Hopi Business License for Construction

Projects.

C. RSN 01 29 00-2, Copy of All Subcontractors Hopi Business License for Construction Projects.

1.3CONTRACTOR RESPONSIBILITY
A.The Contractor shall be responsible for complying with The Hopi Tribe’s procedure for

obtaining a business license including payment of applicable fees and compliance with applicable Hopi Tribal Employment Rights and Hopi Environmental Protection requirements for the license.

1. Obtain current information regarding applicable fees and contacts from the Hopi Tribe Office of Revenue Commission, P.O. Box 123, Kykotsmovi, AZ 86039, or by telephone: 928-734-3172.

B. The Contractor shall ensure that each Subcontractor obtains appropriate business license in connection with the work.

C. Hopi Tribe Business License applies to work being performed within the boundaries of the Hopi Reservation.

1.4FEE
A.The Hopi Tribe Business License Fee for Construction Projects is based on contract

amount for Prime and Subs. The following table lists the fees as of January 1, 2015.

THE HOPI TRIBE EMPLOYMENT RIGHTS

PART 1GENERAL
1.1MEASUREMENT AND PAYMENT
A.Hopi Tribe Employment Rights; (TERO):
1.Payment: Lump sum price offered in price schedule A, B, C, D, and E.
a.Payment for The Hopi Tribe Employment Rights fees will be made at

appropriate percentage of total contract amount shown below.

b. Price shall include only the amount to be paid to the Hopi Tribe for the fee and shall be due prior to commencement of work.

1.2SUBMITTALS
A.Submit the following in accordance with Section 01 33 00 - Submittals.
B.RSN 01 29 10-1, Proof of Payment for Tribal Employment Rights Fees to the Hopi Tribe

Prior to Commencement of Work.

C.RSN 01 29 10-2, Prime Contractor - Tribal Employment Rights Compliance Plan.
D.RSN 01 29 10-3, Subcontractor - Tribal Employment Rights Compliance Plan.
1.3CONTRACTOR COMPLIANCE AND RESPONSIBILITY
A.In addition to the requirements of the clauses entitled “Indian Preference - Department of

the Interior” and “Indian Preference Program - Department of the Interior,” the Contractor shall comply with the Hopi Labor Code.

B. As part of the business licensing process the Contractor is required to submit a compliance plan to the Hopi Tribal Employments Rights Office indicating arrangements to fulfill the requirements of the Hopi Labor Code.

1. Contractor shall be responsible for contacting the Office of Revenue Commission and complying with Hopi Environmental Protection requirements to obtain the license.

2. Contractor shall ensure that each Subcontractor provides an acceptable compliance plan to the Tribe in connection with the work.

3. Contractor shall obtain current information regarding the Hopi Labor Code and licensing contacts from the Hopi Tribal Employment Rights Office, P.O. Box 123, Kykotsmovi, AZ 86039, or by telephone: 928-734-3162.

C. Contractor shall also be responsible for paying, to the appropriate authorities, all applicable Tribal Employment Rights Ordinance (TERO) fees and taxes.

1. As of January 1, 2015, the employment rights fee was 1/2 of 1 percent, (0.5 percent) of the total contract price, (excluding amounts bid for tribal fees or employment fees).

a. This fee is separate from and in addition to the fees required for The Hopi Tribe Business License Fee for Construction Projects discussed in Section 01 29 00 - The Hopi Tribe Business License Application - Construction Projects.

b. Copies of the Hopi Labor Code and other information on current fees which are applicable to this contract can be obtained from the Hopi Tribal Employment Rights Office, P.O. Box 123, Kykotsmovi, AZ 86039, or by telephone: 928-734-3162.

1.3CONTRACTOR RESPONSIBILITY
A.Contractor shall develop and submit an Environmental Protection Plan (EPP) to the Hopi

Tribe’s Environmental Protection Office as a condition of obtaining a business license.

B. Contractor shall ensure that each Subcontractor obtains appropriate business license and amends the EPP as necessary in connection with the work.

C. The requirement for a Hopi Tribe Business License process and EPP applies to work being performed within the boundaries of the Hopi Reservation.

D. The Contractor shall obtain current information the Hopi Tribe Environmental Protection Office, P.O. Box 123, Kykotsmovi, AZ 86039, or by telephone: 928-734-3632.

E. The Contractor may obtain a copy of the Environmental Assessment (EA) for the project from Reclamation.

PART 1GENERAL

schedule A for mobilization and preparatory work.

2. Updating and Using Construction Program: Include as an element of Contractor’s overhead.

1.3DEFINITIONS
A.Schedule: The Critical Path Method (CPM) of planning and scheduling a construction

project where activities are arranged based on activity relationships and network calculations determine when activities can be performed and the critical path of the project.

B. Project Calendar: Cross reference of numerical work days with calendar days. The project calendar serves as the basis for the day/date conversion and assigns work days and non-workdays.

C. Resources: Equipment, labor or crews, materials, subcontractors, fabricators, manufacturers, and consultants.

D. Out of Sequence Work: An activity that starts before its predecessor activities are completed.

1.4SUBMITTALS
A.Submit the following in accordance with Section 01 33 00 - Submittals.
1.Furnish database files in format compatible with Microsoft Project or Primavera

P6 Project Manager.

2. Furnish schedule and database files on CD-ROM disc.

3. Upon request, provide information and data used to develop and maintain the Construction Program to the CO.

C.RSN 01 32 10-2, Updated Schedule:
1.Include:
a.Bar chart for project or bar charts for each sub network.
b.Construction Program database with updated activity and milestone data.
c.Definition of workday calendars.
d.Narrative report specifically stating status of project in terms of total float.
1)If negative float exists, cite specific actions and conditions which

caused the "behind schedule" condition and provide proposed course of action to complete the project within the specified delivery time.

2) List of Contractor-initiated changes to current schedule stating reason for action taken and unresolved issues relating to the Construction Program. Government reserves the right to reject Contractor-initiated changes to current schedule which negatively impact Government action which was initiated on the basis of current schedule.

1.5SCHEDULES AND TIME IMPACT ANALYSIS
A.Develop, maintain, and use approved Construction Program to plan, monitor, and

evaluate, and report accomplishment of work.

B. Failure to include any element of the work will not release Contractor from completing all required work under the contract.

C.Construction Program:
1.Prepare detailed activity network for accomplishing required work.
2.Prepare schedule based on required sequence and interdependence of activities.
3.Include work of subcontractors, Government interfaces, and contract milestones.
4.Include contract title, contract number, and Contractors’ name on each sheet.

5. Define construction activities to a level of detail resulting in their durations being no greater than 25 workdays.

6.Adjust Construction Program for seasonal weather conditions.
7.Use durations in units of whole workdays.
D.Baseline Schedule:
1.Represents Contractor’s as-planned approach to accomplishing the work. Do not

include actual start dates, percent completes, or actual finish dates.

2.Include planned start and completion dates for features of work.
E.Updated Schedule:
1.Enter actual progress.
F.If, in the opinion of the CO, the Contractor falls behind the approved schedule,

Contractor shall take steps necessary to improve progress, including those that may be required by the CO.

1. The CO may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting officer deems necessary to demonstrate how the approved rate of progress will be regained.

2. Costs for actions required to improve progress will be the responsibility of the Contractor.

G.Contract Modification or Delay:

1.6FAILURE TO COMPLY

1.5SUBMITTALS PROCEDURES
A.Submit only checked submittals. Submittals without evidence of Contractor's approval

will be returned for resubmission.

B. Submit complete sets of required materials for each RSN as specified in “Submittals required” column in Table 01 33 00A - List of Submittals. A complete set includes all listed items for RSNs with multiple parts.

C. Submit number of sets specified in “No. of sets to be sent to:” columns in Table 01 33 00A - List of Submittals.

D.Include the following information in transmittal letters:
1.Contract number and title.
2.RSN for each attached submittal.
3.Responsible code.
4.Number of sets for each RSN.
5.Identify submittal as initial or resubmittal.
E.Resubmittal of submittals not approved:
1.Mark changes such that they are readily identifiable and show revision date.
2.Describe reasons for significant changes in transmittal letter.
3.Resubmit returned submittals within 28 days after receiving the comments, unless

otherwise directed.

4.Requirements for initial submittals apply to resubmittals.
F.More than one RSN may be submitted under a transmittal letter, provided the responsible

code is the same.

1.6REVIEW OF SUBMITTALS
A.Time Required:
1.Submittal review will require 28 days for review of each submittal or resubmittal,

unless otherwise specified.

2. Time required for review of each submittal or resubmittal begins when complete sets of materials required for a particular RSN are received and extends through return mailing postmark date.

B.Time in Excess of Specified:
1.CO may extend contract completion date to allow additional time for completing

work affected by excess review time.

a. Time extension will be to the extent that excess review time caused delay to the contract completion date.

b. The time extension will not exceed the time used in excess of the specified number of days for review of submittals or resubmittals.

c. Concurrent days of excess review time resulting from review of two or more separate submittals or resubmittals will be counted only once in extending the contract completion date.

2. No time extension will be allowed if Contractor fails to make complete approval submittals in sequence and within time periods specified.

3.Adjustment for delay will be made only to the extent that:
a.Approval was required under the contract, and
b.Requests for approval were properly and timely submitted and were

approved.

4. Adjustment will be subject to terms of paragraphs (b) and (c) of the clause at FAR 52.242-14, Suspension of Work; however, no such delay shall be deemed to be a “suspension order” as the term is used in that clause.

C.Return of Submittals:
1.Action Submittals: One set of submittals required for approval will be returned

either approved, approved subject to identified changes, or not approved.

a.Revise and resubmit for approval submittals not approved.
b.Do not change designs without approval of the CO after approval

drawings, documentation, and technical data have been approved.

2. Informational Submittals: Government will acknowledge Informational submittals.

a. Informational submittals will not be returned when they comply with specifications.

b. Informational submittals that do not comply with specifications may be returned for resubmittal or additional information may be requested.
