IN REPLY REFER TO:
Justification for Brand Name Products
Date: 06/04/2021
Project: SCBA breathing apparatuses for structure fire, Yellowstone National Park
1. Identifications
a. Agency: National Park Service
b. Contracting Office: Northern Rockies Major Acquisition Buying Office
2. Description of the action being approved:
The National Park Service (NPS) is soliciting for SCBA breathing apparatuses for the Structure Fire Department. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR).
3. Description of supplies and services:
The structural fire department needs to add additional SCBA to its operational inventory Yellowstone National Park currently utilizes 60 Self-Contained Breathing Apparatus (SCBA), brand name SCOTT only.
To utilize those SCBA's Yellowstone National Park purchased 120 SCBA air bottles and approximately 150 SCBA masks.
To utilize the inventory of SCBA bottles and SCBA masks requires staying with the SCOTT brand for compatibility reasons.
Yellowstone National Park utilizes 60 SCBA's units that utilize the Snap-Change bottle available for SCOTT SCBA's only.
To ensure that a mix of SCBA models in the Yellowstone operation doesn't create a hazard to the fire fighter, the Fire Management team requires the same brand to ensure regardless of apparatus a spare SCBA bottle is removed from it will fit the wearers SCBA back-plate.
If a firefighter had a failure of their SCBA they could take an extra off of any apparatus and the SCBA mask they have been fitted for would connect with the extra SCBA."
4. Authority:
a. 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.
b. FAR Part 11.105: The Brand Name products are essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet and cannot be modified to meet the agency’s needs.

c. FAR 6.302-1: The use of the name brand products is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
5. The description of the product’s unique qualifications or the unique nature of the acquisition:
The Park Service current inventory of SCOTT SCBA’s and additional spare components Other brand would cost the Government in additional testing equipment, training, repair components.
The possibility of employee safety due to multiple devices and functions.
The SCBA are worn on all Fire Fighters (mandatory) when entering a building that is on fire or has a potential hazard. The operation of these SCBA must be universal and the operational methods must be well known to ensure proper function during time of high stress and the potential hazards of entering a building during a fire or emergency response.
6. Efforts to obtain competition:
a. Efforts to ensure offers are solicited from as many potential sources as is practicable:
Request for quote will be issued to against NAICS 339113.
b. Presolicitation notice per FAR 5.2:
Request for quote will be issued against NAICS 339113.
7. Determination that costs will be fair & reasonable:
SCBA equipment is available through vendors under NAICS 339113 with numerous vendors providing pricing on this brand name item.
8. Description of the market research conducted:
There are other companies the produce SCBA’s / they do not function identically as the
SCOTT’s this is a critical feature in the justification of brand name only.
The Fire department management has used other brands on demonstration purposes and none of them function exactly as the brand requested
9. Other facts supporting other than full & open competition:
a. Reason why documents suitable for full & open competition have not been developed:
Park Service in stock replacements components are compatible with current models being used The SCOTT SCBA’s currently used in the park are compatible with current testing equipment and not compatible with other brands.
The Park would have to purchase additional testing equipment, replacement components and additional training requirements.
b. Data, estimated costs or other rationale as to the extent or harm to the Government:
Safety: to Visitor, employees and emergency response teams, Cost: additional equipment / testing, cleaning and replacement parts
10. Interested Sources:
All vendors meeting NAICS 339113 size standard and providing SCOTT SCBA equipment.
11. Actions to remove barriers to competition in the future for similar acquisitions:
Barrier will be removed if a complete overhaul of all SCBA’s is required or functionality of such changes.
12. Certifications:
Technical / Requirements Certification:
